AFFIDAVIT
I, [state Name and NRIC] of [state address], the above mentioned Plaintiff/Defendant* affirm/make
oath* and say as follows:
1. I am the Plaintiff/Defendant*.
2. The facts deposed to herein are either within my personal knowledge or derived from the file in
my possession and are true to the best of my knowledge, information and belief.
3. I crave leave of the Court to refer to the Order of Court dated [date].
4. In the said Order of Court, it was ordered that the matrimonial property at [state address] shall be
[state the contents of the Order of Court in relation to the matrimonial property].
5. The Court also made orders for the Registrar or Assistant Registrar of the Family Justice Courts
to be empowered to sign the documents relating to the sale/transfer* of the matrimonial property
(“Sale/Transfer* Documents”) in the event that either party fails to execute the same upon being
given [7/14/other specified time] days’ written notice.
6. Under the Order of Court, the sale/transfer* is to take place within [state the period specified in

of Court] of the Order of Court has not been exceeded as at the date hereof.

letters to the Plaintiff/Defendant*’s attention because [ state basis of belief, e.g. the address
belongs to the Plaintiff/Defendant*’s parents and the Plaintiff/Defendant* currently lives with
his/her* parents].
11. Despite these attempts, the Plaintiff/Defendant* has failed to sign and execute the Sale/Transfer*
Documents.

of Court and given the requisite [7/14/other specified time] days’ written notice to the
Plaintiff/Defendant*.
13. I declare that as at the date of deposition of this affidavit, I am unaware of any pending
application(s) affecting the validity or execution of the Order of Court, including but not limited
to an existing undisposed appeal; application(s) for the stay of execution pending appeal;
variation and/or setting aside of the Order of Court.
14. In the circumstances, I humbly pray for the Registrar to exercise his powers pursuant to the Order
of Court dated [state date] to sign the Sale/Transfer* Documents as the Plaintiff/Defendant* has
defaulted in signing the same.
