This cemetery is not considered extraterritorial. According to a history written by its first superintendent, Mr. R. Warren Davis: "During the construction period, Madame Perle Mesta, U.S. Minister, and His Excellency Mr. Joseph Bech, the Luxembourg Minister of Foreign Affairs, signed an Accord (March 20, 1951) by which we received the use of the land in perpetuity. Outright title to the land had been offered, but this would have raised a problem of extra- territoriality, which was considered undesirable." Davis was superintendent from early 1946 until the second half of the 1960s. The full text of the history by Davis is available on a page of the Patton Society website: http://www.pattonhq.com/funeral.html If there is ever a security problem in this cemetery the Luxembourg police will take care of it (this was the wish of the US government when the treaty was signed in 1951). There are no US active-duty military personnel stationed here. The cemetery, however, and its American superintendent and his assistant, enjoys full exemption from taxation in Luxembourg. Also, unlimited quantities of water for both drinking and irrigation are provided free of charge to the cemetery by the City of Luxembourg.
