These templates are bogus. There is no pan-EU copyright law, only a copyright directive, with no direct power of law. Each member state has its own copyright laws, hopefully following, but possible modifying the directive. These templates need to be replaced with individual countries' templates. - The EU directive is very loose and every country implements it quite differently, usually based on pre-existing copyright laws. Additionally, there is quite a solid chunk of case law that differs widely per country. By your logic, we would not need to list individual EU countries in Copyright rules by territory or could remove any country-specific PD templates. This template was more or less created as wishful thinking. If we wanted to keep it, we would need to investigate each member state's copyright laws and list exceptions in the template to prevent misuse. - We should really link the relevant directive from the template, since I was looking through the wrong one. But both, the German and Austrian laws, limit the copyright term to 70 years after creation if not published within 70 years, a provision not found in the directive. In the German law, the author does not need to reveal themselves, their heirs are also allowed to. And maybe most importantly, the definition of "anonymous" can vary quite a bit. From what I understand, in German law this usually means that an author actively meant to stay unknown, while here it is usually interpreted to mean "the author is unknown", which is quite a difference. - Article 1.6 of the 2006 Copyright Term Directive: In the case of works for which the term of protection is not calculated from the death of the author or authors and which have not been lawfully made available to the public within 70 years from their creation, the protection shall terminate. So yes, that 70 term from creation if not published (or rather, made available to the public) is part of the EU directive, and should be present in all current EU laws. As for whether only the author or heirs are allowed to make authorship public, Article 1.3 also arguably allows for the author's name becoming known at any time before the 70 years are up, be that after death or not. - The difference in 'anonymous' comes from Article 10 of the 2006 Directive: if a longer copyright term was in force for an existing work before July 1995 (or something), then the longer term remains in force for that work. - Yes, there are some cases where previous terms could be longer -- sometimes where unpublished works once had an infinite copyright. Differences in "anonymous" and if an older term "already running" by 1995 can be gray areas, though sometimes hard to define. If the old definition of anonymous was stricter, and so in theory based on someone's life but there is no possible way to know when that life ended and so had no defined expiration, was the old term "already running" per the EU directive? If there was a definite older term, sure, but if the old law was simply ambiguous it makes it harder to follow those older laws, especially in the absence of case law which clarifies how they worked. But sure, there are some countries which could have a more specific tag. Most though can just use the more general tag, since outside of some edge cases they are mostly the same. - Keep EU directive 2006/116/EC lists three rules for anonymous works. From article 1:
3. In the case of anonymous or pseudonymous works, the term of protection shall run for 70 years after the work is lawfully made available to the public. However, when the pseudonym adopted by the author leaves no doubt as to his identity, or if the author discloses his identity during the period referred to in the first sentence, the term of protection applicable shall be that laid down in paragraph 1.
6. In the case of works for which the term of protection is not calculated from the death of the author or authors and which have not been lawfully made available to the public within 70 years from their creation, the protection shall terminate.
- From article 10:
1. Where a term of protection which is longer than the corresponding term provided for by this Directive was already running in a Member State on 1 July 1995, this Directive shall not have the effect of shortening that term of protection in that Member State.
- This template takes care of the rules in article 1. It is possible that we should also require a template for the rule in article 10, in addition to this template. For example, under Swedish law, an anonymous work created before 1 July 1995 is protected for 50 years from publication if published during the lifetime of the anonymous author, or for 50 years from the death of the anonymous author if not published during the anonymous author's lifetime. It's up to the person using a work to prove that the anonymous author has been dead for at least 50 years if the work was first published less than 50 years ago - the person claiming to be the copyright holder only needs to prove that the author possibly was alive less than 50 years ago. On the other hand, the person claiming to be the copyright holder needs to prove that he is the copyright holder, which probably usually requires showing who the author is (and from that information, finding the death year should be trivial). Due to the old Swedish law, the copyright term may longer than the one stated in this template if the work wasn't published for some time. - Directive 2006/116/EC (which regulates copyright terms) applies to the EEA.
- If you are using a work in Algeria, then you use Algerian copyright law. If you are using a work in France, then you use French copyright law. The EU directive is only part of French law but not of Algerian law. The source country (where Commons requires it to be in the public domain) is 'the country of first publication' and so you would have to figure out whether the law states that publication in Algeria during French rule constitutes publication in France or whether it constitutes publication in Algeria. - Colonies typically had their own law -- many times the European nation applied their copyright law, or most of it, to the colony but there was still a separate legal history for the colony. Colonies may have been part of the Berne Convention but would have had to reaffirm when they became independent if they were only a member via the colonizing country. As one example, India separately joined the Berne Convention in 1928 or so, long before it became independent. - Labeling this file "Redundant" not only sounds bad, it's not correct.
- Firstly, this file is published by NASA. Therefore, it's a primary source.
- Secondly, as a pdf--as a pdf in which the text is recognized (and recognizable) by humans and machines it has a significant advantage over a jpg--not that I have anything against jpg's.
- I do not agree with you conclusion that this file is redundant nor would I characterize a jpg version of this file as superseding it. Having a jpg version of this file provides another version of this file to users--it certainly does not warrant the deletion of the original. @B dash:

This is labelled as "Own work" however I don't believe it is The description simply says "AMAZINH" which is obviously a typo for "Amazing", The meta data states it was "Created with Sketch." however that means nothing as unless you fiddle around inside the SVG file then that's always going to say "Created with Sketch.", - I vaguely remember this logo appearing on the EN article before it was replaced, Not sure if this meets TOO either, Also just to add this is being used on almost all Wikimedia projects so I'd rather not delete but at the same we can't host files that are COPYVIOS/Aren't the uploaders?, Thanks, –Davey2010Talk 18:07, 13 May 2018 (UTC)

- Not at all, Images should not be renominated time and time again, It was closed by one of the most experienced admins on this project and whilst admins do get things wrong interms of DRs that's very rare, A few people being unsure is not community consensus no where near it.
- The best solution is to go to Commons:Village pump/Copyright and seek clarification - As I said my opinion is that it's above the TOO threshold, So therefore we have 2 conflicting opinions on whether it fails TOO or not so for me the best solution like I say is to close as keep and go to Commons:Village pump/Copyright/ and If I'm wrong then any admin is more than welcome to delete the file and I will absolutely happily update this to reflect that, I don't speak for Commons only myself. –Davey2010Talk 20:54, 30 April 2020 (UTC)

I'm really hoping I'm wrong here and I would appreciate second opinions but there is a problem with the copyright status of this work. The flag is of a British Overseas Territory so would, probably, follow UK law. Assuming it does then it would matter what exactly the flag was copyrighted under. This news article from the Cayman News Service is what prompted this. There appears to be non-commercial restrictions on it as laid out by the Deputy Governor’s office. Whether or not this is just governmental copyfraud (happens all the time) or actually true is what prompted this.
Any thoughts on this matter would be appreciated. I actually hope I am wrong since this is used on so many articles and it would be a shame to have to remove it after so many years. But the official news article has sown significant doubt. Majora (talk) 22:17, 13 May 2018 (UTC)
- Just a couple of notes: The law in question can be downloaded as a PDF from here. It also appears at some point that the coat of arms on our copy was replaced with File:Coat of arms of the Cayman Islands.svg. The copyright status of that file is also a bit odd, and I can't really follow the various logs. If the restrictions Majora noted apply, then the CoA should be deleted as well. - If it is Crown Copyright, sure. That would only last 50 years. That was my original thought when I first looked at this but as I dug deeper I couldn't find any proof that that was actually true. And governments have the ability to recopyright material that has fallen out of copyright if they choose to do so (see en:URAA for an example of that). The issue is the news article. Which shows a pretty concrete example of a non-commercial restriction. Now this might just be governmental copyfraud, as I originally mentioned, but we don't have any proof of that either. I would hate to lose this image. It is used on so many articles but use and value cannot override the fact that we need to be sure here. - If it is Crown Copyright, sure. That would only last 50 years. That was my original thought when I first looked at this but as I dug deeper I couldn't find any proof that that was actually true. And governments have the ability to recopyright material that has fallen out of copyright if they choose to do so (see en:URAA for an example of that). The issue is the news article. Which shows a pretty concrete example of a non-commercial restriction. Now this might just be governmental copyfraud, as I originally mentioned, but we don't have any proof of that either. I would hate to lose this image. It is used on so many articles but use and value cannot override the fact that we need to be sure here. Without proof that it is under a free license, and with a news article stating the contrary, I really think our hands are tied. --Majora (talk) 00:01, 22 May 2018 (UTC)

- Comment: I asked about this at COM:VP/C#File:Sky-Logo2017.png so perhaps Alex Jazz saw that post. As I pointed out in my VP/C post, English Wikipedia is treating essrntially the same logo en:File:Sky plc logo.png as non-free content. The UK has a pretty low COM:TOO#United Kingdom and I'm not sure it can be clearly claimed that file would file below that; however, if the consensus is that it does and the file is kept, then it seems the the local Wikipedia file probably can be licensed the same way as well. The Commons file is being used across multiple Wikipedia's in various articles; some of these might allow COM:FAIR content to be uploaded locally, but they may place heavy restrictions on how the file can be used. - The question is whether displaying this photograph of a work of art infringes the copyright of the sculptor or the photographer. Ownership is not relevant. If you took the photograph then in uploading it you granted a suitable copyright license on the photo. Photographer is most likely the author of the mentioned book, Arthur Heinke. He was born in 1883 and died in 1959. Therefore licence PD-old is not correct, it is copyrighted until 2029.

- @ShakespeareFan00: Hello there. I am the original author for the insignia. It seems this is a duplication for my work (Link 1), however feel free to upload my works in Wikimedia Commons for other language's wikipedia usages.
Regarding about the issue you have mention, this insignia is drawn by me in .svg format based on two sources (Link 2 and Link 3).
The 'Link 2' is the tactical patch worn by the actual operators (bigger image) while the 'Link 3' is the actual insignia printed out at the official pamphlet during the launching ceremony of NSOF (Low Quality). Unfortunately, the actual physical patch worn by the operators contains errors at the motto as mentioned by former minister, Brig Gen Khairy Jamaluddin in his twitter (Link 4). I have found this image in a forum about Second World War. I wrote about Arthur Adam in Wikipedia and searched for a picture of him without copy rights. I found the file in the google search and was led to the site. In this forum there was an exchange of images of WWII. The person who shared the picture wrote: no Author found. This 1944 photo is claimed to be anoymous and therefore in the public domain in Germany. It's quite doubtful if the photo is actually "anonymous" in a legal sense in Germany, as we don't know when, how and where it was first published, if that publication was uncredited and if the photographer was not publicly known otherwise (as required by German law). All we have are two blog posts using this photo, none of them giving any contemporary sources of the photo, one of them claiming that the photographer is "unknown" without us being able to tell if that is actually true.
But even if the "anonymous" claim were true and the photo was published right away in 1944, it would still have been protected on the URAA date for Germany in 1996, and the US copyright (until the end of 2039) would have been restored. - That is not a "permission", but a source, a book by some dubious right-wing auction house (an auction catalog actually), published in 2012 apparently. That is probably where one of the blogs took the photograph from, but it's not a contemporary source and unlikely to be the first publication of this photograph. - Keep Reich period patents, copyrights and trademarks were confiscated in the USA during WWII by the Office of Alien Property Custodian. The URAA agreement did not restore Reich period copyrights in the USA. For instance all Bayer patents, copyrights and trademarks were purchased by Sterling Winthrop, and Bayer had to buy them back in 1994. - Per en:Wikipedia:Non-US copyrights#Wartime copyrights, “Any copyrights that were "ever owned or administered by the Alien Property Custodian" were not restored if the restored copyright would be held by "a government or an instrumentality thereof".” There is no indication that the copyright of this photograph was held by a government. And per en:Wikipedia:Non-US copyrights#Germany, “A number of German cases indicate that the copyright in images or graphic works remains with the author, even if the works were produced for official use. All of these German copyrights were extended in period to 70 years pma before the date of restoration, and so the US copyrights have been restored.
