N�vrh schvalovac�ho usnesen�.
Sen�t N�rodn�ho shrom�d�n� republiky �eskoslovensk� schvaluje dohodu k prozat�mn� obchodn� dohod� mezi republikou �eskoslovenskou a Spojen�mi st�ty americk�mi ze dne 29. ��jna 1923, sjednan� ve Washingtonu dne 29. b�ezna 1935 a uveden� v prozat�mn� platnost vl�dn� vyhl�kou ze dne 29. b�ezna 1935, �. 44 Sb. z. a n.
D�vodov� zpr�va.
Na po��tku leto�n�ho roku rozhodla se vl�da Spojen�ch st�t� americk�ch pod t�hou hospod��sk� krise podporovati snahy o uvoln�n� zahrani�n�ho obchodu, kter� je v Americe t�sn�n vysok�mi cly a v Evrop� mimo to r�zn�mi restriktivn�mi opat�en�mi (hlavn� povolovac�m a devisov�m ��zen�m) a zah�jila nap�ed se st�ty latinsk� Ameriky a pak i se st�ty evropsk�mi jedn�n� o obchodn� smlouvy na podklad� vz�jemn�ch konces� celn�-tarifn�ch. Spojen� st�ty americk� projevily p�i tom ochotu poskytovati v�hody z t�chto smluv tarifn�ch i ostatn�m st�t�m, se kter�mi maj� dosud obchodn� smlouvy na podklad� dolo�ky nejvy���ch v�hod, av�ak pouze, pokud nediskriminuj� ��dn�m zp�sobem jejich obchod. Pokud jde o �eskoslovensko, vyslovila vl�da Spojen�ch st�t� americk�ch p��n�, aby byla dopln�na dosavadn� prozat�mn� dohoda obchodn� ze dne 29. ��jna 1923, prodlou�en� dohodou z 5. prosince 1924 (Sb. z. a n. �. 313 z 31. prosince 1934), ustanoven�mi, kter� by brala n�le�it� z�etel na dne�n� omezen� obchodu a zabezpe�ovala slu�n� a spravedliv� zach�zen� se zbo��m druh�ho st�tu.
Aby mohlo �eskoslovensk� zbo�� po��vati celn�ch v�hod ji� z prv� tarifn� dohody sjednan� mezi Spojen�mi st�ty americk�mi a Belgi� dne 27. �nora t. r., kter� byla vyhl�ena 1. dubna t. r. a vstoupila v platnost dnem 1. kv�tna t. r., sjednala �eskoslovensk� vl�da s vl�dou Spojen�ch st�t� americk�ch skrze �eskoslovensk�ho vyslance ve Washington� p�edkl�danou dohodu s t�m, �e z�stane v platnosti a� do sjedn�n� obchodn� smlouvy tarifn�, kter�to jedn�n� m� b�ti zah�jeno je�t� v srpnu t. r. Je�to Spojen� st�ty americk� p�izn�vaj� v nov� dohod� s Belgi� celn� v�hody na �etn� druhy zbo��, kter� se do Spojen�ch st�t� americk�ch vyv�� ve velk�m rozsahu tak� z �eskoslovenska, znamen� tato dohoda zaji�t�n� na�eho v�vozu na americk�m trhu za v�hodn�j��ch celn�ch sazeb ne�li po��valo dosud.
Tato dohoda obsahuje v �l. 1. ustanoven� o nejvy���ch v�hod�ch, pokud jde o cla, vnit�n� d�vky a celn� formality. V �l. 2. se zabezpe�uje slu�n� a spravedliv� zach�zen� s p��slu�n�ky a zbo��m druh�ho st�tu, pokud jde o povolov�n� devis, v �l. 3. pak pokud jde o zbo�� podroben� povolovac�mu ��zen� nebo t. zv. celn�m kontigent�m. �l. 4. stanov�, �e se ustanoven� t�to dohody nevztahuj� na v�hody pohrani�n�ho styku nebo v�hody plynouc� z celn�
unie, ani na v�hody, kter� Spojen� st�ty americk� poskytuj� sv�m dr�av�m, Filipin�m, p�smu Panamsk�mu a republice Kub�nsk�. Stejn� Spojen� st�ty americk� nebudou se dom�hati zvl�tn�ch v�hod, kter� by byly poskytnuty �eskoslovenskem st�t�m Mal� dohody, Rakousku a Ma�arsku, ��m� uzn�vaj� zvl�tn� region�ln� obchodn�-politick� syst�m pro st�edn� Evropu. �l. 5. obsahuje obvykl� t. zv. klasick� v�jimky z voln�ho obchodu. V �l. 6. se stanov� doba trv�n� dohody, t. j. od 1. kv�tna a� do doby, kdy bude se 30denn� lh�tou vypov�d�na nebo nahrazena smlouvou definitivn�.
V�znam t�to dohody - krom� zm�n�n�ho z�sadn�ho uzn�n� st�edoevropsk�ho hospod��sk�ho syst�mu, - je patrn� z rozvoje a rozsahu na�eho vz�jemn�ho obchodu, kter� se jev� podle �eskoslovensk� statistiky zahrani�n�ho obchodu (dovoz podl� zem� v�roby):

Referring to recent conversations concerning the commercial relations between the Czechoslovak Republic and the United States of America I have the honour to confirm and make of record by this note my understanding that pending the conclusion of a definitive agreement governing the commercial relations between the Czechoslovak Republic and the United States of America, the commercial agreement of October 29th, 1923, as prolonged by the Agreement December 5th, 1924, shall be amended to read as follows:
1. With respect to custom duties or charges of any kind imposed on or in connection with importation or exportation, and with respect to the method of levying such duties or charges and with respect to all rules and formalities in connection with importation or exportation and with respect to all laws or regulations affecting the sale, taxation or use of imported goods within the country, any advantage, favour, privilege or immunity which has been or may hereafter be granted by the Czechoslovak Republic or the United States of America to any article originating in or destined for any third country shall be accorded immediately and unconditionally to the like article originating in or destined for the Czechoslovak Republic or the United States of America, respectively.
2. If the Czechoslovak Republic or the United States of America establish or maintain, directly or indirectly, any form of control of foreign exchange it shall administer such control so as to insure that the nationals and commerce of the other country will be granted a fair and equitable share in the allotment of exchange.
3. If the Czechoslovak Republic or the United States of America establish or maintain any form of quantitative restriction or control of the importation or sale of any article in which the other country has an interest, or impose a lower duty or charge on the importation or sale of specified quantity of any such article than the duty or charge imposed on importations in excess of such quantity, it shall accord fair and equitable treatment to the commerce of the other country in respecl of the allotment among exporting countries of the total quantity as originally established or as changed in any manner, of any such artic�e permitted to be imported or sold or permitted to be imported or sold at such lower duty or charge.
4. The advantages now accorded or which may hereafter be accorded by the Czechoslovak Republic or the United States of America to adjacent countries in order to facilitate frontier traffic and advantages resulting from a customs union to which either the Czechoslovak Republic or the United States of America may become a party shall be exempted from the operation of this agreement.The Czechoslovak Republic will not invoke the provisions of this agreement to obtain the advantages now accorded or which may be hereafter accorded by the United States of America, its territories and possessions, the Philippine Islands and the Panama Canal Zone to one another or to the Republic of Cuba. United States of America will not invoke the provisions of the present temporary agreement to obtain the advantages which have been or may be accorded by the Czechoslovak Republic to Austria or Hungary. United States of America will refrain from invoking the present temporary agreement to obtain advantages which the Czechoslovak Republic is at present according to the commerce of Yougoslavia and Rumania pending a satisfactory agreement with respect to this matter in connection with a comprehensive trade agreement between the two countries.
5. Nothing in this agreement shall be construed as a limitation of the right of either country to impose on such terms as it may see fit, prohibitions or restrictions
1.) relating to public security,
2.) imposed on moral or humanitarian grounds,
3) designed to protect human, animal or plant life,
4} relating to prison made goods,
5) relating to the enforcement of police or revenue laws or
6) relating to the control of the export or sale for export of arms, munitions or implements of war and in exceptional circumstances all other military supplies.
6. The present agreement shall become operative the First day of May 1935 and shall continue in force until superseded by a more comprehensive trade agreement or by a definitive treaty of commerce or navigation or, untiI denounced by either country by advance notice of not less than thirty days.

2. Jestli�e republika �eskoslovensk� nebo Spojen� st�ty americk� zavedou anebo maj�-li zavedenu p��mo nebo nep��mo jakoukoliv formu kontroly devis, budou ji prov�d�ti tak, aby zajistily p��slu�n�k�m a obchodu druh� zem� slu�n� a spravedliv� pod�l p�i p��d�lu devis.
3. Jestli�e republika �eskoslovensk� nebo Spojen� st�ty americk� zavedou anebo maj�-li zavedenu jakoukoliv formu kvantitativn�ho omezen� nebo kontroly dovozu anebo prodeje kter�hokoliv zbo��, na n�m� druh� zem� m� z�jem, anebo zavedou-li na dovoz nebo prodej ur�it�ho mno�stv� takov�ho zbo�� ni��� dovozn� clo nebo d�vku, ne� jest clo anebo d�vka na dovoz nad takov� mno�stv�, budou s obchodem druh� zem� slu�n� a spravedliv� zach�zeti, pokud jde o rozvr�en� mezi v�vozn� zem� p�vodn� stanoven�ho nebo jak�mkoli zp�sobem zm�n�n�ho celkov�ho mno�stv� takov�ho zbo��, p�ipu�t�n�ho k dovozu nebo k prodeji anebo p�ipu�t�n�ho k dovozu nebo k prodeji p�i takov�m ni���m cle anebo d�vce.
4. V�hody nyn� poskytovan� nebo kter� by mohly b�ti poskytnuty v budoucnosti republikou �eskoslovenskou nebo Spojen�mi st�ty americk�mi zem�m s nimi soused�c�m k usnadn�n� pohrani�n�ho styku a v�hody plynouc� z celn� unie, jej�mi� �leny by se mohly st�ti bu� republika �eskoslovensk� nebo Spojen� st�ty americk�, vyj�maj� se z t�to dohody. Republika �eskoslovensk� nebude se dovol�vati ustanoven� t�to dohody, aby dos�hla v�hod nyn� poskytovan�ch nebo kter� by mohly b�ti poskytnuty v budoucnosti Spojen�mi st�ty americk�mi, jejich �zem�mi a dr�avami, Filipinsk�mi ostrovy a zonou Panamsk�ho kan�lu sob� navz�jem anebo republice Kub�nsk�. Spojen� st�ty americk� nebudou se dovol�vati ustanoven� t�to prozat�mn� dohody, aby dos�hly v�hod, kter� byly nebo by mohly b�ti republikou �eskoslovenskou poskytnuty Rakousku nebo Ma�arsku. 5. Nic v t�to dohod� nem� b�ti vykl�d�no jako�to omezen� pr�va kter�koliv z obou zem� zav�sti vhodn� opat�en�, z�kazy nebo omezen�
1) t�kaj�c� se ve�ejn� bezpe�nosti,
2) z d�vod� mravnosti a lidskosti,
3) k ochran� �ivot� lidsk�ch, zv��ec�ch a rostlinn�ch,
4) t�kaj�c� se zbo�� vyroben�ho ve v�znic�ch,
5) t�kaj�c� se uplat�ov�n� z�kon� policejn�ch a d�chodov�ch anebo
6) vztahuj�c� se na kontrolu v�vozu anebo prodeje pro v�voz zbran�, st�eliva nebo v�le�n�ch pot�eb a v m�mo��dn�ch p��padech i v�ech dod�vek vojensk�ch.
6. Tato dohoda vstoup� v platnost dne 1. kv�tna 1935 a bude platiti do t� doby, dokud nebude nahrazena podrobn�j�� obchodn� dohodou nebo definitivn� obchodn� a plavebn� smlouvou nebo dokud nebude vypov�zena kteroukoliv z obou zem� ve lh�t� nejm�n� 30-denn�.

4) t�kaj�c� se zbo�� vyroben�ho ve v�znic�ch,
5) t�kaj�c� se uplat�ov�n� z�kon� policejn�ch a d�chodov�ch anebo
