in the
Workplace

Article X111, Sec. 3
It shall guarantee the rights
of all workers to self-organization
Article 111, Sec. 8
The right of the people, including those employed in the
public and private sectors, to form unions, associations, or
societies for purposes not contrary to law shall not be
abridged.
Article 3 of Labor Code

State shall assure the rights of workers


to self-organization, collective
bargaining, security of tenure, and just
and humane conditions of work.
A labor union
• is an organization of workers joined to protect
their common interests and improve their
working conditions.

• It serves as an intermediary between the


employer and the employees.
• The main purpose is to give
workers power to negotiate more
favorable working conditions
through collective bargaining.
(2) TYPES OR SECTORS OF
LABOR UNIONS IN THE PHILIPPINES (DOLE)
1. PUBLIC SECTOR UNION or PUBLIC EMPLOYEES ORGANIZATION

 refers to any organization, union, or association of employees in


agencies of the national government and their regional office,
attached agencies and their regional offices, state universities
and colleges, government-owned and controlled corporations
with original charters, and local government units, which exists
in whole or in part for collective negotiations or mutual aid,
interest, cooperation, and protection.
PRIVATE SECTOR UNION or
LABOR ORGANIZATION
 refers to any union or association of employees
in the private sector that exists in whole or in
part for collective bargaining, mutual aid,
interest, cooperation, protection, or other
lawful purposes.
7 Types of Union
1. CRAFT UNION – labor union of people of the same skilled craft.
2. INDUSTRIAL UNION - in which all workers in the same industry are
organized into the same union, regardless of differences in skill.
- all workers in a given industry are eligible for membership.
3. PUBLIC SERVICE UNION- in the same or similar job type within a specific
public service industry.
- Membership in these groups is often voluntary but highly encouraged.
- They often represent public service jobs within small sectors, regions, or
institution
- the collective bargaining agreements made do not alter conditions in an entire
industry.
4. FEDERATIONS /NATIONAL UNIONS
- an organized group of one or more unions.
- a group of legitimate labor unions in a private
establishment organized for collective bargaining
- Registered with the Bureau of Labor Relations (BLR) in
accordance with Rule III, Section 2-B of Department Order No.
40-03, as amended.

5. UPLIFT UNION - also known as friendly union organizations that


use collective bargaining to serve the social and emotional well-being of
their members.

life, intellectualism, and morality.
6. IDENTITY-EXCLUSIVE UNION – is an organized group of
unions can benefit
people who share a common social, cultural, or
religious identity.

provide fair wages, compensation, and protections for their
members
and employers.
7. ENTERPRISE UNION - focus on providing employees with job
stability, employment contracts - “lifetime
employment” and improvements in employer
relationships.

ADVANTAGES TO
EMPLOYEES
Collective Bargaining

• It is a process where the parties agree to fix and


administer terms and conditions of employment
which must not be below the minimum standards
fixed by law, and set a mechanism for resolving
their grievances.
• The heart and soul of labor unions,
collective bargaining increases a group’s
negotiation powers.
Collective Bargaining
Agreement
• it is a contract executed upon
request of either the employer
or the exclusive bargaining
representative of the employees.
Negotiations concerning:
- wages, better health care, pension, retirement funds
- hours of work (OT pay)
- safer working conditions
-legal protection from wrongful termination
-Legal protection when the company violates labor laws
- other terms and conditions of employment
Representation
• It offers more strength because workers come together
as a group instead of as individuals.

• Tend to have more power within their workplace


because they are acting as a cohesive group instead of
as a series of individuals.
Strengthen democracy
• During policy debates, unions are included as a
means for management to be more responsive to
worker needs.

• Laws, standards, and norms are remodeled to


match the concerns of union members.
• Unions provide intervention during employee-
related matters as well as improve job security
and predictability as benefits, wage increases
and better working conditions are pushed
forward.
ADVANTAGES TO
EMPLOYERS
Consistency

• Standardized salaries and other work benefits can


save a company an enormous amount of time.
Negotiating with individual employees requires a
great deal of effort from the human resources
department.
• it simplifies compensation and budgeting
procedures as employers know what costs
they will expect in the coming years.

• Unions also provide ease in discipline (as


stated in contracts) and fairness across all
workers.
Reduced turnover
• The greater the seniority of a union member, the higher
the wages and the better the benefits—which means
employees are more likely to stay in a company.

• Most employees also pride themselves on working for


an employer for a long time as this reflects on their
commitment and longevity.
Employee satisfaction and well-being

• Workers who feel valued and trusted, increases


quality of performance.

• Under fairer, better, and more amenable working


conditions, their motivation and satisfaction
increases, which results in better work.
DISADVANTAGES
OF UNIONS
• Union fees
• Union negotiations may not reflect your
opinion
• Increased competition for jobs
• No individual negotiations
• Promotions are sometimes based on seniority
