THE CARTOGENA PROTOCAL
 The Cartagena Protocol is a protocol of the Convention on Biological Diversity (CBD).

 The Parties shall consider the need for and modalities of a protocol setting out appropriate

procedures, including, in particular, advance informed agreement, in the field of the safe transfer,

handling and use of any living modified organisms (LMOS) resulting from biotechnology that

may have adverse effect on the conservation and sustainable use of biological diversity.
 The Protocol was adopted on 29th January 2000.130 Parties signed the protocol. Currently 119
countries have ratified
 India ratified the protocol on 17th January,2003.The Protocol came into force on 11th
September 2003.
OBJECTIVES
 The objective of the protocol is to contribute for safe transfer, handling and use of
living modified organisms(LMOS) resulting from modern biotechnology that
may have adverse effects on the conservation and sustainable use of biological
diversity.
 The Protocol also takes into account risks to human health.
 The Protocol specifically focuses on transboundary movement of LMOs.

Success of the Cartagena protocol
 The cartagena Biosafety Protocol has been hailed as a significant step forward in that it provides an international
regulatory framework to reconcile the respective needs of trade and environmental protection with respect to a
rapidly growing global industry, the biotechnology industry. The Protocol thus creates an enabling environment
for the environmentally sound application of biotechnology, making it possible to derive maximum benefit from
the potential that biotechnology has to offer, while minimizing the possible risks to the environment and to human
health.
LIMITATIONS OF THE PROTOCAL
 Failing to launch a new round of trade negotiations in Seattle.
 The denial of fast-track negotiating authority in the U.S.
 the death of the OECD efforts to conclude an investment agreement.

COMCLUSION

The Cartagena Protocol overall is a mixed package. Some of the tougher issues have been postponed until a later
date, and others remain unsettled through ambiguity. But the progressive elements of this agreement—the strong
elaboration of the precautionary principle prime among them—make it a strong addition to the body of international
environmental law. It is also welcome as a signpost on the road to more enlightened trade policy-making.
