Scheduled and Tribe Areas

Scheduled areas in India are governed under the Fifth and Sixth Schedules of the Constitution to safeguard tribal populations. Scheduled Areas
■ Scheduled Areas are areas in India with a preponderance of tribal
population subject to a special governance mechanism wherein the central
government  plays a direct role in safeguarding cultural and economic
interests of scheduled tribe in the area.The authority to create and administer
Scheduled Areas stems from the Fifth and Sixth Schedules of the
Constitution of India .
■ In Scheduled Areas declared so under the Fifth Schedule, the governor of
the state has special responsibilities with respect to tribal populations in the
area including issuing directives to the state government and limiting the
effect of acts of the central or state legislature on the Schedule Area.
■ On the other hand, in Scheduled Areas declared so under the Sixth
Schedule, the emphasis is on self-rule; tribal communities are granted
considerable autonomy, including powers to tribal communities to make
laws and receive central government  funds for social and infrastructure
development.
Criteria For Scheduled Areas
 The presence of a large tribal population.
 The area's compactness and suitable size.
 A functional administrative unit, such as a district, block,
or taluk.
 Economic backwardness of the area as compared to the
neighbouring areas.
Sixth Schedule
■ Between September 5-7, 1949, the Constituent Assembly
discussed and passed the Fifth and Sixth Schedules.
■ Northeast India, home to numerous diverse ethnic
groups and located strategically with borders with Bhutan,
China, Myanmar and Bangladesh.
■ Sixth schedule gives tribal people freedom to exercise
legislative and executive powers through an Autonomous
District Council and an Autonomous Regional Council.
In India, there are 4 states
having tribal area’s namely:

■ Assam: North Cachar Hills District;


Karbi Anglong District; Bodoland
Territorial Areas District.
■ Meghalaya: Khasi Hills District,
Jaintia Hills District & Garo Hills
District.
■ Tripura: Tripura Tribal Areas District.
■ Mizoram: Chakma District, Mara
District & Lai District
Constitutional Provision Of Sixth Schedule

 Article 244(2) provides that the provisions of the


sixth schedule shall apply to the administration of the
tribal areas in the state of Assam, Meghalaya,
Tripura and Mizoram.
 This special provision is provided under Article
244(2) and Article 275(1) of the Constitution.
Administration Of Tribal Areas
■ The various provisions of administration of Tribal Areas contained in the
sixth Scheduled are:
■ The tribal areas in the states of Assam, Meghalaya, Tripura and Mizoram
have been constituted as Autonomous District. But they do not fall outside
the executive authority of the State concerned.
■ If there are different tribes in an Autonomous District the Governor can
divide the District into several Autonomous region.
■ Each Autonomous District has a District Council consisting of 30
members.
■ Four are nominated by the governor and they perform their duties during the
pleasure of the governor.26 are electedusing the adult franchise and
their term of office is five years.

■ Powers of Autonomous District/Regional Councils:
The District and Regional Council are empowered to assess and collect land
revenue and to impose certain specified taxes.
■ When both parties are Scheduled Tribe members and the maximum
sentence is less than 5 years in prison, autonomous district councils have
the authority to convene courts.
Conclusion
■ Although special constitutional protections for
marginalized groups are necessary to ensure
historical injustices against them.
■ To deal with this sensitive subject, the government
and other agencies must gain the trust of tribals
and non-tribals in the region and in-still a sense of
security and belonging among them.
