3. The PNP under the law is the primary Law Enforcement Agency
of the government tasked to enforce the laws of this country. As
such the PNP shall enforce the law, prevent and control crimes,
maintain peace and order, and ensure public safety and internal
security with the active support of the community.
II. The role of the PNP in Anti-Insurgency operation pursuant
to RA 6975

Section 2. Declaration of Policy. – It is hereby declared to be the


policy of the State to promote peace and order, ensure public
safety and further strengthen local government capability aimed
towards the effective delivery of the basic services to the citizenry
through the establishment of a highly efficient and competent
police force that is national in scope and civilian in character. The
State shall bolster a system of coordination and cooperation
among the citizenry, local executives and the integrated law
enforcement and public safety agencies created under this Act.
The police force shall be organized, trained and equipped primarily
for the performance of police functions. Its national scope and
civilian character shall be paramount. No element of the police
force shall be military nor shall any position thereof be occupied by
active members of the Armed Forces of the Philippines.
Section 12. Relationship of the Department with the
Department of National Defense. – During a period of
twenty-four (24) months from the effectively of this Act, the
Armed Forces of the Philippines (AFP) shall continue its
present role of preserving the internal and external security
of the State: Provided, That said period may be extended by
the President, if he finds it justifiable, for another period not
exceeding twenty-four (24) months, after which,

“The Department (DILG/PNP) shall automatically take over


from the AFP the primary role of preserving internal security,
leaving to the AFP its primary role of preserving external
security. Internal Security means addressing the problem on
insurgency. The Anti criminality and maintaining internal
security are the two major roles of the PNP.
III. The role of the PNP in Anti-Insurgency
Operation pursuant to RA 8551

February 17, 1998 - Republic Act 8551 or the PNP


Reform and Reorganization Act of 1998 was
enacted. It amended certain provisions of
Republic Act No. 6975.
IV. The role of the PNP in Anti-Insurgency operation
pursuant to executive order number 110

EXECUTIVE ORDER NO. 110 - DIRECTING THE PHILIPPINE


NATIONAL POLICE TO SUPPORT THE ARMED FORCES OF
THE PHILIPPINES IN INTERNAL SECURITY OPERATIONS
FOR THE SUPPRESSION OF INSURGENCY AND OTHER
SERIOUS THREATS TO NATIONAL SECURITY.

WHEREAS, Republic Act No. 8551, particularly Section 3


thereof, amending Section 12 of Republic Act No. 6975, has
relieved the Department of the Interior and Local Government
(DILG) of the primary responsibility on matters involving the
suppression of insurgency and other serious threats to national
security;
WHEREAS, Section 3 of Republic Act No. 8551 further
provides that the Philippine National Police (PNP) “shall,
through information gathering and performance of its
ordinary police functions, support the Armed Forces of
the Philippines (AFP) on matters involving suppression of
insurgency, except in cases where the President shall call
on the PNP to support the AFP in combat operations”;

WHEREAS, the National Democratic Front (NDF) has


manifested its intention to resume armed struggle against
the government and the Filipino people and the NDF
negotiating panel has decided not to engage in further
peace negotiations with the government;
  
WHEREAS, as a result of the NDF termination of talks,
the Central Committee of the Communist Party of the
Philippines (CPP) has directed the New People’s Army
(NPA) to launch tactical offensives from its “guerilla
fronts” in order to “capture weapons and deal blows
against the Government”;

WHEREAS, the NPA has started to undertake terroristic


activities in several parts of the country; WHEREAS,
while the AFP elements have been deployed to contain
the insurgency problem throughout the country, there is
need to continue mobilizing government resources to
protect our people from the terroristic activities of the
NPA and to preserve public order and safety;
WHEREAS, the PNP is organized in the nature of a territorial
force and, as such, has the presence of personnel in all the
provinces, cities and municipalities of the Country;

WHEREAS, the National Peace and Order Council, in


consultation with the Chairman of the Regional Peace and
Order Councils, has recommended the utilization of the PNP
in internal security operations against insurgency.
NOW, THEREFORE, I, JOSEPH EJERCITO ESTRADA,
President of the Republic of the Philippines, by virtue of the
powers vested in me by law, do hereby order the following:
 
The PNP is hereby directed to support the AFP in internal
security operations (ISO) for the suppression of
insurgency and other serious threats to national security.
V. The Role of the PNP in anti-insurgency operation pursuant to
Executive Order Number 546
 
Executive Order No. 546- AMENDED CERTAIN PROVISIONS OF EO
NO.110

WHEREAS, Section 12 of Republic Act No. 6975, as amended by Republic


Act No. 8551, provides that the primary responsibility involving the
suppression of insurgency and other serious threats to national security
rests with the Armed Forces of the Philippines (AFP) and that the Philippine
National Police (PNP) shall, through information gathering and performance
of its ordinary police functions, support the AFP on matters involving the
suppression of insurgency, except in cases where the President shall call on
the PNP to support the AFP in combat operations;

WHEREAS, the National Democratic Front, the Communist Party of the


Philippines and its military arm, the New People’s Army, have been waging
an armed struggle against the Government and the Filipino people for more
than thirty years;
WHEREAS, the ongoing insurgency has a negative impact on the
economy and resolving the insurgency will foster a climate conducive to
economic growth and national development;

WHEREAS, to effectively address this threat, there is a need for a


“whole of government approach” to ensure sustained, consistent,
integrated and coordinated international security measures against the
Communist Terrorist Movement and other organized elements/groups
engaged in armed offensives against the Government;

NOW, THEREFORE, GLORIA M. ARROYO, President of the Republic


of the Philippines, by virtue of the powers vested in me by law, do
hereby order the following:
 
SECTION 1. The PNP shall support the AFP in combat operations
involving the suppression of insurgency and other serious threats to
national security.
SECTION 2. In the exercise of its responsibility, subject to the concurrence of the
appropriate Local Chief Executive through the Local Peace and Order Council, the
PNP is hereby authorized to deputize the barangay tanods as force multipliers in the
implementation of the peace and order plan in the area.

SECTION 4. The Local Chief Executives, in coordination with the Local Peace and
Order Councils, shall include in the integrated area/Community Public Safety Plan of
their respective city/municipality, the priority program of action/thrust in resolving the
insurgency and other serious threats to national security and ensure appropriation
thereof for effective implementation of this Executive Order.

SECTION 5. All executive issuances, rules and regulations or parts thereof which are
inconsistent with this Executive Order are hereby revoked, amended, or modified
accordingly. (Sgd.) GLORIA MACAPAGAL-ARROYO

SUPPRESSION OF INSURGENCY AND OTHER SERIOUS THREATS TO
NATIONAL SECURITY,”
VI. The role of the PNP under the PNP/AFP Joint Letter Directives

In the conduct of joint operations involving suppression of insurgency


and other threats to national security, the AFP shall be responsible to
take the lead role with the PNP in the support role. On the other
hand, the PNP shall be responsible to take the lead role in law
enforcement operations, including investigation and prosecution of
cases.
 
VII. The Criminals acts committed by the insurgents

The repeal of RA 1700 (anti-subversion law) having been de


criminalized does not make the members of the CPP/NPA criminals for
being members of the communist party of the Philippines. HOWEVER,
the members of this organization can be held liable for acts they
commit in violation of the REVISED PENAL LAW AND OTHER.
PERTINENT LAWS either in their individual capacity or in conspiracy. The
following are the common crimes that can be attributed to the group;
 
• Murder
• Homicide
• Illegal possession of firearms and explosives
• Arson
• Robbery
• Theft
• Extortion
• Coercion
• Threats
• Physical Injuries
• Illegal Detention
• Concealing true name
• Conspiracy to commit crime
• Tax evasion
• Theft of minerals
• Kidnapping
 
VIII. Summary
 
Since it is very apparent that the members of the CPP/NPA
are engaged in criminal activities and some of them have
standing warrants. It is just appropriate that the PNP, as the
primary Law Enforcement agency of the Government, take
the lead role in the legal offensive against these criminals
hiding under the cloak of subversion. The Police has the
inherent role and responsibility of maintaining internal peace
and security through the enforcement of the rule of law,
investigating and arresting criminal offenders. It should be
noted that the NPAs have already accumulated a long track
record of criminal acts and they need to answer to the Law.
Insurgents are arrested not for subversion but for their
criminal offenses to include extortion, murder, kidnapping and
other forms of violation of the law and human rights.
