Introduction:
The National Telecommunications
Commission (NTC) is the government agency
created under Executive Order No. 546
promulgated on July 23, 1979, and conferred
with regulatory and quasi-judicial functions
taken over from the Board of
Communications and the
Telecommunications Control Bureau which
were abolished in the same Order.
Primarily, the NTC is the sole body that
exercises jurisdiction over the supervision,
adjudication and control over all
telecommunications services throughout the
country. For the effective enforcement of this
responsibility, it adopts and promulgates such
guidelines, rules, and regulations relative to
the establishment operation and maintenance
of various telecommunications facilities and
services nationwide.
Although independent, in so far as its
regulatory and quasi-judicial functions are
concerned, the NTC remains under the
administrative supervision of the
Department of Transportation and
Communication as an attached agency.
However, with respect to its quasi-judicial
functions, NTC's decisions are appealable
only and directly to the Supreme Court.
Historical Background
December 5, 1927
Act No. 3396 known as the Ship Radio Station
Law was enacted. The Radio Construction and
Maintenance Section, the first radio regulatory
office was charged to enforce the said law.

November 11, 1931


Act No. 3846 known as the Radio Control
Law was enacted. The Radio Control
Division in the Bureau of Post was created
under the jurisdiction of the then Secretary of
Commerce and Communications.
1939
The Radio Control Division was transferred
to the Department of National Defense which
was organized pursuant to Executive Order
No. 230.

1947
The Radio Control Division was again
transferred to the Department of Commerce
and Industry which was created pursuant to
Executive Order No. 94.
January 01, 1951
By virtue of the provisions of E.O. No. 392, the
Radio Control Division and the Radio Control
Board were transferred to the Department of
Public Works and Communications. Radio
Control Board was charged to implement the
provisions of the Radio Broadcasting Law, Act
No. 3997.
1956
Republic Act No. 1476 was enacted,
abolishing the Radio Control Board.
August 23,1962
Department Order No. 51 was issued
changing the name of the Radio Control
Division to Radio Control Office.
1972
The Board of Communications (BOC) was
created under the Integrated Reorganization
Law of 1972. It was the first quasi-judicial
body with the adjudicatory powers on matters
involving telecommunications services.
July 1, 1974
The Radio Control Office was renamed as
Telecommunications Control Bureau (TCB).
July 23, 1979
By virtue of Executive Order No. 546,
the TCB and the BOC were integrated into a
single entity now known as the National
Telecommunications Commission (NTC).
The Ministry of Transportation and
Communications, which was created under the
same Order has administrative jurisdiction
over the NTC.
April 13, 1987
President Corazon C. Aquino issued
Executive Order No. 125-A making the NTC
an attached agency of the Department of
Transportation and Communications (DOTC).
2004
By virtue of Executive Order No. 269, created the
CICT, then NTC was transferred to CICT from
DOTC but subsequently transferred back to
DOTC in 2005 by EO 454.
August 06, 2007
President Gloria Macapagal-Arroyo issued
Executive Order No. 648 effectively
transferring the NTC from DOTC to the CICT.
While the DICT Bill is still pending in the
Senate, the NTC will remain independent with
regard to its regulatory and quasi-judicial
functions
2011
By virtue of Executive Order No. 47 dated 23rd
June 2011, reorganizing, renaming and
transfering the CICT and its attached agencies
to the DOST; NTC shall continue to be under
the Office of the President.

Vision :

By 2015, the National

• 1. Authorize, supervise, regulate and

4. Conduct registration and licensing of
radio Stations/ system/network. Also
conduct examinations and
licensing of radio operators.

Act No. 3846, as amended an act
Providing for the Regulations of
Public and Radio Communications
in the Philippines and for other
purposes ( 11 November 1931 )
ACT 3846 – RADIO CONTROL LAW

Section 1 No person, firm, company,


association, or corporation shall construct,
install, establish, or operate a radio
transmitting station, or a radio receiving
station used for commercial purposes, or a
radio broadcasting station, without having
first obtained a franchise therefore form the
Congress of the Philippines.
ACT 3846 – RADIO CONTROL LAW

Section 1 a No person, firm, company, association or


corporation shall posses or own transmitters or
transceivers without registering the same with the
National Telecommunications Commission, nor sell
or transfer the same to another without his approval,
and no person, firm, company association or
corporation shall construct or manufacture, or
purchase radio transmitters or transceivers without a
permit issued by the National Telecommunications
Commission.

Section 2 The construction or installation of


any station shall not be begun unless a
permit therefore has been granted by the
National Telecommunications Commission.
No station shall be operated except and
under in accordance with the provisions of a
license therefore by the National
Telecommunications Commission.

Section 7 A person to whom or through whom a


message has been submitted for transmission shall
not willfully publish or divulge the contents,
substance, purport effect, or meaning thereof to
any unauthorized person.

provisions of this Act, or any provisions of
the International Radio Regulations, shall be
punished by a fine of not more than two
thousand pesos or by imprisonment of not
more than two years, for each and every

Section 13 Any firm, company, or association


failing or refusing to observe or violating any
provision of this Act, or any provision of the
Regulations prescribed by the National

Section 16 Posting of licenses


Management of radio station should see to it
that station and operator licenses are
conspicuously posted in the premises. The
station license shall be posted in the
transmitting station and the operator licenses
should be posted in the place where the
operators render service. In the case of the
land mobile stations, the operator shall carry
the licensed or a certified true copy thereof in
his person at all times while on duty.

Guidelines and Procedure for issuance
of Restricted Radiotelephone
Operator’s Certificate for Land
Mobile Stations (RLM), Without
Examination
REQUEST FOR SEMINAR

The following shall be submitted to NTC:

A] A written request for the RLM seminar indicating the


tentative date and venue

B] Construction Permit or Radio station license or any


authorization from NTC indicating the assigned
frequency for use in the land mobile service.

C] List of individual qualified applicant for the seminar


who are certified to be regular employee or members of
the agency, company or organization.
Qualifications of Applicant
A] He must be citizen of the Philippines.
B] He must be good moral character.
C] He must be at least 18 years of age.
D] He must be able to transmit and receive
radiotelephone messages at least in Pilipino or English
E] He must be connected or employed in a firm,
company or organization which is authorized to operate
radio stations in the land mobile service.
F] He must have completed a course on rules,
regulations and land mobile radio operating
procedures conducted by NTC.
Scope of Authority
A] He is authorized to adjust the external controls of
the transceiver such as “ON & OFF, squelch and
volume controls and channel selector.

B] He shall operate in accordance with the


conditions as stipulated in the radio station license.

C] He must follow the instruction given by the base


operator for proper handling of radio interference
and NTC rules and regulations.

three (3) months from date taken;

handwritten)

1. Application for RLM Radio’s Certificate:

than three (3) months from date taken;
3. Submit original copy of RLM Certificate;
4. Application must be filed 30 days before its expiration
date. An imposition of 50% surcharge to late filing
from 1 day but not more than 6 months and 100%
surcharge for filing more than 6 months or for every
year thereafter.

Identification of Stations (CALL SIGN) A station call
sign must be transmitted at least once before and
after each transmission (as provided in section 26 of
D.O. No. 11 every station should be properly
identified by call sign assigned to it.

Interference To minimize interference,
radiotelephone operators are advised not to begin
transmission until after listening long enough to
determine that the frequency channel desired is not
busy.

Don’t interfere an on going communication. Intentional
jamming is prohibited by law.

Make sure the message reached the party concern
Advise when leaving your radio
Terminate call positively and courteously
Take advantage of height for better reception / transmission
