Rules regarding leave:
– •Applicability:
– The provisions contained in these rules shall apply to all employees of National
– Institute of technology.
– •Right to leave:
I. Leave cannot b claimed as a matter of right and the leave sanctioning authority may refuse and revoke
any kind of leave.
II. Leave sanctioning authority can not alter the kind of leave due and applied for.
III. Leave will not be granted to staff under suspension.
Kinds of leave:
– 1.casual leave:
– Casual leave is not earned by duty.A staff on CL is not treated as absent from duty.CL
cannot b claimed as of right and is subject to a maximum of 8 days in a calendar year..
In addition each employee will also be allowed to avail himself/herself of any two
holidays from the list of restricted holidays declared by the government.
– 2.Earned leave:
– The EL is admissible to a member of the staff shall be 30 days in a calendar year.15 days
of EL is credited in advance on the first January and first July every year.The maximum
amount of the earned leave that can granted to a member of staff at a time shall be 180
days.
– 3.Special leave:
– Special leave may b granted when a staff member wishes to attend
conferences/seminars/symposia/ practical training or out of country up to 15 days in a
calendar year.
– 4.vacation:
– Teachers including librarians and physical directors can avail 60 days vacation in an
academic year partly in winter and partly in summer period or entire 60 days in summer
period.other employees are not eligible for vacation.
– 5.Half pay leave:
– The half pay leave is admissible to a member of staff in respect of each completed year of
service shall be 20 days.service includes period of duty and leave including extraordinary
leave with or without medical certificate,but does not include periods of suspension
treated as dies non,overstayl of leave/joining time unless otherwise regularized.
– 6.Commuted leave:
– Commuted leave not exceeding half the amount of half pay leave due can not be taken on
medical certificate.
– 7.leave not due:
– Leave not due may be granted only on medical grounds to a permanent staff with no HPL
at his/her credit.
– 8•Extra-ordinary leave:
– EOL should always be without leave salary and may be granted when other no kind of leave
is addmisible,or when other leave being addmisible ,the staff concerned has specifically
applied in writing for the grant of EOL.
– 9•Maternity leave:
– Maternity leave may b granted to a female staff with less than two surviving children for a
period of up to 135 days from the date of its commencement.Maternity leave may also be
granted on full pay in case of miscarriage including Abortion.It shall not be debited to the
leave account.
– 10•Adoption leave:
– A female member of the service on her adoption of a child may b granted leave of the kind
due and addmisible (including commuted leave without production of medical certificate
for a period not exceeding 60 days and leave-not-due)puto one year by following some
conditions.
– 11•paternity Leave:
– Male staff with less than two children may be granted 15 days paternity leave during the
confinement of his wife for child birth.
Rules Regarding Appointment:
a. Ad hoc appointments ,,means temporary Appointment of a duly qualified person made otherwise
than in accordance with prescribed method of recruitment ,pending the recruitment in accordance
with such method.
b. Appointing Authority,in relation to a post means the person authorized under regulation 3 to make
Appointment to that post.
c. Appointing Authority:The authorities competent to make Appointment to various posts specified in
the Appendix shall be as follow:
Method of Appointment:

– A: By initial recruitment in accordance with the provisions contained in the Appendix and
every vacant post of any pay scale which falls under direct recruitment quota shall be
advertised through press and selection will be based on merit given due weightage to the
educational qualifications ,experience,aptitude and permanencyof tenure.
– B: By promotion or transfer.
– Appointment by transfer shall be made from amongst person holding appointment on
regular basis in the same pay scale ,in which to be post filled and exists.
– A person appointing against a post by promotion and transfer shall retain his/her lien
during the period of probation in the post vacated by him/her.
Explanation:

– If a junior employee in a lower pay scale is promoted to higher pay scale


temporarily,even though continuing later permanently in higher pay scale,it
shall not adversely affect the interest of his seniors in the fixation of his
seniority in the higher pay scale.

– If he promoted to higher pay scale by superseding a senior employee and


subsequently that employee is also promoted to the same pay scale,the
employee first promoted shall rank senior to the employee promoted
subsequently……
Rules for pay and Allowance

– • Teacher salary payment is calculated on a monthly basis ,beginning from the


date on which teacher actually reports for duty and ending on the date on which
teacher actually leaves their positions ,shall be paid monthly .
– If a person has not worked for a full month the amount of the salary payments
referred to preceding paragraph is calculated based on the number of days they
worked.
– The salary grades assigned to teachers at elementary school ,junior high
schools,senior secondary schools will be based on their education,experience and
seniority.
– The salary grades assigned to teachers at a junior college, tertiary college and
university will be based on their professional rank , education,experience and
seniority.
– A lecturer or assistant professor who has a doctorate may however,be assigned
a starting salary grade of 330 salary points .
– The seniority at elementary or secondary school teacher accumulated when
they worked as a regular substitute teacher will be advanced one level for each
instance of their substitute teaching periods of three months or more
amounting to a cumulative total of one full year.
– The salary grade of a teacher who has graduated from a junior college ,tertiary
college and university or holds an equivalent formal academic credential who
obtains a master’s degree will be advanced three grades;the salary grade of
teacher who directly proceeds to undertake advanced study and obtains a
doctorate will be advanced five grades.
– The salary grade of a teacher holding a master degree who obtains a doctorate
will be advanced two grades.
– Promotion of salary grade of any public secondary school teacher will be
carried out in accordance with the Regulations governing Teacher performance
evaluation at the public senior secondary school level and below.
Allowances:

– Allowances refers to the additional pay given as well as the basic salary because of the
type and nature of duties associated with the particular teaching positions and it’s
locations.
– Allowances are categorized into three types:
– 1•occupational Allowances:Allowances offered to those serving concurrently in
supervisory positions,serving as counselors or responsible for special education.
– 2•Academic research Allowances:Allowances offered to those who engaged in
pedagogical research or academic research.
– 3•Regional Allowances:Allowances offered to those serving in remote or special
districts.
– First type will be formulated by Ministry of education based on the level of
school ,the organizational level,and the level of accupational duties and
submitted to the executive yuan for retification.
– Second type the condition under which acedemic research allowances of the
preceding paragraph are paid ,and the amount of the paid will be separately
formulated by Ministry of education and submitted to the executive yuan for
retification.
– Third type the conditions under which regional allowances are paid to public
school teachers and amount to be paid will be separately formulated by the
executive yuan with reference of the place of service and relating factors
including geographical environment ,transportation conditions ,the associated
degree of difficulty and economic conditions.
Terms of reference of various personnel in school:

– Membership:
– The governing body shall be consist of:
– •Two parent governers
– •one LA governor
– •one staff governor
– •one head teacher
– •Eight co-opted governors
– The total number of governor is 13.The term of office of all categories of governors is 4
year.
Quorum:
– The quorum for a meeting of the governing body and any vote on any matter at
such a meeting ,is one half of the membership of the governing body.
– The membership of the governing body does not include vacant positions on
the governing body.
– Every question to be decided at a meeting of the governing body is to be
determined by a majority of votes of the governors present and voting on the
questions.
Meetings:
– The governing body must hold at least three meetings in every school year.otjer
delegated committees will also hold at least one meeting per term.
– Advice given by the governors at this school is incidental to their professional
expertise and is not being given in their professional capacity.
– Terms:
– Conducting the school with a view to promoting high standards of educational
achievements.
– Ensuring that the school operates within statutory safeguarding regulations.
– Approving appropriate targets for pupil achievements.
– Monitoring the school development plan.Monitoring and Approving the school’s
budget.
– Monitoring the curriculum to ensure it is balanced and broadly based,and in
particular that the international primary curriculum is taught and receiving
curriculum assessment and examination results.
– Responsibility for Appointment of the head and assistant head teachers and
regulating staff conduct and discipline.
– Drawing up an action plan after a statutory inspection in co-operation with the
LA.
Terms of reference in various
personnel of colleges and university
– For CPD program:
– The learning innovation division conducts various training programs for faculty
across the country with the aim to provide the necessary skills for faculty
members/teachers to participate positively in academic function of university.The
training programs are to keep teachers abreast of new concepts and content
incorporated into curricula and mode of delivery,advanced skills.
– The learning innovation division schedules educational activities for each quarter
of a year.institutions and departments that wants to conduct a course must submit
a written request approved by Hels’competent authority along with the detail
proposal to the learning innovation division at least a month ni advance.
Requirements of the CPD:

– Duration of one CPD will be five working days.


– A batch of 25_30 participants will be arranged for one training.The participants
will be taken from the same university and sorrounding university and affiliated
colleges.
– The participants will be from faculty cadre of Hels’.
– The course will be learner oriented activity based rather than theoretical.
– Local transport facility,if required,for the resource person and the HEC
representatives will be provided by the university.
– Resource person can be selected from any public and private sector university
and expense of the participants of the course taken from private sector
universities will be cover by their university.

– Nobody is allowed to change in documents sent by HEC,only HEC is reserves the


rights to amends documents.HEC May take serious action in case of non-
compliance.
Code of Ethics in higher education:

– Preamble:
– Higher education and research are in a constant state of change,societal demands
and expectations of what knowledge should deliver are multiple and
expanding.research in higher education institutions is continuously pushing back
the frontiers of discovery. In many nations the growth in the number of higher
education institutions is unmatched in history.
– The legitimacy,credibility ,support and autonomy of higher education institutions
rest on their qualities of activities and services relating to teaching and
learning,research and outreach as well as the integrity and transparency of their
procedures.
– All institutional code of ethics in higher education should be elaborated
following a transparent and inclusive process of consultations of the diverse
group that make up the academy community-faculty member,students ,staff
and governing bodies/leadership –respecting the rights and responsibilities of
each.
– Furthermore specific focus should be given to:
a) Promoting academic integrity.
b) Development of educational programs to uphold ethical values.
c) Upholding equity,justice equal opportunity,fairness,and non-discrimination.
– Obligation of accountability and transparency in all operations.
– Pursuit of individual and /or institutional reputations and publicity.
– Avoidance all abuse of power.
– Promoting critical analysis,freedom of speech and reasoned debate.
– Encouraging social responsibility at the institutional and individual level.
– Exercising vigilance with regard to applications and receipt of external funds.
– Fair management of intellectual property.
– Promoting solidarity ,respect of diversity and equitable international partnerships and
collaboration.
