Age
What does Privacy mean?
• Privacy is the right to be let alone, or freedom from
interference or intrusion by people, organizations or the
government.
• Right of privacy can be defined as the right of a person
to enjoy his own presence by himself and decide his
boundaries.
 With the development in technology, data privacy
is becoming more important as more data is being
collected by the companies and the government.
 Why does  As the technology gets more intrusive, so do the
uses of data and that leaves organizations the task
Privacy matter? to ensure that personal information is protected.
 As a result, privacy has fast-emerged as perhaps
the most significant consumer protection issue in
the global information economy.

THREATS TO PRIVACY

 Browser Cookies: Cookies help website to keep track of user


preference and user information and data collected by cookies is
sold to other companies.
 Companies sell personnel data to adverting companies to earn
money.
 Big tech giants keep users preferences, location history and
other personal information to show targeted ads and may sold
this data to third parties.
PRIVACY LAWS

Privacy law refers to the laws that deal with the regulation,


storing, and using of personally identifiable information,
personal healthcare information, and financial information of
individuals, which can be collected by governments, public
or private organizations, or other individuals.
Privacy in India
India is not a member to any convention on protection of
personal data which is equivalent to the GDPR or
the Data Protection Directive.
However, India has adopted other international
declarations and conventions such as the Universal
Declaration of Human Rights and the International
Covenant on Civil and Political Rights, which recognize
the right to privacy.
IT Act 2008 Amendment
•Section 43A, deals with implementation of reasonable security
practices for sensitive personal data or information and provides
for the compensation of the person affected by wrongful loss or
wrongful gain.
•Section 72A, which provides for imprisonment for a period up to
three years and/or a fine up to Rs. 500,000 for a person who
causes wrongful loss or wrongful gain by disclosing personal
information of another person while providing services under the
terms of lawful contract.
Aadhaar Act
India has introduced a biometric based unique identification
number for residents called ‘Aadhaar’.
Aadhaar is regulated by the Aadhaar Act 2016 and rules and
regulations issued there under. 
Entities in regulated sectors such as financial services and
telecom sector are subject to obligations of confidentiality under
sectoral laws which require them to keep customer personal
information confidential and use them for prescribed purposes or
only in the manner agreed with the customer.
Personal Data Protection Bill 2019
Recently the Personal Data Protection Bill, 2019  was
introduced in Parliament.  The Bill has been referred to a Joint
Parliamentary Committee for detailed examination, and the
report is expected by the Budget Session, 2020.  
The Bill seeks to provide for protection of personal data of
individuals, create a framework for processing such personal
data, and establishes a Data Protection Authority for the
purpose.
Article 21 of Indian Constitution
Article 21 of the Constitution of India states that “No person shall be
deprived of his life or personal liberty except according to procedure
established by law”.
The right to life enshrined in Article 21 has been liberally interpreted
so as to mean something more than mere survival and mere
existence or animal existence.
It therefore includes all those aspects of life which makes a man’s
life more meaningful, complete and worth living and right to privacy
is one such right.
Privacy / Data Breach
A privacy breach occurs when
someone accesses information
without permission.
It starts with a security breach —
penetrating a protected computer
network — and ends with the
exposure or theft of data.
Government tracking during COVID-19 pandemic

 Government of India, used contact tracking app to help to stop


spread of covid-19 pandemic which stores location history of
users at it’s server.
 Many government departments made the app mandatory
risking the privacy of the people.
 Accordingto a French "white hat", or ethical hacker the app
has vulnerability and "privacy of 90 million Indians is at stake".
Big Basket data breach

 User data from online grocery platform Big Basket is for sale
in an online cybercrime market.
 Part of a database containing the personal information of
close to 20 million users was available with a price tag of 3
million rupees.
 The data comprised names, email IDs, password hashes,
PINs, mobile numbers, addresses, dates of birth, locations,
and IP addresses.
