Violation with a higher penalty: A
Proposal to Further Amend R.A. 4136 otherwise known as An Act to Compile the Laws Relative to Land Transportation and Traffic Rules, to Create a Land Transportation Commission and for Other Purposes COUNTERFLOW
When the driver of a vehicle drives to the opposite side of
the center line of a highway in order to overtake or pass another vehicle driving in the same direction unless such left side is clearly visible, and is free of such oncoming traffic for a sufficient distance ahead or when there is a traffic officer allowing or permitting to do so; or when there is an emergency and the vehicle concerned is an ambulance, a fire truck, or a police car; or when the passenger of such vehicle is the President, member of the Congress while in session, or any other persons immune from suit. The amendment of Republic Act No. 4136 may be helpful in preventing and managing road accidents and traffic congestion by providing suspension of the license even at the first offense of the offender. RECOMMENDATION In order to help reduce possible road accidents and to make traffic congestion more manageable, must amend the law and provide for a specific penalty for counterflow such as:
First Offense: P 2,000 and 1 month suspension of the license
Second Offense: P 3,500 and 2 months suspension of the license Third Offense: P 4,000 and 6 months suspension of the license Succeeding Offense: P 7,000 and revocation of the private license -THANK YOU!-
