 An Act to regulate the importation, possesion, manufacture, compounding,
storage, transport, sale and use of poisons.

 This Act shall apply throughout Malaysia.

5.1.2 Poison Act 1952

 For over 40 years this Act and its regulations provided the chief source of law
relating to the sale and supply of medicines and other chemicals.

 A Poison Board was created under the Act, to advice the Health Minister on
substances to be controlled and various restriction to be imposed upon.

 The expression “Poison” was defined as any substance specified by name in the
first column of the poison list order under the Act.

 The poison Act only allow a licensed Pharmacist to deal in all the substances
listed in the poison list where this include importation, possession for sale,
manufacture, compounding and retailing.

 A registered Medical Practitioner, registered Dentist are allowed to use the


substances in the poison list for their own particular patient treatment only.

5.1.3 Environment Quality Act 1974
 The Environmental Quality Act, 1974 (Act 127) was formulated and made law by
Parliament with Royal Assent on March 8, 1974. This act was enacted on April
15th 1975
 It is an act relating to the prevention, abatement, control of pollution and
enhancement of the environment, and for purposes connected therewith.
 The Environmental Quality Act (EQA) provides:
(i) a common legal basis to coordinate all activities on environmental control
throughout the country
(ii) It seeks to prevent, abate and control pollution and to enhance the quality of
the environment .
 The agency responsible in administering this Act is the Department of
Environment (DOE) under the Ministry of Natural Resources and Environment
(MNRE).
 The EQA is a regulatory framework based upon:
(i) the issuance of licences
(ii) prohibition and control of pollution
(iii) the prescription of premises to be regulated

5.1.4 Atomic Energy Licensing Act 1984

 The regulation on the use of radioactive objects was carried out since 1968 when
Parliament passed the Radioactive Objects Act 1968. Given the rapid
development of atomic energy activities in Malaysia and requires more effective
regulation, in April 1984 the Parliament passed the Atomic Energy Licensing Act
(Act 304).

 In accordance with the requirements of Section 3, Act 304, the Atomic Energy
Licensing Board (AELB) was established under the Prime Minister's Department
on 1 February 1985.

 AELB acts as an enforcement body on Act 304 and subsidiary legislation made
under the act. Beginning October 27, 1990, AELB was placed under the
MINISTRY OF SCIENCE, TECHNOLOGY AND INNOVATION.

 AELB comprises five members appointed by the minister. These members are all
qualified in the field of science and technology related to atomic energy.
