ANTI-BRIBERY AND CORRUPTION


FRAMEWORK IN MALAYSIA
The MACC Act covers the following conduct:
the giving and accepting gratification;

the giving or accepting gratification by an agent;

corruptly procuring the withdrawal of a tender;

bribery of an officer of a public body;

bribery of foreign public officials;

using an office or position for gratification; and

dealing with, using, holding, receiving or


concealing gratification or advantage in relation
of any offence under the MACC Act.

MACC Act and includes


money, donation, gift, loan, property, financial benefit or
other similar advantage;

any office, dignity, employment, contract of services;

any payment, release or discharge of any loan,


obligation or other liability;

any discount, commission, rebate, bonus or percentage;

any forbearance to demand any money or moneys


worth or valuable thing;

any favor of any description, including protection from


any penalty or proceedings of a disciplinary or criminal
nature or forbearance from the exercise of any right,
power or duty; and

any offer or promise of any gratification within the


meaning of any of the preceding items.

ECONOMIC ANALYSIS ON THE ACT OF BRIBERY

economics can help isolate the


underlying factors that produce corrupt
incentives, independent of the strength
of bribery laws
economic principles can help one assess the laws and
policies against bribery to see whether they deter
payoffs effectively. Private actors frequently make
payments to public officials to obtain a benefit or to
avoid harm.

ETHICAL ANALYSIS ON THE ACT OF BRIBERY

Rule

actions themselves.
-The rights & duties model chooses the course that respects
what others are entitled to (rights) and obligations a
stakeholders has to fulfill them (duties).
-The last model, virtue, chooses the option that enforces good
habits of character for yourself and others.
-Each model can be applied when evaluating whether bribery is
ethical or not. In terms of benefits and harms tothe economy,
the benefits of bribing credit-rating agencies would havea
significant impact.

SOLUTION OF BRIBERY AND CORRUPTION


A campaign by all
20 ideas

The campaign cannot be a one-man mission. The Prime Minister must


receive dedicated support and active participation at all levels and in all
sectors.
Designate the eradication of corruption as among the highest priorities of
the nation.
Adopt a no-nonsense, zero-tolerance approach to corruption eradication. A
single-minded purpose should be inculcated at all levels and in all sectors.
Supplement the national target with corresponding state and institutional or
departmental targets. It cannot be campaign by the center alone, with the
states neither seen nor heard.
Apply key performance indicators at all levels and institutions


CORRUPTION CASES IN MALAYSIA
DATUK MOHAMAD KHIR TOYO
Dr. Mohamad Khir Toyo is a former
Chief Minister of Selangor (13th)
replacing Tan Sri Abu Hassan Omar.
Dr Khir claimed his bungalow in Section 7, Shah
Alam worth RM3.5 million and not RM24 million
as claimed. Khir was the second Chief Minister of
Selangor who was convicted of corruption after
Datuk Harun Idris.

DATUK HARUN IDRIS


Dato Harun Idris (December 22, 1925 - October 19, 2003) is
the eighth of Selangor which is the politicians and the
famous Malay fighter primarily in the state. In addition, he is
an important figure in the sports arena football for Selangor
and Malaysia.
Harun Idris was jailed for two years after being
found guilty of accepting a bribe of RM250,000
from Hong Kong and Shanghai Banking
Corporation.

METHODOLOGY
We have done survey by using google forms.
In the survey we have 35 responses and we include 7 questions.
Below is our result of the survey:

Question 1

Based on the chart above, 20 responses do not know that Malaysia is ranked 60 th in the Corruption Perception
Index (CPI).
That may be because no exposure about it in media. Media massa should play role regard this.

Question 2

31 respondents agreed stating that corruption affects the economy.


Evidence indicates that corruption is likely to adversely affect long-term economic
growth through its impact on investment, taxation, public expenditures and human
development.
Corruption is also likely to undermine the regulatory environment and the efficiency of
state institutions as rent-seeking distorts incentives and decision-making process.

Question 3

70.6% of the respondent did not know about the code of ethic.
This is because the code is not in the expose rampant and most people are not interested in
reading the act.
This code is used by engineers registered with the BEM.

Question 4

21 respondent say no to the bribery and 13 respondent say they no sure


about taking bribery and only one person say he will take the bribery that
offer to him.
There are many reason why they do not want to take bribery such as for the
muslim, it is prohibited to take bribery because the Allmighty will be sad and
the person is guilty in his view.

Question 5

Majority believes the goverment and the MACC( Malaysian Anti Corruption
Commitee) approach is not sufficient or aggresive enough to cope the crimeful act.
This is most probably because the high public perception on the CPI

Question 6

Astounding majority of the respondent agrees that stricter enforcement are the
better ways to curb corruption compared to education and campaign.
This futher proves the point the have been made in Question 5 that states the action
that is taken now is not sufficient

Question 7

The top answer for this question is contractors, businessman, and others. This
is most likely to be effected by the academic background of the respondents,
most of the respondents is bussiness and engineering students. They might be
extremely aware of the corruption in those sectors. Those who choose others
might refer to police officers or some goverment officials that is often reported
by the media

We are not arguing that there is no corruption in


Malaysia.
Perception does not arise out of thin air. All that
we are saying is that there is a need to be
cautious and not throw blanket accusations
denying the many good efforts initiated by the
government.
