Senator-judges vote 20-3 to convict Corona for non-disclosure of assets

convict Chief Justice Renato Corona for failing to fully disclose his assets, making him the rst chief justice to be removed from ofce by impeachment.
The 20 senator-judges who convicted Corona based their decision not on hard evidence presented by the prosecution, but on the chief justices own admission that he did not declare some of his bank deposits because he considered thOse condential under bank secrecy laws, which are now under review by Congress. For not disclosing his $2.4 million in dollar deposits and P80.7 million in peso deposits, the senators declared Corona morally unt and said he could not remain a chief justice any minute longer. Corona accepts fate, but insists on his innocence

CHIEF Justice Renato Corona on Tuesday accepted the Senates decision nding him guilty of violating the Constitution by failing to disclose his cash assets. In a statement released hours after the Senate rendered its verdict, Corona said he had surrendered his fate from the start when he submitted himself to the impeachment process. If this is for the good of the country, I am accepting the calvary that I have suffered. From the start, I had been ready to offer my own life for the country, Corona, who still conned at The Medical City, said in a statement. Carpio to serve as acting chief justice


ANTONIO Carpio, the most senior associate justice, will be the acting Chief Justice of the Supreme Court as a result of the removal by impeachment of Renato Corona, an ofcial said Tuesday. Senior Justice Carpio, by operation of law, will be acting chief justice, said a Supreme Court magistrate who asked not be named because he has no authority to speak for the Court. He said Carpio will assume the role as chief magistrate until President Benigno Aquino III appoints a permanent chief justice from a list to be submitted by the Judicial and Bar Council. Voting 20-3, the impeachment court ordered Coronas dismissal for violating the Constitution, citing his failure to declare all his assets in his Statement of Assets, Liabilities and Net Worth. They pointed to the $2.4 million and the more than P80 million in bank deposits that he said he owned. The Constitution says a vacancy in the judiciary must be lled within 90 days. Enrile said Corona did not stand accused of amassing ill-gotten wealth and so the court disallowed the charge contained in Paragraph 2.4 of Article 2 that the chief justice was suspected and accused of having accumulated ill-gotten wealth, acquiring assets of high values and keeping bank accounts with huge deposits. To this day, I strongly maintain it was an invalid charge, it being based on mere suspicion, on so-called reports, rather than on factual allegations, Enrile said. Enrile also criticized the prosecution for its poor preparation and for taking its case to the public through the media. As a lawyer, I must confess that I was personally frustrated by the loose and hasty crafting and preparation that characterized the presentation of the charges contained in the Articles of Impeachment. It seemed that the case was being built up only after the charges were actually led. The repeated recourse to this courts compulsory processes to obtain evidence which normally should have formed the factual basis of the charges in the rst place further burdened and, at times, taxed the patience of this court, Enrile said. He cited how the letter of the administrator of the Land Registration Authority which contained, as an attachment, a list of 45 properties supposedly owned by Corona, was fed to the media even before the Senate could begin the actual trial of the case. Even before the Hon. Ombudsman, Conchita Carpio Morales, was called to testify before this Court, her letter to the Chief Justice requiring him to explain in 72 hours an alleged aggregate amount of $10 million in several dollar accounts was leaked to the media right before the resumption of this trial last May 7, Enrile said. We have sternly cautioned against unethical and unprofessional conduct, the penchant to engage in trial by publicity, to use the media to disseminate and advance so called information or evidence, to provoke and disrespect this court and its members, and to irresponsibly hurl disparaging insinuations and accusations, he said. But Enrile also faulted the defense and Corona himself for reviving the nature of his assets by introducing evidence to prove that his income and assets were legitimate, and by testimony to show how he and his wife had saved and invested these savings in foreign currency over so many decades. I submit that the Chief Justice had justiable and legal grounds to rely on the Supreme Courts procedural and policy guidelines governaldine Javier, Janet Balbarona, Arturo Sanchez, Ronald Ventura, Luis Lorenzana, Yasmin Sison, Rodel Tapaya, Randy Solon, Lynyrd Paras and Neal Oshima. Angeles joins a growing group of young Filipino artists who have been breaking records at Christies and Sothebys, the other premiere art auctioneers in Asia. Even as the Chief Justice had full access to his own bank accounts and all the opportunity to introduce evidence to disprove the data, ndings and analysis presented by the Ombudsman or the report of the AMLC, the defense did not introduce any such evidence, Enrile said. Because of this, Enrile said, the impeachment court could only rely on the documents supplied by the Ombudsman, which showed Coronas bank transactions but which did not show the actual bank balances of his bank accounts. Finally, Enrile said he disagreed with Coronas defense that the law allowed him to exclude his dollar deposits and co-mingled peso deposits from this statements of assets, liabilities and net worth. If, indeed, any of the respondents cash deposits were co-mingled with the funds belonging to other parties such as the Basa Guidote Enterprises, Inc. (BGEI) or his children, the respondent was still duty bound to declare these deposits in his SALN, they being admittedly under his name, Enrile said. He added that Corona had provided no evidence that he was holding the funds in trust. Assuming that any part of such deposits in truth belonged to third parties, the respondent could have indicated such third-party funds as corresponding liabilities in his SALN. That would have reected his real net worth, Enrile said. With all due respect, I believe that the respondent chief justices reliance on the absolute condentiality accorded to foreign currency deposits under Section 8 of Republic Act No. 6426 is grossly misplaced, Enrile said. Are we now to say that this Constitutional command is limited to a public ofcials assets or deposits in local currency? If so, would we not be saying, in effect, that the Constitution allows something less than a full, honest and complete disclosure? It bears noting that the prescribed form of the SALN quite simply requires public ofcers and employees to declare their assets, real and personal, the latter to include cash and bank deposits, bonds, etc. It does not require the pubFilipino artists include Ronald Ventura, Andres Barrioquinto and Jon Jaylo. Supreme Court Associate Justice Serafin Cuevas, accepted the impeachment courts verdict but said Corona had the option to question the guilty verdict. He said Corona may ask the Supreme Court to void the impeachment courts decisions for grave abuse of discretion. If the chief justice decides to do so, we will bring this issue before the Supreme Court, Cuevas said. We noticed many instances of grave abuse of discretion. But defense counsel Dannis Manalo said the impeachment courts decision may not be appealed. We respect the impeachment court, he said. Maguindanao Rep. Simeon Datumanong said he hoped that the Aquino administration would be able to focus on the countrys pressing problems now that the impeachment trial was over. Let us hope that the decision of the impeachment court will now make government focus on solving the problems besetting our nation, he said. Zamales Rep. Milagros Magsaysay urged the Aquino administration to begin focusing on the gut issues. Genuine reforms should take place and true governance for the benefit of the Filipino people should prevail, she said. House Assistant Majority Leader and Davao City Rep. They also said Coronas accusers were equally guilty, if not more guilty of not declaring all their assets. The Senate is being asked to remove the chief justice only because he submitted allegedly an erroneous SALN. Thus far, what has happened? We were getting close to a bill of attainder, a law passed by one house and approved by another, creating an offense, inventing a crime willful or not. It is a legislative act of convicting an accused, and through a vote instead of a trial, on the basis of accusation taken as proof, Arroyo said. Arroyo said Corona was a victim of political assassination. I cannot imagine on account of a SALN, we will remove the chief justice, Arroyo said. I vote to acquit. Santiago said the Constitution provides that the impeachable offenses are culpable violation of the Constitution, treason, bribery, graft and corruption, other high crimes, or betrayal of public trust. An omission in good faith in the SALN carries a light penalty, and is even allowed to be corrected. Thus, it is not impeachable, Santiago said. Santiago said the Constitution simply provides that a public officer shall submit a declaration under oath of his assets, liabilities, and net worth. That is all. There are no details. The Constitution is a brief declaration of fundamental principles. Many constitutional provisions are only commands to the Congress to enact laws to carry out the purpose of the charter, she said. As a general rule, Santiago said, constitutional provisions are not selfexecutory but the usual exceptions are the Bill of Rights, and constitutional prohibitions. All other constitutional provisions, such as the SALN provision, she said, need implementing laws to provide the details. Hence, Congress, to implement this constitutional provision, has passed a number of laws, including the Foreign Currency Deposit Act, which confers absolute condentiality on dollar deposits, Santiago said. She also said there was no conict between the Constitution and the Foreign Currency Deposits Act. The perceived conict is so simplistic that it is seriously laughable. If there is any conict, it is between the Code of Conduct and Ethical Standards, which provides for a waiver of condentiality; and the Foreign Currency Act, which provides for absolute condentiality, Santiago said. It is for Congress to balance on the one hand, the need for public accountability from public ofcers; with, on the other hand, the desper-

The burden of proof is on the prosecution. How much proof is necessary? In other words, what is the standard of proof? I have adopted the very high standard of overwhelming preponderance of evidence. My standard is very high, because removal by conviction on impeachment is a stunning penalty, the ruin of a life. The defendant admitted that he did not declare his dollar accounts and certain co-mingled peso accounts in his SALN. Did this omission amount to an impeachable offense? No, Santiago said. When she started to leave the podium without casting her vote and was reminded to do so, she said: Will you be surprised if I vote not guilty? Marcos, for his part, lamented that instead of granting Corona due process, the government used all its resources to ensure the chief magistrates conviction. After four hours in which the senators took turns explaining their vote, Enrile, who was the last to cast his vote to convict, announced the verdict and ordered that the Chief Justice, the Vice President, the Speaker and President Benigno Aquino III be given a true certied copy of the conviction. Revilla Jr. was the 16th senator to vote for conviction, delivering the winning vote to the prosecution. Enrile, in explaining his vote, pointed to the irregularities that marred the trial. The non-disclosure of these deposits, in both local and foreign currency, would naturally result in a corresponding distortion of the chief justices real net worth, Enrile said. He said the provisions of RA 6426 cannot be interpreted as an exception to the unequivocal command and tenor of Article XI, Sec. 17, of the 1987 Constitution, and I regret that the Highest Magistrate of the land, no less, would think otherwise. Enrile also said the Foreign Currency Deposit Act prevented other parties from revealing details of bank deposits, not the depositor himself. Enrile sought to answer why the chief justice should be held accountable when others were guilty of the same offense. Here lies what many have posited as a moral dilemma. I believe it is our duty to resolve this dilemma in favor of upholding the law and sound public policy. If we were to agree with the respondent that he was correct in not disclosing the value of his foreign currency deposits because they are absolutely condential, can we ever expect any SALN to be led by public ofcials from hereon to be more accurate and true than they are today? Enrile said. I am not oblivious to the possible political repercussions of the nal verdict we are called upon to render today. I am deeply concerned that the people may just so easily ignore, forget, if not completely miss out, the hard lessons we all must learn from this episode, instead of grow and mature as citizens of a democratic nation, he said. And so, with full trust that the Almighty will see us through the aftermath of this chapter in our nations history, I vote to hold the Chief Justice, Renato C. Corona, guilty as charged under Article 2... and that his deliberate act of excluding substantial assets from his sworn statement of assets, liabilities and net worth constitutes a culpable violation of the Constitution, Enrile said. Let us never forget that those who come to court, be they rich or poor, must do so in the expectation of receiving impartial justice from those who uphold both the spirit and the letter of the law. Valte said the President had 90 days to appoint a new chief justice. She insisted that the Senate verdict was immediately executory and Coronas position became vacant immediately. Lead impeachment prosecutor and Iloilo Rep. Niel Tupas Jr. described the conviction as a victory for the Filipino people. We have no personal gain here. We just did what we should do in support of the Aquino governments reform agenda, he said. Rep. Erin Taada and Aurora Rep. Juan Edgardo Angara said Coronas removal signaled a new beginning for the judiciary. This is the start of putting our republic back in order, Taada said. We are hopeful that this historic decision of the Senate impeachment court will help restore the peoples faith in the judiciary and in government, Angara said.

I spent my life paying for this property, only to be taken away by an ambassador who is a very rich and powerful man, Santos told the Manila Standard during the preliminary investigation held by Assistant City Prosecutor Edna Conde Tuesday afternoon. He should not do this to someone like me. Lhuillier, the ambassador to to Italy from 1999 to 2010, did not appear in court. His lawyer said the ambassador was in Portugal, and that he would answer the

charges against him in due time. Santos counsel Jonas Castro said the case stemmed from an equitable mortgage case between Santos and one Lourdes Mendoza, who allegedly faked an order from the Makati Regional Trial Court Branch 147 that supposedly awarded the property in question to her. The forgery allegedly took place after the court declared Santos as the lawful owner of the property. Mendoza later transferred the ownership of the property to her daughter Maria Lourdes, who then sold it to Lhuillier at an undisclosed amount.

Mr. Lhuillier bought the property from the wrong owner without conducting the standard due diligence in buying real estate, Castro said. If he claims he is the real owner, then he should show to us a genuine title. Santos said he wrote the ambassador informing him that he made a mistake in buying the piece of property from the wrong person. He said his lawyers meeting with Lhuilliers lawyer did not end well because Lhuillier offered to buy the property instead for P8 million. Santos said he was surprised when he discovered that his prop-

THE National Police on Tuesday said 17 more people joined its list of informants who got their own share of reward, which so far amounted to P2.4 million. National police chief Gen. Nicanor Bartolome said each tipster received amounts ranging from P90,000 to P300,000. One of these cases was the arrest of Sahid Guiamadel alyas Jun Aliman, who was among the suspects in the massacre of 57 people including 30 journalists on November 23, 2009 in Ampatuan town of Maguindanao. Bartolome explained that the identity of the informants would remain condential and could not be disclosed for security reasons. These tipsters gave us valuable information on the whereabouts of fugitives, including a recently arrested suspect in the 2009 massacre of 57 people in Maguindanao, Bartolome said. A LAWMAKER has led a bill requiring parents to plant two trees for every child born to them to help reverse the worsening effects of climate change and promote environmental protection The proposed measure to be called the Family Tree Planting Act requiresFilipino couples, whether legally married or not, to plant or cause to plant two trees. Rep. Edwin Olivarez of Paranaque led the bill. Under the proposal, trees may be planted either within the premises of their family home or in the areas to be designated by the concerned Provincial Environmental and Natural Resources Ofce (PENRO) or Community Environment and Natural Resources (CENTRO) where they reside. The bill provides that before the Local Civil Registrar of the city or municipality where the child was born can issue a birth certicate, the parents or parent should secure a joint afdavit or afdavit attesting that they have complied with the law. The barangay chief will issue the afdavit of compliance where they reside if the trees were planted within the premises of the family home or the appropriate legal ofcer of the PENRO or CENRO if the trees were planted in government sites, the bill said. The bill provides penalty for the civil registrar, who will issue the birth certicate even if the parent/ parents failed to present a certicate of compliance. The penalty ranges from month suspension of the erring ofcial or a ne of P10, 000 to dismissal from ofce. The prosecution of violation committed by the erring Local Civil Registrar shall be without prejudice to the ling of a criminal case against the guilty parents or parent, the bills author said. China open to a dialogue, says Gazmin

DEFENSE Secretary Voltaire Gazmin on Tuesday said China was open to dialogue and communications. In a statement released by the Philippines Department of National Defense, Gazmin said he had met with his Chinese counterpart Liang Guanglie during the Asean Defense Ministers Meeting and took the time to discuss their territorial row over Scarborough Shoal. According to Liang, the two defense departments should play a positive role by staying calm, making prudent remarks on the situation to avoiding overstatements and misinterpretations by the parties, observing restraint in their actions and most importantly keeping the lines of communications open. The shoal was within the 200-nautical-mile exclusive economic zone of the Philippines, but China staked a claim on the area and called it Huanyan Island, more than 800 nautical miles from the mainland China. Liang noted that while the Philippines and China were currently facing difculties, positive remarks are notable in regard to the two countries defense relations. He likewise acknowledged that the two defense ministers having a dialogue would denitely contribute to the search for a solution to the conct, the statement said. Gazmin countered the point raised by Liang that it was the Philippines action to have a Philippine Navy vessel arrest the Chinese shermen. He emphasized that the Navy vessel was t en route to the northern Philippines to assist Filipinos who fel threatened by Gazmin North Koreas rocket.

LEARNING German increases the chances of Filipino graduates to secure jobs in Germany or nd employment in any of the German companies in the Philippines, an executive of Goethe-Institut Philippines told members of the Foundation for Upgrading the Standard of Education . Addressing a recent FUSE general assembly in Manila, Falk Schleicher, head of Goethe Institut Philippines language program, said nurses and caregivers are in high demand in Germany due to its aging population, but it would help if job applicants know how to speak German. Theres a shortage of nurses and caregivers in our country as young Germans leave their parents in rural areas, Schleicher said. To ll the shortage, Germany is looking for health-care providers who can speak our language. Schleicher told FUSE memberscomposed of the countrys top educators from public and private schools and university ofcialsthat there are currently 150,000 nurses and caregivers in Germany. Meanwhile, there are about 150 German companies operating in the Philippines, many of them in the call-center industry, which require German-speaking staff. According to Schleicher, nine public high schools in the Philippines are offering German classes through a memorandum of understanding (MOU) entered into by the Department of Education (DepEd) and GoetheInstitut Philippines last year. About 680 students attend the German classes, while 36 English teachers have been attending a training program to become German teachers, with eight of them currently on a six-month immersion program in Germany.

Ex-governor pleads for case dismissal

FORMER Governor Grace Padaca of Isabela has asked the Supreme Court to dismiss the graft cases led by the Ofce of the Ombudsman, In a 45-page petition, Padaca urged the high court to set aside the resolution of Ombudsman Conchita Carpio-Morales nding her liable for graft and malversation of public funds. The (Ombudsman) acted with grave abuse of discretion amounting to lack or excess of jurisdiction in issuing the assailed resolutions nding probable cause against (Padaca), the petition stressed. The elements of undue injury to the government or unwarranted benets to any party and manifest partiality, evident bad faith or inexcusable negligence are clearly absent, Padaca said. Padaca and several ofcers of a nongovernment organization were accused of mishandling government funds. The former provincial chief executive allegedly allowed the NGO Economic Development for Western Isabela and Northern Luzon Foundation (Edwinl) to take out hybrid rice loans from a P25-million fund in 2006 without public bidding. However, Padaca said public bidding was not required and the government was not adversely affected when Edwinl secured the loans. She said the NGO did not receive any amount from the provincial government and was only supposed to maintain the funds for the rice program and then facilitate their transfer to qualied farmer beneciaries in Isabela. In performing such an undertaking, the NGO did not expect to get paid because it was voluntary, Padaca said. The memorandum of agreement between the provincial government and the NGO had sufcient safeguards to prevent Edwin1 from getting any unwarranted benets from the project, she said. Her petition also said that not all the elements of the crime of malversation of public funds could be found in the case. Padaca said she did not have custody of the public funds and she was not the accountable ofcer.

Lawmakers propose garbage compactors for local governments


LOCAL Government Units will do well to use garbage trucks with onboard compactor for the collection and transportation of solid waste. This was the idea behind the bill led by Buhay party-list Reps. Irwin Tieng and Mariano Michael Velarde,who sought to address the increasing volume of garbage and the need for a system of collection and disposal. The measure would require garbage disposal with onboard compactor that would compress solid waste while in transit. It was also in keeping with the goal of Republic Act 9003 otherwise known as Ecological Solid Waste Management Act of 2000 to reduce solid waste volume and adopt waste minimization measures. Tieng said as urbanization and economic development was increasing in the Philippines, nowhere was the impact more obvious than its worsening garbage problems. Citing statistics from the Metro Manila Development Authority, Tieng said each Filipino living in the metropolis generated an average of half a kilo of solid waste everyday. With a population of more than 10 million, he added, total waste generated in Metro Manila alone could run up more than two million metric tons every year. Despite the passage of the Ecological Solid Waste Management Act, garbage production still continues to increase at an alarming rate. Although considerable efforts are being made by our government in combating waste-related problems, there are still major gaps to be lled in this area, Tieng said. Tieng said one of the causes that could be attributed to this worsening problem is the use of outdated technology. He said most LGUs lacked modern and cost-efcient transport system for purposes of collecting and transporting garbage from every household to the landlls. Maricel Cruz

AFTER 44 trial days, the Senate impeachment court has spoken. By a vote of 20 to 3, the senators found Chief Justice Renato Corona guilty of a culpable violation of the Constitution for failing to le an accurate statement of his assets, liabilities and net worth. In the end, the vote was relatively easy for the senators, who regardless of their public pronouncements, kept a steady eye on public opinion that had already been shaped by a relentless and shameful media campaign to tar and feather the chief justice. Faced with a conviction in the court of public opinion and confronted by illegally obtained documents, the chief justice made admissions before the court that proved to be his own undoing. Never mind if rules were broken or that his rights had been violated. To the common folkrepresented in the Senate by one lawmaker who seemed proud that he could speak no Englishthe issue

was cut and dry. After all, he saw it in a PowerPoint presentation. The vote is no doubt a victory for the Aquino administration and its allies, who had made the conviction of the chief magistrate their top priority for the good part of the last several months, often to the detriment of matters of greater national import. There will no doubt be celebrations and self-congratulation at the Palace, and on the streets where its minions gathered to pressure the senators to vote the chief justice out of ofce. Lost in the din of the celebrations will be the cautionary voices who courageously voted to acquit the chief justice, against the tide of public opinion, on the bases of a defective impeachment complaint, tainted and spurious evidence, the blatant violation of the defendants rights, and the unprecedented mobilization of state resources against the political enemy of the Chief Executive. In the self-righteous The sad truth is that the chief justice was prosecuted and judged mostly by people whose moral standing was not demonstrably superior to his. Many, in the course of the impeachment trial, showed their hypocrisy in twisting the rules to suit their purposes. Others never had the honesty to inhibit themselves, even though there were clear conicts of interest involved. Can we honestly expect these same politicians to grow halos on the strength of the chief justices conviction? The only realistic hope we can draw from what has proved to be a divisive and expensive exercise is that the branches of government will get back to work and forget that they have become instruments of executive wrath. As for the President, who enters his third year in ofce with very little to show, the chief justices removal will offer him no further excuse for nonperformance.

Noynoy wins it all

ITS all over. The powerful palace, backed by both Houses of Congress, Big Media and all the resources at the states disposal, has won against the weakest branch of government. There is certainly going to be rejoicing amongst those who assembled the immense forces deployed against Chief Justice Renato Corona. Those who supported the convicted chief justice who dared to go against the palace-created juggernaut, however, should not bow their heads in shame, despite their defeat. Even if he lost so completely in the Senate, Corona and his allies can take comfort in leading a much-needed crusade for transparency in government that, ironically, claimed the chief justice as its rst prominent victim. Whether or not Coronas tormentors will apply the same standard of complete and transparent disclosure of their own assets on themselves, however, is another thing altogether. But the people who have witnessed the Corona impeachment trial have now been made aware of just how important it is to adhere to both the letter and the spirit of the laws on disclosing their ofcials wealth. Now that Corona has been convicted, no longer will the self-righteous people who called him a thief and liar be able to say that they are not on trial. Now, everyone in government is expected to declare all assets painstakingly and completely. And until the corrupt nd new ways to squirrel away their stolen wealth, every ofcial should go under the same microscope used on Corona. Distressingly, the instigators of Coronas removal have never gone far enough to require the same stringent standards of disclosure on themselves. Even President Noynoy Aquino, who publicly declared as a candidate that he would, on his own, disclose the contents of his personal bank accounts, has been quick to distance himself from that particular campaign promise. It would be terribly optimistic to hope that the conviction of Corona would lead to a self-instigated housecleaning by the Aquino administration, with the end in view of shaming and removing all corrupt ofcials wherever they may be. The track record of this administration simply does not allow for that hope. *** Yes, the Senate has handed down a verdict of guilty in the case of impeached Chief Justice Renato Corona by a wide majority. consequences of the removal of Corona, if the Aquino administrations playbook is to be followed, should become apparent soon enough. The rst and most logical result of Coronas conviction is the appointment of a new chief justice of the Supreme Court more to the liking of President Noynoy Aquino. The naming of a new, palace-friendly chief magistrate will have very serious, far-reaching repercussions, as far as the disposition of several important pending cases before the tribunal is concerned. These cases include the compensation that should be given to the Presidents family for the g o v e r n m e n t s acquisition of Hacienda Luisita and the expansion of the powers of the Autonomous Region for Muslim Mindanao, to name just two. How the court, under its new chief, will now rule on cases that are being pleaded by Malacaang or the President before it, will make for very interesting watching. The identity of Coronas replacement will surely be a key indicator of the new direction the court will take. If this new chief magistrate is Coronas longtime rival, Senior Associate Justice Antonio Carpio, then it is safe to say that all the fears about a high court that is subservient to Malacaang will have come trueand then some. Carpio is widely believed to look with favor on the electoral protest led by Transportation Secretary Mar Roxas, Aquinos 2010 running mate, against Vice President Jejomar Binay. If the Supreme Court under Carpio suddenly gives due course to Roxas protest, then we will know just how far-reaching the campaign to remove Corona is. Needless to say, the effect of Coronas removal on the rest of the Supreme Court, regardless of who is appointed as his replacement, is also considerable. As one incredibly cocky congressional ally of Aquinos said on the eve of the handing down of the Senate verdict, it will be a very brave justice who will now attempt to oppose the wishes of the administration. *** The conviction of Corona, after all, was never a simple matter of replacing an ordinary high government ofcial. The chief justice of the Supreme Court is head of what is supposed to be a co-equal branch of Malacaang Palace and Congress. Aquinos successful ouster of Corona means that the President now has absolute control not only over his own immensely powerful department but over both House of Congress, as well. Needless to say, the soon-tobe-headless Judiciary is now rmly under the presidential thumb. And all that power now in Aquinos hands is what scares me most of all.

A tale of three women

THERES an interesting and interlocking sidebar to the South China Sea territorial dispute. It is a tale of three strong-willed women who have been thrust into a convergence zone of conict of national interests. On the soft shoulders of these hard-nosed negotiators in the eld of diplomacy rests the hope of nding a solution to the not-too-calm waters of the South China Sea. The rst woman is Ambassador Sonia Brady who has been drawn out of retirement to provide the old China hand card to deal with the Mandarins in Beijing. She was our ambassador to Beijing from 2006 to 2010. The second femme fatale (only to men who cant stand up to the diplomatic skills of these women) is Ambassador Fu Ying who was Chinese ambassador to the Philippines from 1998 to 2000. Madame Fu Ying is presently Chinas Vice Foreign Minister with whom our Ambassador Brady would have to counteract on the sensitive issue of the South China Sea, and the ashpoint in the Scarborough Shoal Ambassador Brady, before her assignment as envoy to Beijing, was also the DFAs undersecretary for policy, the counterpart of Fu Yings vice foreign minister rank. The third, but not least of these three women deeply involved in the high-stakes game of global poker, is US Secretary of State Hillary Rodham Clinton. She recently incurred

Chinese ire with her statement that China has exceeded her claims beyond the maritime limits provided in the United Nations Convention on the Law of the Sea. China which has staked a sweeping claim over the entire South China Sea found Clintons comment as meddling by a non-claimant country. Beijings ofcial position is that the conicting claims in the SCS can only be resolved bilaterally and without multilateral intervention. A widening Washington involvement is upsetting Beijing. Aside from providing Manila with two naval vessels to strengthen its maritime security, US Secretary of State Clinton and Defense Secretary Leon Panetta also met with their Philippine counterparts, Secretaries Albert del Rosario and Voltaire Gazmin in the US capital last month. Before Clintons remark that China has exceeded her claims beyond the scope of UNCLOS, Beijing has never reacted directly to oft-repeated US statements that vital sea lanes in the South China Sea must be kept open to navigation. To the Washington watchers in Beijing, the Clinton statement gave clarity as to whose side the US is on. America has always been considered a Pacic power since it sailed into Manila Bay to take over the islands from the Spanish colonizers. The reach of its naval power extends from San Diego in California to Cam Ranh Bay during the Vietnam war. Its forward position of military deployment is manifested in its bases in Japan, Korea and the US territory of Guam. But to go back to the two principal

players in this tug of war over riches beneath the sea, Ambassadors Brady and Fu Ying are both well cast into the roles each will play in the service of their country. Early in her career, Brady had a previous posting in the Chinese capital as Philippine consul. She has a background in international relations, philosophy and journalism important tools in diplomatic dialogue. Sonia Cataumber, my classmate at the University of Santo Tomas, was married to a New Zealander diplomat surnamed Brady who had since passed away. Fu Ying, aside from postings as ambassador to Indonesia, Australia and the United Kingdom, is a woman of letters. She has published articles in The Guardian, including one in the London Daily Telegraph criticizing Western media for demonizing China. She is a graduate of University of Kent. Indeed, both sides wont have a problem of losing something in English translation when the two women sit down to dialogue. Although an ethnic Mongolian born in Hohhot, Inner Mongolia, Fu Ying started her career as an English translator for the Chinese foreign ministry Ambassador Fu Ying has published a literary essay, appropriately titled If the West Can Listen to China. The summer games to be held in London this August would surely bring back memories of her designation as Olympic torch bearer in the British capital for the 2008 Beijing Olympics. Amid a backdrop of slight snow dusting the ceremonial run, Fu Ying and the Chinese delegation were mobbed by unruly English thugs protesting Chinas human rights violations in Tibet.

FIRST THINGS FIRST
MILANWhile Filipinos were on tenterhooks awaiting the Senate verdict on Chief Justice Renato Corona, families from all over were descending upon Milan for the 7th World Meeting of Families with Pope Benedict XVI. Two different worlds praying to the same God: in Manila, that the Senate may acquit Corona; here, that the world would learn to care more and much better for the human family. Increasingly, the latter has become a universal prayer. Two days ago I was in Madrid for the 6th World Congress of Families where I found myself the only Asian speaker in a wide array of speakers from the ve continents. From that purely secular event to this religious-cultural one, the message is the same: the natural human family is the nal earthly hope of mankind; it must be protected from all harm. Still, as soon as I checked into my hotel here, the rst call I got was from a Manila TV station asking for a fearless forecast on how the senatorjudges would vote on Corona. I told the caller one should not speculate on that, knowing its implications to the whole country. Hours before the trial started, I got a call from the Senate protocol ofce asking whether I would be attending the nal day. Like other Filipinos here, I shall be waiting for the rst bulletins from Manila. There will be a lot of Filipino ecclesiastics travelling here who will be sitting on pins and needles waiting for the breaking news. My only prayer now

Pluses and minuses


TO THE POINT
THE impeachment court has nally come out with the verdict on Chief Justice Renato Corona. The next question is: What does this mean for us? Will it mean more jobs and higher wages to enable Filipinos to cope with increasing prices of practically everything? Will it mean less criminality and a more secure environment for citizens? Will the verdict translate to timely and adequate action to keep the poor out of harms way in the event of typhoons and resulting oods, landslides and similar disasters? All these questions are addressed to Malacaang, which spent months xated on pinning down the chief justice in the face of other concerns that need attention. Congress, too, let its work slide. Perhaps now they can get back to work. *** The impeachment courts decision on Corona carries with it plus and minuses. We all agree on the need for transparency and accountability in government ofce. This is mandated by the Constitution. Article XI, Section 1 says that public ofce is a public trust. Public ofcers and employees must at all times be accountable to the people, serve them with utmost responsibility, integrity, loyalty, and efciency. They must act with patriotism and justice, and lead modest lives. The Corona trial also serves as a wake-up call for the members of the Judiciary. They should respond to calls for reform. Their branch of government has been weighed down by complaints of graft and corruption. Whatever we say about the nal decision, it shows us one thing: That democracy works in this country through the system of checks and balances. Unfortunately, the trial has damaged the Supreme Court as an institution. It has also sent a chilling effectthat the Palace can mobilize agencies such as the Land Registration Authority, Bureau of Internal Revenue, Ofce of the Solicitor General, Ofce of the Ombudsman, and the Anti-Money Laundering Council. This tells us how far a President is willing to go in the name of what he calls reform, using his awesome powers. Is it worth it? Did God abandon the Senate?

is that whatever happens at the Senate, the country would be spared further pain and agony. And I will be asking the reader to join everyone here in Milan in praying for the family, which is facing all sorts of evil everywhere today. In Madrid, I was asked to speak on the topic, Can democracy and human rights exist without God? along with three other distinguished scholars and religious leaders from the United States, Spain and Russia. I shall share with you part of that speech now. Can democracy and human rights exist without God? The truth is evident enough, so the question answers itself. Still we must talk about it. We live in an age of belief and non-belief. The war of religions is over, but the war against religion is on. Our faith in the Triune God is growing, but so also is its antithesis---atheism, agnosticism, and apostasy. Our certain hope though is that our Faith---the Christian faith--shall ultimately prevail. None of us live in a country where the political authority reaches for a gun whenever someone speaks of faith or reason. But many of us, I fear, are living in countries where every kind of discourse is permitted, or even applauded, so long as one does not speak of God or use the language of religion. Such countries like to call themselves democratic. And they invoke human rights to justify acts and omissions that paradoxically offend and deny our intrinsic nature as human beings. But are they true democracies? Are the human rights they speak of legitimate human rights when, in the most tragic cases, they seek to repudiate the very truth of our being? What happens when a great country, which was built under a sacred canopy, with religion as its rst political institution, according to Alexis de Tocqueville, a country which as inspired so many others to adopt a democratic constitution, proclaims the destruction of the unborn as a human right and promotes it such as a legal norm for all nations? What happens when a great continent like Europe, which once stood as the shining glory of Christianity, allows itself to be divided on the issue of whether or not to mention God and the Christian origin of its culture in its Constitution? And what happens when agencies of the UN, which was established to save succeeding generations from the scourge of war and to reafrm faith in fundamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small, pursue the exact opposite of its declared objective, and wage war on the unborn, the family and marriage, and compel poor countries to enact laws that undermine their basic values and institutions? Let us, for a moment, look at the great Western democracies Do they not by their achievements validate the wisdom of excluding God from public life? And yet the moment the State accepts and begins to exercise its mandate to govern it will have to accept the authority of a Transcendental Power from whom the truth about man, about freedom, about justice, about peace comes. There is only one name for that PowerGod. The speech does not end here. But I will end by praying that as God will be with the worlds families in Milan, may He not abandon the Philippine Senate today. [email protected]

What does the verdict mean for Filipinos?

Many interesting things are happening: Former President Joseph Estrada is running for mayor in Manila and movie and television personality Vic Sotto is trying his luck against Mayor Herbert Bautista in Quezon City. Boxing icon Manny Pacquiao is running for governor of Sarangani. The local scene is lively. But the focus is on the senatorial race. The United Nationalist Coalition of Vice President Jejomar Binay and former President Estrada has come out with a formidable line up, which includes Chiz Escudero, Loren Legarda, Alan Peter Cayetano, Koko Pimentel, Greg Honasan, Jackie Ponce Enrile, JV Ejercito, Dick Gordon, Migz Zubiri, Mitos Magsaysay, Gwen Garciaand possibly two more. We can be sure that at least 10 of them will win. This leaves only three slots for newcomers and the other wannabes. On the Liberal Party side, President Aquino has already endorsed fourCustoms Commissioner Ruffy Biazon, Tesda Director Joel Villanueva, former party list Rep. Risa Hontiveros-Baraquel and Rep. Sonny Angara, son of Senator Edong Angara. Oh well, they can dream, cant they? The Nacionalista Party wants to coalesce with the Liberal Party. Senator Manny Villar wants his wife Cynthia to run for the Senate. Whether or not she can win is a big question mark. *** The move of Malacaang to have Customs Chief Biazon run for the Senate is considered by many as a big mistake. If he runs, he will be considered a lame duckentirely useless as chief of the Bureau of Customs. My gulay, Biazon has hardly warmed his seat and now he will leave it at once? Observers say the frequent changing of top ofcials has been responsible for the failure to curb smuggling. In fairness to Biazon, hes trying his best to institute reforms in his bureau. *** I heard Ilocos Norte Rep. Rudy Farias make a summation last Mondays at the impeachment trial. I could not help but recall that he had confessed that he had not signed the Articles of Impeachment against Corona because he was a slow reader and could not possibly have read everything. But last Monday, Farias was there accusing the chief justice of so many things, saying that Corona used lame excuses in defending himself from the charges thrown at him by the prosecutors. I believe the word he used was palusot. Wasnt there a point when Farias was ready to resign from the prosecution? But, there he was, castigating Corona for the lame excuses he offered about not disclosing his peso and dollar accounts in his Statement of Assets, Liabilities and Net Worth. There is a name for people like Farias, but I wont say it here because its not polite.

Trusting the process


ARE WE THERE YET?
MOST people I know tried to get through the routines of their daily lives yesterday as if nothing extraordinary was about to happen. But there was no denying the anticipation that hung in the air; it was almost palpable. People awaited with bated breath the outcome of the impeachment trial of Renato Corona, chief justice of the Supreme Court. We made history yesterday and however we looked at the verdictwhether we rejoiced or grieved, we all have to stand by the decision of our senators because that is people in a democracy do. We bow to the system. Whatever misgivings we have, we trust the process. This column was written and submitted before the senator-judges cast their votes yesterday, which was propitious because I wanted to make certain observations about certain things about the impeachment trial without the burden of having them framed within the context of the nal verdict of the senators. We truly seem to be a people that take immense pleasure from making fearless forecasts and predictions on any process that requires voting. Trusting the designated authorities and submitting ourselves to a process are concepts that do not seem to jibe well with our temperament. I was asked many times

in the last few days what I thought would be the nal outcome of the voting, which senators would be voting for or against Coronas impeachment, and how the senators would be justifying their votes. People speculated on how certain senators would vote based on perceived body language, the number and kind of questions they asked, even based on their perceived afliations. I told people repeatedly that I honestly didnt know and didnt want to prejudge the senators. There were those who proclaimed a hundred percent certainty of the accuracy of their predictions primarily because they were convinced of the brilliance of their personal deductions. Unfortunately, there is no accounting for personal biases and convictions and what really mattered in the end were those of the individual senators. Which is why I fervently hope that people would respect and accept the decision of the senators. The chief justice himself said that he would do so. The prosecutors also said as much. Whether or not we agree with the decision, we should abide by it. I personally found a lot of things that were really objectionable about the way this particular impeachment process was conducted, but at the end of the day, we all have to accept that its a process that continues to be a work in progress. This is only the second impeachment complaint that actually went into trial; and the rst one ended with a walkout that spiraled into a people power revolution. I keep the hope that we would eventually be able to conduct an impeachment trial in ways

that are truly fair and make us proud of our democratic systems and ourselves. Of course, our leaders should not be the subjects of impeachment complaints, but that is an ideal that we can only dream of at this point given our penchant for electing the wrong people into ofce and the culture of corruption that is deeply imbedded in our system. It is expected that there will a lot of caterwauling and justifying in the next few days. I hope our senators and our congressmen watch what they say in public. It is not the time to gloat or to throw tantrums. Truth be told, I wish the senators would be required to shut up after they have cast their votes and take a vow of silence so as not to dilute the essence of their votes or destroy whatever integrity is left of the system. It will take time before the people who think of themselves as aggrieved parties are able to accept the verdict but we can all take comfort from the fact that everything eventually normalizes. Even the senators who voted against the opening of that controversial envelope during the Estrada impeachment trial and who were subsequently demonized and hung in the bar of public opinion were eventually able to regain their popularity. Many of them are back as senators. We will all be able to recover from this process; there is life after this painful and difcult phase. Whether or not what happened yesterday bodes well for the country is something that cannot be divined immediately. But we can all allow the process of healing to start now.

CHASING HAPPY
PRISON conjures images of horror cramped cells, cruel prison guards, nasty gang wars, bad food. Desperation. I had this mindset when I, along with two of my classmates Vietnamese Lan Phuong and Cambodian Seangly Phak visited the Correctional Institution for Women the other Sunday. Employees led by prison guard Elsa Martorillas, teacher Jeanefer Guy Llanes, and recreation officer Lulu Santos, as coordinated by Bureau of Correction ofcials Major Johnson Agbayani and Private First Class Lowela Alibania, gave us a tour of the facilities. I had some interesting observations. First stopthe mothers ward. It is a room of about ve or six single beds for the exclusive use of pregnant prisoners. Since no conjugal visitsactually, no male visitorsare allowed in the facility, all the women there conceived

while they were still outside. The mothers are assigned plastic dressers on which to put their grooming items. There are medical personnel on standby. The sheets over the mattresses contain drawings of cartoon characters. There are books and magazines to leaf through. Gina* is 34 and ve months heavy with her fourth child. Her three other kids are in the care of her mother. She is in prison for child abusea trumpedup charge, she insists, of her husbands mistress. This pregnancy is difcult because of the stress of my condition, Gina says. I think about my other children all the time. Gina can perhaps be consoled that she would be with her newborn a full year before she is supposed to turn the baby over to her mother, or other relatives. In a nearby section are the drug offenders. One of them, Karen,* is 30, mother of two and serving a life sentence for drug dealing. She has not seen her two children in seven years. Amelia*, with short silver hair, is eloquent, condent and knowledgeable.

A certied public accountant, she has been in jail for more than 20 years. She looks forward to being a free woman at the end of this year. Not far ahead is the school room with wooden desks, books, notebooks and other supplies. Teacher Guy, one of our guides, has been teaching here for three years. The Correctional is an accredited provider of Alternative Learning Program of the Department of Education. On the floor that day are five or six inmates engaged in beadworkkey chains, coin purses in the form of slippers, animals, even the Philippine ag. Further down, there is a library inmates can go to when they want to read or borrow books. There is an entire edition of the Encyclopedia Britannica, as well as computers for those who wish to be literate. While there is of course no Internet access, some inmates are allowed to use Skype, under supervision, to communicate with their loved ones. Outside the library is a salon. Trained inmates offer haircuts, manicures, pedicures, hot oil treatment, even massages at prices lower than what you

see on the streets. The next building is the livelihood center where inmates display their beadwork, bags, baskets, vases, articial plants. Some visitors admire the work so much they return to order in bulk. Prison guard Elsa says the prisoners are allowed to keep a maximum of P1,000 in their pockets. If they are able to save extra money, it is put in a trust fund which they can ask to be sent to their families. The inmates stay in double deckers, with mattresses and comfortablelooking sheets. The food budget is P50 per prisoner per day, covering three meals. This gives the inmates a diet of vegetables and occasional sh. Anything extra is brought to them by their families. I can imagine a more desolate life in urban slums. We end our tour in the administrative office. A maximum security inmate whom everybody calls Mommy and who can comfortably shit from English to Tagalog takes our picture. The New Bilibid Prison in Muntinlupa, for the male inmates, is

decidedly tougher to manage, says Agbayani. Of course, too, there have been recurring top-level scandals where ofcials are accused of special treatment of high-prole inmates or questionable spending of funds. Guard Elsa, for her part, says petty ghts usually about money and other personal issuesand attempts to escape are realities they have to deal with. But perhaps the best testament of how the womens prison lives up to its namecorrectionalis the sight of Teacher Guys two-year-old daughter Aya dancing and playing with the inmates. Employees are given the option to live within the correctional compound, and Guy has availed her family of this. Now Aya has an entire compound of doting surrogate aunts blurring the line between those inside and outside. This shows how having someone to love, something to do and something to look forward to enables convicted women to reform themselves and dream of the day they walk out of prison. [email protected]

Laguna de Bay shkill probed

THE Laguna Lake Development Authority said the recent sh kill in nine barangays in one city and three towns in Laguna and Rizal, as well as the repeated algal blooms, is a serious indication of the critical state of the lakes ecosystem.
We are concerned that the recurring shkill incidents could be a serious indication of the critical state of Laguna Lakes ecosystem, said LLDA general manager Neric Acosta, concurrent presidential adviser on environmental protection. Acosta said the agency and the Bureau of Fisheries and Aquatic Resources are coordinating with the governments of Jalajala town in Rizal, Pakil and Santa Cruz towns as well as Calamba City in Laguna to properly assess the extent of the shkill and to arrest its impact on livelihood, public health and food security. LLDA is sending monitoring teams to ensure food safety in the affected communities and the proper disposal of the dead sh, Acosta said even as he urged shpen operators not to overcrowd their pends to avoid further damage. especially the sherfolk of Laguna de Bay, that the Authority is doing all it can to mitigate the impact brought by the recently-discovered proliferation of knifesh in the lake. The recent eld surveys done by LLDA revealed the considerable presence of knifesh in Calamba City and in the lakeside towns of Los Baos, Bay, Victoria, Pila and Pangil, Laguna and the towns of Binangonan and Pililla in Rizal. In Santa Cruz river, a sherman doing hook-and-line shing was able to catch a knifesh which indicates that the sh can also swim upstream of the river. The newly-found knifesh in Laguna Lake is believed to be the Chitala ornata species. It was suspected that the knifesh found their way into the lake after escaping from ornamental sh farms or aquariums or by deliberate release by hobbyists who wanted to get rid of the sh. The appearance of the knifesh is distinct for of its silvergray color, a long knife-like body

with an anal n that looks like a knife. A mature knife sh normally have numerous black spots with white rings. It has two nasal tentacles above their large-toothed mouth and has a ag-like dorsal n. Its aesthetic similarity with the popular aquarium sh, arowana makes the knife sh a popular ornamental sh. BFAR shery ofcer Juanito Samson said the knifesh can be processed and turned into the locally popular street food shball which can be exported to other countries. As with the janitor sh, the knife sh is now being considered as a component of liquid fertilizer for soil applications. In general, sh emulsion is a natural, liquid fertilizer made from ground, dried sh pieces. Likewise, experts are looking into the potential of knife sh oil as an alternative bio-fuel. Acosta called for the cooperation of the shermen and shpen caretakers in the lake so that the knifesh can be utilized for its economic uses. LLDA is reaching out to ornamental sh farm owners and hobbyists to ensure necessary safeguards to prevent the escape of aquarium species towards the open lake. For the succeeding weeks, LLDA shall explore on the economic potentials of the knifesh which will not only address the issue of its unprecedented proliferation in the lake, but will also provide jobs for the people in the Laguna de Bay region.

Metro council approves stricter jaywalking rules

THE policy-making Metro Manila Council on Tuesday approved the amendment of its old anti-jaywalking ordinance and modied the denition of a jaywalking offense to include unsafe pedestrian practices that have become common in the metropolis. At its monthly session at the Manila Yacht Club, the council, which is comprised of all Metro Manila mayors, expanded the definition of a jaywalker as a pedestrian who shall leave a curb or other place of safety, and walk or run into a path of a vehicle which is so close that is impractical to yield. So now it not only means those who cross the wrong lane, those who stand in the middle of the road are also now considered jaywalkers, said assistant general manager for operations Emerson Carlos. The redenition of the offense settled legal issues that may confront law enforcers who are tasked to implement new jaywalking rules in the metropolis. The council also approved the proposal to impose a uniform ne of P200 for violation of the anti-jaywalking law and adopt a single pedestrian violation receipt all over the metropolis. Those who attended the council session were Mayors Alfredo Lim of Manila, Jaime Medina of Pateros, John Rey Tiangco of Navotas and Antonino Calixto of Pasay City; Vice Mayors Jose Fabian Cadiz of Marikina and Edgar Erice of Caloocan City. The high incidence of road mishaps involving pedestrians has alarmed the agency and prompted suggestions to change some provisions of the anti-jaywalking ordinance, Tolentino said. Citing data of the agencys Metro Manila Accident Report and Analysis System, Trafc Discipline Ofce director Yves Gonzales said 181 pedestrians were run over and killed in motorcycle-related accidents in 2011 while 552 others were injured. With the new ordinance, Quezon City will have to lower its anti-jaywalking ne of P500 for rst offense, P1,000 for second offense and P1,500 for third offense, Carlos noted. Caloocan City, which has a ne of P150, and Marikina and Mandaluyong, which both imposes a P100 ne, will have to increase their rates. Valenzuela City has not passed an antijaywalking measure, he told the council. The other cities Las Pinas, Makati, Malabon, Manila, Muntinlupa, Navotas, Paranaque, Pasay, Pasig, San Juan, Taguig and Pateros -- will have the same ne of P200, Gonzales said. In the same meeting, MMDA ofcials also offered at least six options to modify the regular truck ban. Chairman Francis Tolentino revealed six proposed modications amending the truck ban, following the success of the agencys temporary daytime truck ban enforced during the May 2-May 5 annual meeting of governors of the Asian Development Bank. Due to public clamor, we saw the need to introduce different modications of the truck ban in the metro, he said. The regular truck ban hours are from 6 a.m. to 9 a.m. and 5 p.m. to 9 p.m., except Sundays and holidays. Tolentino said the agency and 17 local governments of Metro Manila could adopt the ADB model of 4 a.m. to 9 p.m. without changing the existing truck ban routes. Secondly, we could modify the ADB model from 5 a.m. to 2 p.m. and 6 p.m. to 9 p.m. with window hours from 2 p.m. to 6 p.m. and 9 p.m. to 5 a.m. the following day, during which all trucks can ply all streets of Metro Manila, assistant general manager for operations Emerson Carlos said. Tolentinos third option is an absolute truck ban on the whole stretch of Edsa because of a high incidence of road mishaps involving trucks. The agency is also suggesting the enforcement of a total truck ban on Edsa between Balintawak, Quezon City and Magallanes Drive, Makati City from 4 a.m. to 9 p.m., except on Sundays and holidays.

Cops seize 35 kilos of shabu, but no suspect
A HOUSE which allegedly served as a shabu laboratory was raided by combined elements of the Philippine Drug Enforcement Agency and the Malabon City police Monday afternoon. Malabon city police commander Senior Supt. Ferdinand Ampil said the raid took place on a house at Araneta Avenue in Barangay Potrero around 3:30 p.m. and the lawmen found 35 kilos of suspected metampethamine hydrochloride, but no one was in the house, that is believed to be owned by a certain Vincent Go. American deported for drug charges in US


AN American wanted in his own country for possessing and selling heroin was expelled and banned from returning to the Philippines, according to the Bureau of Immigration. Alexander Theodore Bean, 25, left the Ninoy Aquino International Airport aboard a Philippine Airlines ight to Los Angeles, California after he was deported barely four days after his arrest in Cabangan, Zambales by operatives of the bureaus fugitive search unit. The arresting agents said the American was in the company of his Filipina girlfriend when he was served with a warrant of deportation. QC councilors propose arming village watchmen


TWO Quezon City councilors have proposed arming barangay watchmen with guns to enable them protect themselves while in the performance of their duty, but other city ofcials dismissed the proposal as a bad idea. Councilors Ranulfo Ludovica of District 2 and Alexis Herrera of District 1 made the proposal after three barangay public safety ofcers of Barangay Damayang LagiJerry Cervantes, 52, Alberto Olalia, 32, and Rafael Calderon were arrested for illegal possession of rearms. The three watchmen responded to a brawl in Barangay Damayang Lagi, but ended up getting arrested by elements of the Quezon City Police District-Station 11 for illegally carrying guns. Rio N. Araja

LAWMEN arrested three agents of the Philippine Drug Enforcement Agency, based at the airport Ninoy Aquino International Airport, for shooting a teenaged boy in Taguig City on Monday night. Police identied the three PDEA agents as K9 handler Joseph Quitiquit, animal keeper Rico Canete and administrative aide Julius Blas Sancho. The authorities said the victim, whose identity was withheld because he is a minor, was walking with his girlfriend near the property of the Armed Forces of The Philippines Ofcers Village Association at Fort Bonifacio when they were accosted by the three PDEA agents. The victims girlfriend, who identity will also be withheld because she is a minor, accused them of being thieves. She said they tried to run away from the three men because they were both scared. ASPIRANTS in the dragonboat and canoe-kayak competitions have breached the 700 mark, easily the biggest turnout among 38 national sports associations participating in the ongoing second Philippine Olympic Committee-Philippine Sports Commission National Games. Lenlen Escolante, national coach of the Philippine Canoe Kayak Federation Inc. , said the most competitive dragonboat teams and the top canoe-kayak paddlers have signed up for the competitions that are scheduled this Friday up to Sunday at Lake Caliraya in Laguna. Moodys raises PH outlook to positive


MOODYS Investors Service on Tuesday raised the outlook on the Philippines sovereign rating from stable to positive, signaling an imminent upgrade of the actual credit rating which affects interest rates on foreign loans. This is one more step in our march towards investment grade, towards reducing the gap between the market rating and the credit rating, and more importantly towards a more sustainable growth path, said Finance Secretary Cesar Purisima. The outlook on the long-term foreign-currency Ba2 rating is now positive from stable, Moodys said. The Ba2 rating is two levels below investment grade. Moodys Investors Service Singapore Pte. Ltd. assistant vice president and analyst Christian de Guzman said the rating outlook was upgraded because of expectation of continued trend of scal and debt consolidation and the enhanced nance-ability of government debt. The government of the Philippines has continued to demonstrate prudence in its scal management, as characterized by low budget decits relative to its rating peers and a steadily declining level of debt relative to gross domestic product, said De Guzman. The Philippine government is on the right track and we have seen strength in investment, said Tetsuo Yoshikoshi, a senior economist at Sumitomo Mitsui Banking Corp. in Singapore. However, even with domestic factors in the Philippines more favorable than before, in this climate, Moodys may wait and see the fallout from the European crisis before upgrading the sovereign rating. Mendoza says PNB merger to proceed


THE merger of Philippine National Bank and Allied Banking Corp. will be completed within the year in the absence of legal impediments, bank counsel Estelito Mendoza said. Allied Bank shares previously sequestered by PCGG were already nullied by a nal and executory decision of the Supreme Court dated December 7, 2007, said the two banks in their joint answer to the PCGG. The shares of Allied Bank were a result of the acquisition by the Lucio Tan Group of the assets of then Genbank. The Sandiganbayan said the liabilities, obligations and action against merged corporations such as Allied Bank were not erased, citing the Corporation Code. It stressed that the shares of stock were quantiable and that there was no reason to fear they would be lost or disappear in the merging process. The merger of the two banks is seen to enhance shareholder value and make the merged entity the fourth-largest bank in the country. SM to issue P7.5-b notes


SHOPPING mall operator SM Prime Holdings Inc. has signed a P7.5-billion notes facility agreement to help fund capital expenditures and renance current debts. SM Prime said in a disclosure to the stock exchange the debt facility would consist of ve- and 10-year oating rate notes and veand 10-year xed rate notes. The notes facility will be used by SM Prime for the renancing of existing obligations to partially fund capital expenditures and/or other general corporate requirements, it said. Security Bank forms thrift banking unit

SECURITY Bank Corp. said Tuesday it will transform the Premiere Development Bank, which it acquired in June last year, into its thrift banking unit. Security Bank president Albertos Villarosa told reporters at the sidelines of the banks annual stockholders meeting Premiere Development Bank would be renamed Security Bank Savings, pending approval from the Securities and Exchange Commission. Security Bank bought Premiere Bank in June last year for P1.3 billion, through transfer of voting shares equivalent to 96.42 percent of the outstanding capital stock of the selling bank. The Bangko Sentral approved the transaction in January this year. Villarosa said that as a thrift bank, Security Bank Savings would be involved in consumer nance and would cater to small and medium enterprises. SBC is focused on the corporate and on the middle market. Thats precisely the reason why we bought Premiere Bank for it to become the vehicle to carry out consumer nance, he said. The request was P70 million, but Malacaang is considering to release an initial P50 million, a well-placed sourced at the department said. Monday, the eighth day of November, 1965. In rounded terms, the mandated rate under Macapagals executive order which took effect right smack into the middle of the decade of the 60s was 4:1, not 6:1 as Renato Corona asserted. This rate was attested to by two decisions of the Supreme Court. On June 23, 1988, the court decided the case of N.V. Reederij Amsterdam and Royal Interocean Lines v. Commissioner of Internal Revenue, G.R. L-46029. The second of two issues in that case was at what rate, for purposes of determining the income tax liability of the taxpayers, the foreign exchange receipts were to be converted. Was it 2:1 or 3.90:1? The shipping vessel Amsterdam was not doing business in the Philippines; it made only two calls on Philippine ports, one in 1963 and the other in 1964. As foreign corporation not doing business in the Philippines, it was liable to income tax on a percentage of its gross income earned in the Philippines. Its income was in US dollars; hence, the initial issue of what rate of exchange to then apply on its gross income in foreign currency for purposes of calculating its income tax liability which was to be paid in Philippine pesos. The Supreme Court held: The conversion rate of P2:US$1 which petitioners claim to be applicable to the income of petitioners for income tax purposes is likewise not tenable. The transactions involved in this case were for taxable years 1963 and 1964. Under Republic Act No. 2609, the Monetary Board was authorized to x the conversion rate for foreign exchange. The free market conversion rate for those years were P3.90: US$1. The Supreme Court also reiterated its ruling in a previous case: This conversion rate was denitely settled by this Court in the case of Commissioner of Internal Revenue v. Royal Interocean Lines and Court of Tax Appeals (G.R. No. L-26806, July 30, 1970; 34 SCRA 9). What prompted Renato Corona to weave his unhistorical narration in order to justify the extent of his foreign exchange holdings that were not reported in his SALN will most likely remain a mystery for sometime, unless he, at one point decides to make a clean breast of everything. In his private life, he worked in a commercial bank as well as in an accounting rm. He must have known that his allegations by way of justication were easily veriable and, if found inaccurate, denitively exposed to be erroneous. BY the time this column sees the light of day, the dark night of the impeachment trial shall have been over. And while the process we have gone through, particularly its twists and turns, is, in senses more than one, sui generis, some subjects that were highlighted during the hearings remain to be of general interest, if not of concern. These are the subjects that somehow or another affect us personally; among them is the matter of foreign currency bank deposits. Renato Corona, on the witness stand last May 22, asserted that the foreign exchange rate between the Philippine peso and the US dollar at the time, he, during the late 60s, started investing his funds in the latter currency was only 2:1. Asked to be more precise, he responded by recalling that up to 1969, the exchange rate was still at 2:1 and that it went up to 6:1 when it was allegedly devalued to oating rate in January 1970. It could be that his hypoglycemia, which was subsequently invoked as the explanation for his unceremonious walk-out at the end of his opening statement, had started to creep on him by the time he reached this portion of his testimony; his history of our foreign currency exchange rate was terribly inaccurate. Either that, or he was deliberately misleading the senator-judges. The exchange rate of 2:1, or two Philippine pesos for one US dollar, was actually mandated by Commonwealth Act No. 699. Under Section 6 of said law, the par value of the Philippine peso was to be represented ofcially as no other than onehalf of a United States dollar of the weight and neness in effect on January 1, 1944. This rate of exchange was maintained even after the passage in 1948 of the Central Bank Act (RA No. 265). It remained at this legislated level until 1965. On November 6 of that year, Executive Order No. 195 was issued. The Bids and Awards Committee (BAC) of the DPWH-Albay 1st Engineering District Airport Site, through the (Fund Source of the Year) invites contractors to bid for the aforementioned projects: #12-F-A-0022 Completion of Multi-Purpose Bldg. (Multi-Storey City Hall Annex) Phase III Contract Location Tabaco City Scope of Work Const. of 5-Storey Bldg. (Phase III) From 4rth Flr. To Roof Deck Level (Structure) From Ground Floor to Roof Deck Level(Masonry Works, Electrical, Mechanical & Water Proofing Works) Approved Budget for the P48,499,729.91 Contract (ABC) Contract Duration/CD 300 CD Cost of Tender Documents P20,000.00 The BAC will conduct the procurement process in accordance with the Revised IRR of RA 9184. Bids received in excess of the ABC shall be automatically rejected at the opening of bid. To bid for this contract, a contractor must submit a Letter of Intent (LOI), purchase bid documents and must meet the following major criteria: (a) prior registration with the DPWH, (b) Filipino Citizen or a 75% Filipino-owned partnership, corporation, cooperative, or joint venture, (c) with PCAB License applicable to the type and cost of this contract and with Special License for Electrical, Mechanical, Plumbing & Sanitary Works , (d) completion of a similar contract costing at least 50% of ABC within a period of 10 years, and (e) Net Financial Contracting capacity at least equal to ABC, or a credit line Commitment at least equal to 10& of ABC. The BAC will use non-discretionary pass/fail criteria in the eligibility check and preliminary examinations of bids. Unregistered contractors, however, shall submit their applications for registration at the DPWH- Central Procurement Office (CPO) before the deadline for the receipt of LOI. The DPWH- -Central Procurement Office (CPO) will only process contractors applications for registration, with complete requirements and issue the Contractors Certificate of Registration (CRC). Registration Forms may be downloaded at the DPWH website www.dpwh.gov.ph. Leonard Mayaen and the Cordillera ofce of the Department of Social Welfare and Development are hiring 546 students, out-of-school youth, and college graduates under the Government Internship Program. Leonardo Reynoso, regional director, said 60 each came from the municipalities of Bauko, Besao, Bontoc and Sabangan; 55 from Natonin; 54 from Tadian; 50 each from Paracelis and Sadanga; 49 from Sagada; and 48 from Barlig. The interns are deployed in their respective municipalities so that they will be able to serve their people through the program, Mayaen told Manila Standard, adding that they will receive P272 stipend a day for 52 days. According to him, the new hires will assist in implementing the Pantawid Pamilyang Pilipino Program, Social Pension Program for indigent senior citizens, Supplementary Feeding Program among other activities in Sabangan and Sagada towns. They also help in clerical work in the different municipal social welfare and development ofces, especially in facilitating the documentation of the various programs and projects of the agency and the local governments concerned, Reynoso said. In Sabangan, Brigida Mangayat, municipal social welfare ofcer, said interns would be assigned in the Core Shelter Assistance Program for health care and environment projects. She said female interns would help in propagating seedlings in community nurseries and in doing a survey of conditional cash beneficiaries on how the program improved their lives.

Joey Salceda said the governments Pantawid Pamilyang Pilipino Program will increase the number of beneciaries in the province to 60,260 families by midyear, welcoming an infusion of P1 billion to the local economy in the next ve years. It will certainly help the province in sustaining its early achievement of the Millennium Development Goals in participation rates in basic education, low maternal mortality, infant mortality and child mortality, he said, citing the need to improve income distribution in the countryside and help lift 60,000 of the 76,000 poor households in the province from survival to subsistence, and boost further Albays disaster resilience, as it helps poor families to respond to risks. It gave us a beautiful perspective of the colorful city at night, while sailing under the three bridges that connect the Macau Peninsula to Taipa which, in turn, is connected to the island of Coloane through the landll popularly know as the Cotai Strip, the entertainment center of the city. The next couple of days brought us to more of the interesting and awe-inspiring destinations the city boasts of, while giving us the opportunity to gorge on the sumptuous Macanese cuisine. This Macau trip could easily be characterized by the phrase, a lot ofwalking, eating and non-stop laughter! Our group was such a fun mix of diverse personalities, I wouldnt have wanted it any other way! There was Roel Supendio, whose funny one-liners never failed to evoke ts of laughter from all of us. The highly energized Dominican sisters Ma. Cecilia Tio Cuison and Cristina Cabral, never seemed to run out of steam; their hilarious antics literally rocked even our tour bus! Runo Oliva easily became the darling of the group as he presented himself to be our ofcial photographer. Alida Hernandez, nicknamed Happy, was the baby of the group; she with her diminutive smile, always evoked the motherly instincts of our nurturing Tour Escort, Jet Cabuslay. Carolina Roces was very comprehensive in her compilation of our Tours documentary evidence that she even took photos of all the street posts we passed by. Merle San

Pedro, Lilibeth Sabillano and Rosel Corazon Fonacier didnt want to be outdone, as they made sure they had photo ops at every single nook and cranny of the colorful city, keeping Facebook busier than ever! There was also Josephine Mendoza, who, as she reminisced on her college life, could easily recall all the details of her classmates various romantic liaisons, validating her photographic memory to all and sundry! If she were on a sightseeing tour here in the country, Cecilia Uncad would be an easy target for kidnapfor-ransom gangs, as she was always decked with endless strands of beautiful pearls. She had them on all the time, I was beginning to suspect she also wears them even while taking a bath, and when going to bed! Our tour ended with most of us worried about excess baggage charges, as each one tried to bring home a sample of what Macau offers its visitors and this city, now Asias most exciting destination, has lots of it. As I mentioned at the beginning of this piece, regardless of how many times I have visited the city, I always discover new places to see and my stay never seems long enough. This trip is no exception. In the typical Philippine system of education, one teacher is assigned to a class of 40 to 50 students. Only the brightest and most talented students are recognized in this kind of setting. Those who have mediocre performance in school are often neglected and their progress, or lack thereof, is often overlooked. These students then lose self-esteem and fall behind their peers. In Tutoring Club, unlike other tutorial centers, the core skills in learning such as reading, writing and mathematical abilities will be prioritized rather than the present problem at hand. This individual-based and skill-based system addresses not only the skill gaps of a child, but it also makes the child to be independent from supplementary help they get from tutors. Warning: Facebook can ruin your career

ITS been said many times: be careful how you use social media because certain posts can be incriminating. A lot of experts claim that prospective employers look at your Facebook profile to decide whether to hire you or not, and current employees can get fired based on inappropriate posts. But what exactly is inappropriate? Are we supposed to censor ourselves to the point that our social networking pages aren't reflective of our true selves anymore? A recent study conducted by CareerBuilder.com found that 37 percent of companies use social networks to research potential job candidates. Out of them, 49 percent consider provocative photos a cause for concern. Meanwhile, drug use and drinking are two activities that 45 percent of employers do not appreciate. Some of them (35 percent) also assess a candidate's communication skills by reading text posts. Also, discriminatory comments about other people and lying about qualications are frowned upon by 28 percent and 22 percent of employers respectively. It is also worthy of note that 65 percent of the employers surveyed look for red flags on Facebook while only 16 percent check Twitter. They do this for a number of reasons: to determine if the candidate has the appropriate professional demeanor on social media (65 percent), to see if the candidate can be a good fit for their workplace culture (51 percent), to verify the candidate's qualifications (45 percent) and to see how well-rounded the candidate is (35). And interestingly, a few hiring managers (12 percent) are simply looking for reasons not to hire the candidate. The moral of the story is that social media is not a private place. Regardless of your privacy settings, unflattering tidbits about you can reach your current and/or future boss if such things are posted online, either by you or by somebody else. So it's not really about self-censorship. It's really about abiding by society rules of politeness and decency. Your social networking pages should be reflective of the best version of yourself. Simple as that.

ROBIN Lim, the 2011 CNN Hero of the Year, recently held a book signing reception for her 2009 novel, Buttery People at The Podium. Published by Anvil Publishing, Buttery People is a ctional tribute to six generations of Robins Filipino family from Baguio, where she grew up and where much of this work of magic realism takes place. Her grandmother, Vicenta Munar Lim, was a legendary hilot who greatly influenced her Filipino-American granddaughters views on medicine and midwifery. In 1992, her younger sister Catherine died due to complications from her third pregnancy. When Robin saw that even more technologies could not save her beloved sister, she decided to become a midwife.

Her story and journey in a book


Robin then moved to Bali, took the North American Registry of Midwives Exam and became a certied professional midwife. She started providing free health services for pregnant women in Bali in 1994. Mother Robin or Ibu Robin as she is fondly called founded the Yayasan Bumi Sehat (Healthy Mother Earth Foundation) health clinics in Indonesia in 2003 that give free birthing services to everyone who needs it. She has helped thousands of women give birth in Aceh after the 2004 Indian Ocean tsunami; as well as in earthquake struck areas in Yogyakarta in 2006, Padang in 2009, and Haiti in 2010. Robin is the second Filipino to be awarded CNN Hero of the Year

HAVE you discovered what a hero your child can be in his own small way? Children who have been nurtured with the right values and live within an inspiring environment start showing signs of amazing heroism even at an early age. Since the biblical times, we have been told of stories of how a kids small deed have changed lives and situations signicantly. Tang believes in this. It celebrates the greatness of kids. A former street beggar and labor-exploited child, young Kesz Valdes began teaching other kids personal hygiene through demonstrations at the tender age of six. A year later, with no consideration of a reward, Kesz began to volunteer by giving out slippers and books to street children and scavengers roaming the streets. Raynold dela Cruz, a My Rights volunteer, is an active advocate for childrens rights and was recognized with a Good-Deeder Award and a Young Mandela title in 2010 by the South African Embassy and the Dynamic Teen Company during Nelson Mandela Day. He is now a trainee in the Dynamic Teen Company with a project he recently launched called Saving Kids with First Aid Kits, which aims to provide rst aid kits to public school clinics, while also raising funds by selling ice candy made with Tang. U Maalam and Trubador Wisely used their creative skills in creating an illustrated comic collection aimed at uplifting the lives of others. After class, they both try to sell the comics at a higher cost to rich executives, lowering publication costs so they could sell the comics to the masses at a much lower price. Love for God is epitomized in young Padre Pio devotee Angela Seraco who spends her time helping less fortunate children. The multifaceted young artist is a violinist, writer, public speaker, and painter. Young Martha Balagat, in her rst grade, created and illustrated her own book and is a contributor to the Junior Inquirer where several of her pieces were featured. On top of that, she teaches Catechism every Saturday with her mother, at their parish where she reads to underprivileged children and creates visual aids for her classes with them. Last, but not least, Dannah Suaze, a Laguna Council Representative, inspires less fortunate children to be responsible citizens by teaching Catechism and reading. She does all this through her active participation in Barangay, Church, and Girl Scout Programs. Sometimes the best gift we can receive from our children is not what they give us, but what they want to give to the world.
