Legal Officer: This honorable and highest court of the republic of the Philippines with Honorable
Judge Delvin Bautista is now in session. All rise.
Judge: The court is now in session. You may now be seated. Call the cases.
Legal Officer: Criminal case no. 2025-0016: People of the Philippines vs Caven Marquez and Vinci
Ferrer. For Rape Article 266-A of the Revised Penal Code, violations off Republic act 9165
Dangerous Drugs Act.
Prosecutor Vergara: Atty. Siena Vergara appears as a prosecutor under the direct control and
supervision of the public prosecutor, Your Honor.
Judge: Is the accused around?
Legal Officer: Yes your honor.
Judge: Do you have a lawyer or do you want the court to appoint you a lawyer?
Caven: We have a lawyer, your honor.
Scene 2
Judge: Is the prosecution ready?
Legal officer: Yes your honor
Prosecutor Vergara: Atty. Siena Vergara appears as a prosecutor under the direct control and
supervision of the public prosecutor, Your Honor.
Judge: We will now hear the opening statements from the prosecution. Prosecutor Vergara, please
state the case.
Prosecutor Vergara: As you have heard, the defendants have been charged with the crime. Your
Honor, Vienna Del Valle was drugged and raped. The evidence is strong. Vinci Ferrer gave her the
drink, and Caven Marquez took advantage of her when she couldn’t fight back. This is not love. This
is a crime. Being drunk or unconscious is not consent. A past relationship does not mean
permission. We ask the court to give justice to Vienna and hold both accused responsible. That is
what the law demands. Thank you.
Scene 3
Judge: Defendants of the victim, identify yourself.
Atty. Cuevas: Your Honor, Atty. Neriah Cuevas, private counsel for complainant, Ms. Vienna Del
Valle.
Judge: Proceed with the witness testimony.
Legal officer: Do you solemnly swear to tell the truth?
Vienna: I do
Atty. Cuevas: Vienna, tell the court what happened of the night of April 8
Vienna: I was at a private party gathering. Vinci Ferrer handed me a drink that night. I trusted him,
because he was my friend. After a few sips, I felt Lightheaded, then nothing. I got unconscious. I
woke up the next morning, in a random room, with bruises and no memory from last night. Caven…
My ex was beside me. He smirked. I knew something horrible had happened.
Atty. Cuevas: Did you gave consent, Ms. Del Valle?
Vienna: No. As i've said, I was unconscious. I couldn’t move, speak or…. Scream. (paiyak na)
Scene 4 Cross-examination
Atty. Velazquez: Ms. Del Valle, is it not true taht you were previously in a relationship with Mr.
Marquez?
Vienna: Yes, but that ended months ago.
Atty. Velasquez: So you were once intimate with him?
Vienna: Yes, but that doesn’t mean he had the right to rae me that night!
Scene 5
Judge: Defendants of the accused, identify yourself.
Atty. Velasquez: Your Honor, I am Atty. Laura Velazquez for the accused, Caven Marquez and Vinci
Ferrer.
Atty. Velazquez: Mr. Marquez, did you force Ms. Vienna Del Valle to do anything against her will?
Caven: No, You’re Honor. We were in a relationship before. That night, she never said no.
Atty. Cuevas: She was unconscious. How can she consent?
Caven: She was just tipsy, not unconscious. She didn’t resist. I thought she wanted it too.
Atty. Cuevas: Your Honor, the victim was under the influence of benzodiazepines, a drug that can
make you unconcious. Consent cannot be given in that state.
Caven: I didn’t know she was drugged! That’s on Vinci, not me!
Scene 6
Atty Cuevas: Your Honor, I would like to request for your permission to call our witness
Judge: Permission granted. Call your next witness.
Atty. Cuevas: The prosecution calls Ms. Lyra Reyes to the stand.
Legal Officer: Do you solemnly swear to tell the truth, the whole truth, and nothing but the truth?
Lyra: I do.
Atty. Cuevas: Ms. Reyes, were you present at the gathering on April 8?
Lyra: Yes. I was with Vienna. We were supposed to just hang out, but things changed quickly.
Atty. Cuevas: Please explain what you saw.
Lyra: Vinci Ferrer handed Vienna a drink. I noticed he was watching her. Minutes later, she started
to look dizzy, mumbling words. Caven led her to one of the rooms. She wasn’t able to walk
properly.
Atty. Cuevas: Did Vienna seem aware or capable of consenting?
Lyra: No. She could barely keep her eyes open. I wanted to stop them—but I was scared.
Atty. Velasquez: Ms. Reyes, you said you were scared. Why didn’t you call the police?
Lyra: Because I knew no one would believe me over them. They had money. Power. Reputation. But
I’m here now, because Vienna deserves to be heard.
Scene 7 Cross examination
Atty. Velazquez (jew): Mr. Ferrer, did you put anything in Vienna’s drink?
Vinci (nei): No. She was already drinking when I got there. I only gave her a regular drink—same as
everyone else.
Prosecutor Vergara (jei): So how do you explain the lab tests showing high levels of
benzodiazepine?
Vinci (neil): I don’t know. Maybe someone else did it. Or maybe she took something on her own.
She looked fine to me.
Atty. Cuevas (thea): But Ms. Lyra Reyes testified that you were watching Vienna closely after
handing her the drink.
Vinci (Neil): People exaggerate. That doesn’t prove anything!
SILENCEEEEEEEEEE
Judge (Jorge): After careful deliberation of the testimonies and evidence presented, this court finds
both accused, Caven Marquez and Vinci Ferrer, guilty beyond reasonable doubt of the charges of
rape and violation of RA 9165. They are hereby sentenced to reclusion Perpetua for the crime of
rape, and life imprisonment for the violation of the Dangerous Drugs Act. This court commends the
bravery of the victim, Ms. Vienna Del Valle, and the witness, Ms. Lyra Reyes. May this judgment
serve not only as justice for the victim, but as a reminder that silence will no longer protect the
guilty. Court is adjourned.
