DEED OF ABSOLUTE SALE


OF A CONDOMINIUM UNIT
KNOW ALL MEN BY THESE PRESENTS:

This DEED, made and executed in Bacolod City, Philippines, by and between:

JANNIE LIZ ELEVADO, married to, of legal age, Filipino,


married to JOHN ERIC ELEVADO, all residents of Unit 829,
Amaia STEPS Capitol, Bacolod City, Philippines, and hereinafter
referred to as the VENDOR.

-and-

GINA GARCIA ARANETA, Filipino, of legal age, and married to


VAL GAN ARANETA and residents of Block 2, Lot 14,
Rivergrand Subdivision, Camella Avenue, Upper Balulang,
Cagayan De Oro City, and forming part hereof, hereinafter
referred to as the VENDEE.

WITNESSETH:

WHEREAS, the VENDOR is a buyer of a condominium unit known as


UNIT 829, 8th Floor of AMAIA STEPS, CAPITOL CENTRAL NORTH BUILDING,
Bacolod City, Negros Occidental, with an area of 26.01 square meters more
or less.

WHEREAS, the VENDOR agreed to sell the aforementioned


condominium unit together with all the improvements and furnishings found
thereon, including her rights and interests thereof in favor of the VENDEE
and the VENDEE is willing to buy the same subject to certain terms and
conditions mutually acceptable to the parties;

WHEREAS, the VENDOR, secured a loan from the BDO to finance the
purchase of the subject condominium unit wherein there is still an
outstanding loan in the amount of P 1,840,000.00 as of January 2, 2020;

NOW, THEREFORE, for and in consideration of the sum of TWO


MILLION FIVE HUNDRED FIFTY THOUSAND PESOS (P2,550,000.00) in
Philippine currency, the VENDOR does hereby sell, transfer and convey, in a
manner absolute and irrevocable, unto the VENDEE, who acknowledges
receipt thereof, her heirs and assigns, the condominium unit above
described together with all the improvements existing thereon, free and
clear from all liens and encumbrances;

Capital Gains Tax shall be shouldered by the VENDOR while


Documentary Stamp Tax and Transfer taxes shall be to the VENDEE’s
account.

Registration Fee and expenses and all other miscellaneous fees and
expenses in connection with the transfer of title shall be for the account of
the VENDEE;

The VENDOR undertakes warranty against eviction and adverse claims


by third parties;
