26 – Qualifications of inspectors

▪ No person shall be appointed as Chief Inspector or


Inspector unless he holds a degree in mining
engineering of an educational institution approved by
the Central Government and also a First Class
Manager’s Certificate granted under regulation 11.
27 – Qualifications and appointment of manager
▪ No mine shall be opened worked or reopened unless there is manager of the
mine being a person duly appointed and having such qualifications as required
under this regulation.
▪ No person shall act or be employed as a manager unless he has attained 23 years
of age.
▪ For belowground mines:-
 In excess of 2,500 tonnes per month – A First Class Manager’s Certificate not restricted to
opencast mines only
 Not exceeding 2,500 tonnes per month – A First Class Manager’s Certificate or Second
Class Manager’s Certificate not restricted to opencast mines only.
▪ For opencast mines:-
 In excess of 20,000 m³ per month of material handled – A First Class Manager’s Certificate.
 Not exceeding 20,000 m³ material handled per month – A First Class Manager’s Certificate
or Second Class Manager’s Certificate.

▪ A mine having both opencast and underground workings a person holding First Class Manager’s
Certificate not restricted to opencast mines shall only be appointed as the manager of the mine
irrespective of production.
▪ A person with lower qualifications shall not except with the previous permission in writing of the
Chief Inspector be so appointed during the succeeding 12 months.
▪ No person shall act or be appointed as manager of more than one mine except with the previous
permission in writing of the Chief Inspector. No such permission shall have effect for a period
exceeding 12 months unless renewed.
▪ If manager is unable to perform his duties due to certain reasons, the owner, agent or manager
shall authorise a person in writing whom they consider competent to act as manager and no such
authorisation shall have effect for a period in excess of 30 days. Provided that the Chief Inspector
shall not permit any such authorisation for a period exceeding 60 days.
▪ No manager shall vacate his office without giving due notice in writing to the owner or agent at
least 30 days before the day on which he wishes to vacate his office.
▪ The owner or agent shall provide suitable residential accommodation for the manager and the
assistant manager within a distance of 5 km from all mine openings.
28 – Charge report of managers

▪ When there is a change of manager of any mine, the


outgoing manager shall hand over to the incoming
manager, a charge report in a format as may be
specified by the Chief Inspector, by a general or special
order and the charge report shall be signed by both
the outgoing and incoming managers and a copy of
the charge report shall be sent to the Regional
Inspector.
29 – Qualification and appointment of safety officer
▪ In every belowground mine the average monthly output of which exceeds 5000 tonnes or
in every opencast mine the average monthly material handled of which exceeds 20000
m³ the manager shall be assisted in the work of promoting safe practices in the mine by a
safety officer who shall be a person holding the following qualifications:-
 In case of a belowground mine having an average monthly output in excess of 15000 tonnes a First
Class Manager’s certificate not restricted to opencast mines only.
 In case of a mine having opencast working with an average monthly material handled in excess of
50000 m³ a First Class Manager’s Certificate.
 In case of a belowground mine having an average monthly output in excess of 10000 tonnes but not
exceeding 15000 tonnes a First Class Manager’s Certificate or Second Class Manager’s Certificate not
restricted to opencast mines only.
 In case of a mine with opencast workings having average monthly material handled in excess of
20000 m³ but not exceeding 50000 m³ a First Class Manager’s Certificate or Second Class Manager’s
Certificate.
 In the case of a belowground mine having an average monthly output in excess of 5000 tonnes but
not exceeding 10000 tonnes holder of a First Class Manager’s Certificate or Second Class Manager’s
Certificate not restricted to opencast mines only or a degree or diploma in Mining or Mining
Engineering.
30 – Appointment of assistant manager

▪ In every mine the manager shall be assisted by


assistant managers on the scale as may be specified by
the Board.
▪ Provided that in specific cases the Chief Inspector may
relax the requirement of the appointment of assistant
manager.
31 – Qualification and appointment of ventilation
officer

▪ In every belowground mine consisting of gassy seams of first degree, the average
output of which exceeds 5000 tonnes or of second or third degree the average output
of which exceeds 2500 tonnes the manager shall be assisted in the work of supervision
the maintenance of ventilation system of the mine in accordance with the provisions
of these regulations by the ventilation officer who shall be a person holding:-
 In case of mine consisting of gassy seams of first degree and having an average output in excess of
15000 tonnes or a mine consisting of gassy seams of second or third degree and having an average
output in excess of 10000 tonnes a Manager’s Certificate not restricted to opencast mines only.
 A Manager’s Certificate not restricted to opencast mines only or a Degree or Diploma in Mining or
Mining Engineering recognised by the Central Government.
▪ In case of a mine consisting of gassy seams of first degree and having an average
output of less than 15000 tonnes the Chief Inspector may combine the post of
ventilation officer with that of safety officer appointed under regulation 29.
32 – Appointment of engineers

▪ At every mine where machinery is used an engineer holding a degree or


diploma in mechanical engineering, electrical engineering, mining machinery
shall be appointed to hold general charge of such machinery and to be
responsible for its installation, maintenance and safe working who shall be
subordinate to manager.
▪ Where electrical energy exceeding 650 volts is used and the installed capacity
of all electrical equipment is 1.5MVA and above an engineer holding a degree
or diploma in electrical engineering or equivalent qualification as may be
recognised by the Central Government shall be appointed.
▪ In mines worked by HEMM or mechanised mines having belowground
workings in which aggregate HP of all machinery used exceeds 1500 a
mechanical engineer shall be appointed.
33 – Appointment and qualifications of senior officials

▪ At every mine, one or more overman shall be appointed to


hold charge of the different districts of the mine on each
working shift unless otherwise specified by the Regional
Inspector.
▪ The districts assigned to an overman shall not be of such a
size not shall any additional duties other than his duties
under these regulations be such as are likely to prevent
him from carrying out in a thorough manner the duties
assigned to under these regulations
34 – Appointment of surveyors

▪ At every mine one or more persons holding a


surveyor’s Certificate shall be appointed to be the
surveyors for carrying out the surveys and levelling's
and for preparing the plans and sections required.
▪ No person shall appointed as a surveyor of more than
one mine.
35 – Appointment of officials and competent persons

▪ The owner, agent or manager shall appoint such number of


competent persons including officials and technicians as is
sufficient to secure, during each of the working shifts for
inspection of the mine and equipment, supervision of
operations in the mine, installation, running and maintenance
in safe working order or machinery in the mine.
▪ It shall be the responsibility of the manager to see that the
persons so appointed are competent to perform the duties
assigned to them.
36 – General management

▪ The owner, agent and manager shall provide for the safety
and proper discipline of persons employed in the mine.
▪ Except in a case of emergency no person who is not an
official or competent person shall give, otherwise than
through the manager instructions to a person employed in
a mine who is responsible to the manager.
