1. OPERATIONS OF NATIONAL BUREAU OF INVESTIGATION


Powers and Functions.— The NBI shall have the following powers and functions:
a. Undertake investigation and detection of crimes and offenses enumerated under Section 5
hereof;
b. Issue subpoena for the appearance of any person for investigation or production of
documents, through its officers from the ranks of Regional Director to Director;
c. Act as a national clearing house of criminal records and other related information for the
benefit of the government;
d. Render technical assistance to government agencies and instrumentalities, when so
requested;
e. Extend assistance in cases involving extradition and mutual legal assistance, when
requested by the Department of Justice;
f. Establish an NBI Academy which shall be responsible for the recruitment, training, and
development of all NBI agents and personnel, among others;
g. Establish and maintain a Forensic and Scientific Research Center which shall serve as the
primary center for forensic and scientific research in furtherance of scientific knowledge
in criminal investigation, detection, evidence collection and preservation, and provide the
necessary training therefor;
h. Establish and maintain a Cyber Investigation and Assessment Center which shall serve as
the nerve center for computer information technologies, data on cybercrime cases,
computer intrusion, threats, and other related crimes or activities;
i. Establish and maintain an integrated, comprehensive, and state-of-the-art network of
equipment and facilities to be used by the NBI in its criminal investigation, detection, and
evidence gathering, and to provide the corresponding training in this regard;
j. Request the assistance of the Philippine National Police (PNP), Armed Forces of the
Philippines, or any other agency of the government, including government-owned and/or
-controlled corporations, in its anti-crime drive. Such assistance may include the use of
the agency’s personnel and facilities upon prior approval by the head of the agency
concerned;
k. Conduct intelligence operations in furtherance of the foregoing powers and functions;
l. Enter into any contract or transaction for the acquisition, ownership, possession,
administration, lease, disposition or acceptance of real or personal property in its name,
subject to the approval of the Secretary of Justice;
m. Establish a modern NBI Clearance and Identification Center containing all derogatory
and criminal records and civilian identification records, including their identifying marks
and characteristics and fingerprint database, as well as dental records pursuant to
Presidential Decree No. 1575, entitled “Requiring Practitioners of Dentistry to Keep
Records of Their Patients”;
n. Maintain, for purposes of investigative and forensic requirements of the NBI, relevant
database such as ballistic records of firearms including, but not limited to, data
ownership, possession, and other related identifying circumstances; and
Deoxyribonucleic Acid (DNA) databank; and
o. Perform such other functions as the President or the Secretary of Justice may assign.
 The National Bureau of Investigation (Filipino: Pambansang Kawanihan ng
Pagsisiyasat, abbreviated as NBI) is an agency of the Philippine government
under the Department of Justice, responsible for handling and solving major high-
profile cases that are in the interest of the nation.
 The Division of Investigation, later renamed the National Bureau of Investigation,
came into existence on June 19, 1947, the date Republic Act No. 157 was
approved.
2. OPERATION OF BUREAU OF JAIL MANAGEMENT AND PENOLOGY

 Operational and Administrative Control: The BJMP is responsible for the operational
and administrative control of all city, district, and municipal jails nationwide.
 Safekeeping and Development of PDL: The BJMP's core mission is to ensure the safe
and humane custody of PDL, while also providing opportunities for their development
and rehabilitation.

 Rehabilitation Programs: The BJMP implements various rehabilitation programs,


including livelihood projects, educational and vocational training, recreation and sports,
and religious/spiritual activities.

 Formulating Policies: The BJMP formulates policies and guidelines for the
administration of all district, city, and municipal jails.

 Security Measures: The BJMP implements strong security measures for the control of
PDL.

 Improving Jail Facilities: The BJMP works to improve jail facilities to ensure they are
secure, clean, adequately equipped, and sanitary.

 Promoting Personnel Welfare: The BJMP promotes the general welfare and
development of its personnel.

 The Bureau of Jail Management and Penology (BJMP; Filipino: Kawanihan


ng Pamamahala ng Bilangguan at Penolohiya[2]) is an attached agency of
the Department of the Interior and Local Government mandated to direct,
supervise and control the administration and operation of all district, city and
municipal jails in the Philippines with pronged tasks of safekeeping and
development of its inmates, officially classed as persons deprived of liberty
(PDL).
 The agency was created on January 2, 1991, by virtue of Republic Act No. 6975,
also known as the Department of the Interior and Local Government Act of 1990.
 The primary law governing the Bureau of Jail Management and Penology (BJMP)
is Republic Act No. 6975, also known as the Department of the Interior and Local
Government Act of 1990, which established the BJMP as a line bureau under the
Department of the Interior and Local Government. It was further amended by
Republic Act No. 9263, the Bureau of Fire Protection and Bureau of Jail
Management and Penology Professionalization Act of 2004.

3. OPERATION OF BUREAU OF FIRE PROTECTION

According to its website, the primary functions of the BFP are[5]


 Be responsible for the prevention and suppression of all destructive fires on:
 Buildings, houses, and other structures;
 Forests;
 Land transportation vehicles and equipments;
 Ships and vessels docked at piers or wharves anchored in major sea ports;
 Petroleum industry installations;
 Plane crashes; and
 Other similar activities

 Be responsible for the enforcement of the Fire Code of the Philippines (PD 1185) and
other related laws;

 Shall have the power to investigate all causes of fires and if necessary, file the proper
complaint with the city or provincial prosecutor who has jurisdiction over the case;
 In the time of national emergency, all elements of the BFP shall upon direction of the
President, assist the AFP in meeting the national emergency; and

 Shall establish at least one (1) fire station with adequate personnel, firefighting facilities,
and equipments in every provincial capital, city and municipality subject to standard rules
and regulations as maybe promulgated by the Department of the Interior and Local
Government (DILG) (Sec 56).

 The Bureau of Fire Protection (BFP; Filipino: Kawanihan ng Pamatay-Sunog[3])


is the government body in the Philippines responsible for firefighting services. It
is under the jurisdiction of the Department of the Interior and Local Government.
 Republic Act No. 6975, or the Department of Interior and Local Government Act
of 1990, took effect on January 1, 1991 and paved the way for the establishment
of the Philippine National Police, BFP and Bureau of Jail Management and
Penology as separate entities.
 RA 11589, otherwise known as the “Bureau of Fire Protection Modernization
Act”, strengthens the powers and functions of the Bureau of Fire Protection
(BFP), which was created under RA 69751, otherwise known as the “Department
of the Interior and Local Government Act of 1990”, as amended.

4. OPERATION OF PHILIPPINE COAST GUARD

Powers and Functions. - The PCG shall have the following powers and functions:

(a) To enforce regulations in accordance with all relevant maritime international


conventions, treaties or instruments and national laws for the promotion of safety of life
property at sea within the maritime jurisdiction of the Philippines and conduct port state
control implementation;

(b) To inspections on all merchant ships and vessels, including but shall not be limited to
inspections prior to departure, to ensure and enforce compliance with safety standards,
rules and regulations;

(c) To detain, stop or prevent a ship or vessel which does not comply with safety
standards, rules and regulations from sailing or leaving port;

(d) To conduct emergency readiness evaluation on merchant marine vessels;

(e) Subject to the approval of the Secretary of the DOTC, to issue and enforce rules and
regulation for the promotion of safety and life and property at sea on all maritime-related
activities;

(f) To coordinate, develop, establish, maintain and operate aids to navigation, vessel
traffic system, maritime communications and search and rescue facilities within the
maritime jurisdiction of the Philippines;

(g) To remove, destroy or low to port, sunken or floating hazards to navigation, including
illegal fish and vessels, at or close to sea lanes which may cause hazards to the marine
environment;

(h) To issue permits for the salvage of vessels and to supervise all marine salvage
operations, as well as prescribe and enforce rules and regulations governing the same;
(i) To render aid to persons and vessels in distress and conduct search rescue in marine
accidents within the maritime jurisdiction of the Philippines, including the high seas, in
accordance with applicable international conventions. In the performance of this function,
the PCG may enlist the services of other government agencies and the merchant marine
fleet;

(j) To investigate the inquire into the causes of all maritime accidents involving death,
casualties and damage to properties;

(l) To assist in the enforcement of laws on fisheries, immigration, tariff and customs,
forestry, firearms and explosives, human trafficking, dangerous drugs and controlled
chemicals, transnational crimes and other applicable laws within the maritime jurisdiction
of the Philippines;

(m) To board and inspect all types of merchant ships and watercrafts in the performance
of this functions;

(n) To enforce laws and promulgated and administer rules and regulations for the
protection of marine environment and resources from offshore sources or pollution within
the maritime jurisdiction of the Philippines;

(o) To develop oil spill response, containment and recovery capabilities against ship-
based pollution;

(p) To grant, within the capabilities and consistent with its mandate, requests for
assistance of other government agencies in the performance of their functions;

(q) To organize, train and supervise the PCG Auxiliary (PCGA) for the purpose of
assisting the PCG in carrying out its mandated functions; and

(r) To perform such other functions that may be necessary in the attainment of the
objectives of this Act.

 The Philippine Coast Guard, hereinafter referred to as the PCG, is hereby


established as an armed and uniformed service attached to the Department of
Transportation and Communications (DOTC): Provided, That in times of war,
as declared by Congress, the PCG or parts thereof, shall be attached to the
Department of National Defense.
 The "PCG Law" refers to Republic Act No. 9993, otherwise known as the
Philippine Coast Guard Law of 2009, which established the Philippine Coast
Guard (PCG) as a separate armed and uniformed service, attached to the
Department of Transportation.

5. OPERATION OF BUREAU OF IMIGRATION

Functions, Duties and Responsibilities of Immigration Area Director - The Immigration


Area Director (IAD) shall perform and exercise the following functions, duties and
responsibilities:

a. Monitor and coordinate with the operations of all BI District, Sub-port, Extension,
Field and Satellite Offices within their respective area of responsibility (AOR) as defined
in Section 4 hereof to ensure that the performance of its duties and responsibilities, as
well as its activities, are consistent with the vision and mission of the Bureau;
b. Direct, control, and supervise the intelligence, enforcement, law and investigation,
alien registration, information technology and civil security programs, operations and
activities of concerned personnel within their respective area of responsibility (AOR)
consistent with existing laws, rules, regulations and procedures.

c. Act as official representative of the Office of the Commissioner to the national


government agencies, local government units (LGUs), non-governmental organizations,
people’s organizations, and the private sector relative to immigration concerns in their
respective area of responsibility (AOR);

d. Provide the Office of the Commissioner with timely analysis and recommendations on
critical and strategic policy on issues and concerns relative to immigration and other
operational matters within their respective area of responsibility (AOR);

e. Assist and coordinate with concerned offices/officers relative to official visits of the
Commissioner in their respective area of responsibility (AOR);

f. Submit monthly report, or as often as may be required, to the Office of the


Commissioner on status of operations in their respective area of responsibility (AOR) and
in the implementation of programs and projects, as well as other relevant matters in their
respective area of responsibility (AOR) and, when necessary, with recommendations on
possible course/s of action;

g. Ensure that all memoranda, orders and directives of the Commissioner pertaining to
their respective area of responsibility (AOR) are faithfully and expediently accomplished;
and

h. Perform such other functions and duties as may be directed by the Commissioner
pursuant to Memorandum Order.

 Legal Basis - Commonwealth Act No. 613, otherwise known as the “Philippine
Immigration Act of 1940”, as amended; Book IV, Title III, Chapter 10, Section 31
of Executive Order No. 292, Series of 1987, otherwise known as the
“Administrative Code of 1987”; and DOJ Memorandum Order No. 04, dated 04
May 2009, entitled “Establishing the Immigration Area Offices in the Bureau of
Immigration, Defining the Functions, Duties and Responsibilities Thereof, and for
Other Purposes”.
 The Bureau of Immigration (BI) in the Philippines is an attached agency of the
Department of Justice (DOJ), responsible for administering and enforcing
immigration, citizenship, and alien admission and registration laws.
