 Inheritance:
Inheritance law in Pakistan includes property of moveable and immovable nature. Every
individual inherits the property devolves upon him on the eve of death of owner of the property/
predecessor in interest of the person. The shares on the legal heirs are dealt in accordance with
their personal law. Law of Succession and Heirship certificate deals with the matters related to
inherited properties. The law in Pakistan has now changed to the extent of getting heirship
certificate from NADRA authorities but in case of any legal defect decline certificate is issued
then same can be resolved smoothly by our legal team.
 Succession Certificate:
Law of succession deals with the movable inherited properties including vehicles, bank lockers,
money left in bank account of the deceased, gold ornaments, cash etc. where one to declare
himself the legatee of the inherited property has to obtain succession certificate from the Court of
Law. In case of issuance of decline certificate from NADRA the matter can be resolved for
issuance of succession certificate under the supervision of our legal team.
 Heirship Certificate:
Law of inheritance deals with all the matters pertaining to immovable property of the
predecessor in interest of the legatees. It includes the properties of immovable nature such as
house, shop, land thus any kind of real state. The jurisdiction of courts in such cases will be in
accordance with the place where such properties exist. Heirship certificate is obtained from Civil
Court for the declaration of legatees of immovable property. The law in Pakistan has now
changed to the extent of getting heirship certificate from NADRA authorities but in case of any
legal defect decline certificate is issued then same can be resolved smoothly by our legal team.

 Penal consequences:

Pakistan Penal Code operates against the acts where one forces a lady to surrender her share in
favor of other legal heir or in favor any other person will be held liable under 498A PPC.

 Tax Liability on Inherited Property:

There is no tax liability on the inherited property as per the laws applicable in Pakistan.
 Tenancy:
Tenancy is also an important field of law and in case of any dispute among the parties doors of
courts are open to resolve the matter. The agreements made between the parties needed to be
drafted under the guidance of Law Attorneys so that to avoid future disputes. Tenancy
agreements can be of any kind either of commercial nature or for residential purposes. To
establish the rights in court of law registration of tenancy agreement before Rent Controller is
very important or otherwise one cannot establish his/ her rights even though he is a tenant or a
landlord.
 Transferable Right:
The tenancy rights are also transferred to the son on the death of his father who was a landlord
while entering into the agreement.
 Subservient Agreements:
Generally, tenancy law does not allow the tenant to make any subservient agreements but if that
is specifically allowed by the tenant in his agreement.
o Requirements of Rent Agreement:
 It must be of real property
 Agreement must be registered
 Agreement of both the parties on the terms and conditions
 Addition of penal clause in agreement

 Rights of Parties:
Tenant And Land Lord both in case of any act done by other in deprivation of the agreement can
seek help from the court of law to establish their rights.

 Laws dealing with Rent Matters:


Special Rent Controller Courts deals with the any issue of rental property under the following
laws:
 The Islamabad Rent Restriction Ordinance 2001, (for the territory of Islamabad)
 The Punjab, NWFP, Baluchistan Rent Restriction Ordinance 1959
 Sindh Rented Premises Ordinance 1979
 Cantonment Rent Restriction Ordinance, 1963 (for Cantonment Areas)
 Contempt Proceedings:
Contempt proceedings may also be initiated against the party who does not comply with the
order of the Courts.
 Civil Cases:
Civil law is a system of law that deals with the disputes emerging on non performing of
civil liability by one person that is levied upon him under the law.
Civil cases include all kind of litigation that either arise from a contract (oral or written) or from
the obligations imposed upon the parties due to any understanding between the parties that leads

 Consumer Protection Rights:


Consumer protection law or consumer law is considered as an area of law that regulates private
law relationships between individual consumers and the businesses who are selling those goods
and services.
 Filing a Consumer Complaint before Consumer Court
The Consumer may file case / claim before Consumer Court which is headed by the District &
Session Judge / Additional District & Session Judge.
Steps for Filing Consumer Complaint:

o 15-Days Legal Notice to Service Provider:

Consumer should serve a fifteen days legal notice on plain paper to the provider of
defective product or faulty service(s), as the case may be, stating therein that he /
she / they will redress the damage suffered by him / her / them and consequently
pay damages to the consumer within fifteen days of receipt of legal notice,
otherwise the consumer may file a claim for redressal of his / her / their grievance
before Consumer Court.

o Legal notice should be served to the manufacturers / sellers of product(s) and to the
service provider, in case of provision of service, especially through registered post /
mail, along-with acknowledgement.
o There is a limitation of 30 days (from arising of cause of action) for filing a
complaint in the consumer court.
o Serving a 15 days legal notice is pre-requisite for filing claim in Consumer Court.

Consumer Complaint:

If matter is not resolved through legal notice, then consumer may file a case / claim
on plain paper for redressal of his / her / their grievance before the Consumer Court
within subsequent fifteen days.
 Family law:

 Powers of Family Courts:


The judge of a family court has wide range of powers is does not only exercise the powers of the
family judge but it also acts as Magistrate whenever there appears cases of Offences and aid and
abetment thereof under Section 337A (i), 337F (i) 341, 342, 343, 344, 345, 346, 352 and 509 of
the Pakistan Penal Code (Act XLV of l860)]
 Court Marriage:
Constitution of Pakistan 1973 provides the liberty to an adult sane person to choose someone of
his/ her wish and enter into the marriage bond with him/ her. Choosing person of own choice for
getting marriage is a constitutionally protected right that cannot be challenged or suspended.
Prescribed age for court marriage in accordance with law is 18 years or as per the age described
by the personal law. Free will of parties is the vital and most important factor for the Court
Marriage.

 National Identity Card of both the parties
 Form B or matriculation certificate in case of non-availability of CNIC
 In case of where one of the partners is foreigner then passport is required.
 Two witnesses
 4’4 pics of bride and groom
 Freewill affidavit of bride
 In case of second marriage of groom, permission certificate from Arbitration
Council is required
 In case of second marriage of wife, divorce deed or death certificate is required as
per the situation

 Registration of Marriage:
Registration of marriage is also an important step required by the prevailing law of the land. To
save oneself from any kind of trouble that may occur in future registration of nikahnama is
important. It is a legal contract and have the same essences therefore once registered will safe
from each and every kind of legal problems which can happen in future.
 Child Custody:
Child custody is a matter completely different from the cases of Family law. Custody of child is
an issue that arises when separation took place between the spouses. In case where custody or
visitation of the minor is not settled between the parties amicably then the party suffering due to
non-availability of rights may seek the help from the Court of Law. The Court’s keeping in view
of the welfare and best interest of minors regarding his/ her mental, physical, emotional growth,
health and well-being. ‘Shared Parenting’ is an emerging concept in Pakistan and is being
focused by us specifically to ensure non-custodian parents to have maximum excess to their
minors.
