ORDER BELOW EXHIBIT-4


This is an application for ad-interim anticipatory
bail u/s.482 of BNSS, 2023 filed by accused-applicants Sanjay
Satish Sharma for releasing them on anticipatory bail in
C.R.94/2025 of Naigaon Police Station for the offences
punishable under Section-504, 506, 354, r.w. 34 of I.P.C. and
section 12 of POCSO Act.
2. It is submitted on behalf of applicants/accused
that they are innocent and they are falsely implicated in the
present crime. All allegations in FIR are false. In fact, the FIR
came to be lodged on 27/03/2023. Even from the FIR it
appears that there was quarrel between husband of informant
and present applicant due to property dispute and hence,
informant has falsely implicated accused/applicant. So also,
nothing is to be recovered from the possession of the
applicants/accused. So also, the applicants have no criminal
antecedents. He is ready to co-operate with I.O. in
investigation and abide by any condition which will be
imposed on him while releasing them on ad-interim
anticipatory bail. Therefore, having regard to the

circumstances of the case, the applicant prayed to release him


on ad-interim anticipatory bail in the event of his arrest.
3. I have gone through the record of the case. Heard
Ld. Advocate for applicants/accused. It appears that FIR is in
respect of the incident dated 27/04/2023 and from FIR itself
it appears that there is property dispute between applicant
and husband of informant. Generally, ad-interim anticipatory
bail is not granted in the cases involving sections of POCSO
act. However, in the present case the allegation regarding
outraging modesty of a minor is against accused no.1 and not
against present applicant/accused. So also, nothing is to be
seized from possession of applicant. Hence, in view of facts
and circumstances of the case, this is a fit case to allow ad-
interim anticipatory bail to the applicant. Hence, I pass
following order.

ORDER
1. Application Exh.4 is allowed.
2. Pending the main bail application, in the event of arrest
of the accused/applicant Sanjay Satish Sharma be
released ad-interim anticipatory bail, in connection with
the C.R.94/2025 of Naigaon Police Station for the
offences punishable under Section-504, 506, 354, r.w. 34
of I.P.C. and section 12 of POCSO Act, on Personal bond
of Rs.50,000/- with one or more surety in the like
amount.

3. Applicants/accused shall remain present before the


Investigating Officer at Naigaon Police station on every
Sunday from 11.00 am to 2.00 pm till next one month
and as and when required by the Investigating Officer
under written intimation till further order.
4. Applicants/accused shall co-operate the investigating
agency and shall not tamper with prosecution evidence.
5. Applicants/accused shall not pressurize the informant
and witnesses in any manner.
6. Issue notice to the State, informant, victim and I.O. of
Naigaon police station returnable on 25.03.2025.
