VERIFIED PETITION TO CONDONE THE DELAY IN PAYMENT OF


DEFICIT COURT FEE

In the above matter, while calculating the Court Fees of the Review
Application interest from the date of petition. Due to oversights and error
regarding the date of petition and further period of interest to be added, the
Applicant have affixed stamps a sum of Rs. 430.00 instead of Rs.30/- and now
there is a deficit in payment of court fees to the extent of Rs. 430/- which was
neither willful nor wanton but occurred only due to the circumstances mentioned
above.

In these circumstances it is prayed that this Hon’ble Court may be pleased


to condone the delay of 89 days in payment of deficit court fee of Rs.430/-
and to pass such other or further orders and render justice.

The matter referred to above is true.

The Petitioners/appellants herein preferred Second Appeal against the Judgment and Decree
of the Subordinate Judge’s Court at Nagapattinam, dated 20.09.2021 in A.S.No. 46 of 2014
CONFIRMING the Judgment and Decree of the District Munsif Court at Nagapattinam, dated
20.10.2014 in O.S.No. 232 of 2011. The Lower Appellate Court furnished only a certified copy of the
decree and Judgement of Courts below and the printed copies applied under C.A.No. of 2021 were
yet to be furnished. As the petitioners are seeking an urgent interim order, it is necessary to dispense
with printed copies of the Judgment of the Courts below in the above second appeal. The petitioners
undertake to produce the same immediately after furnishing the same from the Lower Appellate Court.

In these circumstances, it is prayed that this Hon'ble Court may be pleased to dispense with
the production of the printed copies of the Judgment and Decree of the Subordinate Judge’s Court at
Nagapattinam, dated 20.09.2021 in A.S.No. 46 of 2014 CONFIRMING the Judgment and Decree of the
District Munsif Court at Nagapattinam, dated 20.10.2014 in O.S.No. 232 of 2011 for the present and
thus render Justice.
