inviewofthesignificanceofthe issue theprocedure is reiterated herein below forstrict compliance

0 There shail be a4(four) member committee, comprising ofExecutive Engineer (Civil),


AssistantEngineer(Civil) oftheconcerned district/project, representative from planningwing
ofPHEDirectorate andanofficer ofthe L&LRandRRRDepartment tobe nominated bythe

DistrictCollector, for identificationofsuitable land (s) forthe proposed project (s).

Based onthe LOPRequiring Division shall first locate governmentvested land (Khatian-1),
vacant land ofother departments and parastatals for the proposed projects. The Requiring
Division shall also explore and ascertain if the said project can berealigned orrelocated to
availablegovernmentvested land.

Thecommitteeshallconduct required field verification andascertainavailability ofvested land


parcels andthose held byother government departmentsandparastatals fortheproject. In case
suchparcel oflandis available andfoundto befree from encumbrances,the Committee shall
place the reportbefore the DistrictMagistrate andthe Collector ofthe concerned district who
in-turn shall initiate aproposal forsettlement / Inter Departmental Transferofthe Government
landin favour oftheRequiring Department.

In case the Government land is not available, the concerned Requiring Department in
consultation with the officials of L &LR Department shall explore the possibility of
realignment orrelocation oftheprojectas faras possible andtechnically feasible and ascertain
ifanysuch Government land is available in the relocated/ realignedpositions. Incasethere is
no such Government land available in spite ofrealignmentandrelocation, the Committeeshall
submitareport before the Collector who in-turn after due verification and on complete
satisfaction shall inform the Requiring Departmentabout the non-availability ofGovernment
land.

The Requiring Department on receipt ofthe report ofDistrict Magistrate &Collector shallin
consultation with the L&LRand RRR officials identify suitable private land and initiate a
proposalfor direct purchase oflandin accordance withthepolicy.

vi) The Requiring Department shall obtain market value ofland fromIGRWest Bengal andthen
refer the proposal with draft Cabinet Note to Finance Department for necessary
advice/concurrence.

After concurrence ofFinance Department, the proposal will besubmitted for approval as per
extantproceduresto place before the Standing CommitteeofCabinetonIIE for consideration.

The above guideline mustbe strictly complied before submission ofany proposal for direct
purchase ofland.Allnecessary documentationincludingreport ofthe Committeeandthereport
ofDistrictMagistrate andCollector about non availability ofgovernmentland must invariably
betagged with theproposal.

Please notethat undernocircumstances workatanysite underanyscheme/projectshall


commence unless the required parcel(s) of land free from all encumbrances is in complete
possession ofthe Division/Departmentthrough Inter Departmental Transfer (IDT),acquisition
oras per Direct Purchase Policy. Mere consent from land owner(s) shall not suffice toinitiate
worl at the site. It is therefore expected that, planning for land is done well in advance and
necessary approvals are obtained to ensure havingland in possession before the workorder is
issued.
