6. X borrowed money in the amount of P50,000.00 from Y. Unfortunately, X lost his
job and could barely meet his personal and daily expenses, most especially now
that the cost of basic commodities significantly increased due to inflation. Can X
be excused from paying his debt from Y?
7. Differentiate specific thing and generic thing. Give at least two examples each.
8. What are the different kinds of delay?
9. What rights are given by law to the creditor in case the debtor fails to comply with
his obligation to deliver a specific thing?

3. S sold a car to B for P1,000,000.00 payable in installments of P20,000.00 per


month. The said car was delivered to B who obtained ownership thereof. After B
had paid P900,000.00, he could no longer continue paying in view of financial
reverses but he was willing to pay the balance of P100,000.00 if given more time.
Thereupon, S sued for rescission against B. If you were the judge, would you grant
rescission? Explain.

4. May an obligor be liable under an obligation subject to a suspensive condition


although the condition has not yet been fulfilled? Explain.

5. Has the debtor the right to recover what he has paid to the creditor before the
arrival of the period agreed upon? Explain.

6. D binds himself to give P100,000.00 to C upon the death of the father of D. Is the
obligation of D conditional or one with a period? Explain.

7. Give instances when the obligee can demand the performance of an obligation
even before the arrival of the period agreed upon.
