Disciplinary Committee Letter
Disciplinary Committee
Mombasa, Kenya
I hope this letter finds the esteemed members of the committee in good health and spirits. We have
received communication from the complainants regarding the refund of their deposit paid to our
manpower recruitment agency.
We wish to draw the committee's attention to the terms outlined in the agreement signed by all
applicants upon engaging our services. As per the provisions of the agreement, applicants explicitly
agreed to a refund policy stipulating a maximum refund amount of 100 USD.
In light of this contractual obligation, we regret to inform the committee that we are unable to accede to
the full refund amount requested by the complainants. Notwithstanding our commitment to addressing
their concerns, it is imperative to uphold the terms agreed upon by all parties involved.
After careful consideration of the matter at hand, we understand the complainants' request for a refund
of 40,000 KSh from the initial deposit of 50,000 KSh. However, we regret to inform the committee that
we are unable to accede to the full refund amount as requested.
In our efforts to address the concerns raised by the complainants and in recognition of our commitment
to fair and transparent dealings, we propose a refund of 30,000 KSh from the initial deposit. This refund
amount is calculated based on the expenses incurred by our agency in facilitating the registration
process, conducting medical examinations, and securing attestation services.
For those complainants who are willing to explore new employment opportunities and can
afford to wait for a bit longer, we are committed to assisting them in finding suitable placements
through our network of contacts and resources.
For those complainants who maintain their decision to withdraw from our services, we have
devised a refund plan to expedite the settlement process. We will prioritize refunding applicants
who have not yet received any refunds. Initially, we will refund 15,000 KSh to each eligible
applicant as per the original agreement. Subsequently, we will disburse the remaining 15,000
KSh in installments over a period of time. To ensure a fair and equitable distribution, we will
refund five applicants each month until we complete the settlement.
We apologize for any inconvenience this matter may have caused and assure the committee of our
dedication to upholding professional standards and fulfilling our obligations to all stakeholders.
Thank you for your attention to this matter, and we appreciate your impartial consideration in resolving
this dispute.
Sincerely,
Fatma Ramadhan
Director
