NECESSARY DIRECTIONS OF THIS HON’BLE COURT TO THE
CONCERNED REVENUE OFFICE TO REFUND THE ENTIRE
COURT FEES OF RS. 7029/- ( RUPEES SEVEN THOUSAND TENTY
NINE ONLY) TO THE PLAINTIFF IN COMPLIANCE OF ORDER
OF THIS HON’BLE COURT VIDE DATED 18.03.2024 ON BEHALF
OF PLAINTIFF.

MOST RESPECTFULLY SHOWETH:

1. That the Plaintiff respectfully submits that the Plaintiff has filed the
above-captioned suit under Order XXXVII Of CPC against the
Defendant, seeking recovery for a sum of Rs. 4,76,820/ (Rupees Four
Lakh Seventy Six Thousand Eight Hundred Twenty) vide CS DJ
399/2023 before this Hon’ble Court and the said dispute was amicably
settled between the plaintiff and defendant on dated 18.03.2024 and
therefore, on the same date i.e. 18.03.2024, the plaintiff withdrawn
the above mentioned suit pending before this Hon’ble court and as per
rules, this court directed the plaintiff to get refund of the court fees
worth of Rs. 7,029/- (Rupees Seven Thousand Twenty Nine Only)
which was locked in the said suit and the said suit stands disposed off
by this court as withdrawn by the plaintiff. Copy Of Order dated
18.03.2024 passed by this Hon’ble Court is annexed herewith as
Annexure- A.
2. That as per the said directions of this court, the plaintiff approached
to the concerned courts staff to get discharge of his court fees from the
disposed suit. And on dated 15.07.2024, the counsel of plaintiff
received the original locked court fees from judicial file along with
certificate for refund of court fees from the concerned Ahlmad of this
Hon’ble court. And it came into knowledge of counsel for plaintiff
that the plaintiff has to approached to the concerned nearest Revenue
Office I.e., 36, Mehrauli, Badarpur Road, Tughlakabad Institutional
Area, New Delhi- 110062 to get his money back from the original
court fees. Copy Of Certificate For Refund Of Court Fee and copy Of
court fees worth of Rs. 7,029/- (Rupees Seven Thousand Twenty Nine
Only) are annexed herewith as Annexure- B (Colly).
3. That thereafter, the counsel for plaintiff along with plaintiff as per the
guidance of concerned Ahlmad approached the revenue office situated
in 36, Mehrauli, Badarpur Road, Tughlakabad Institutional Area, New
Delhi- 110062, where the concerned staff of this office directed the
plaintiff and his counsel to approached the main head office i.e.
Department Of Revenue situated in Sham Nath Marg, Civil Lines,
Delhi- 110054.
4. That the Plaintiff along with his counsel then approached to the main
head office i.e. Department Of Revenue situated in Sham Nath Marg,
Civil Lines, Delhi- 110054 but the plaintiff got no relief from there
also as the staff of the department made vague excuses and not gave
any satisfactory reply, due to which the plaintiff unable to encash his
money from the original court fees locked in the present case.
5. That it is pertinent to mention here that despite the order of this
Hon’ble court vide dated 18.03.2024 and despite with the certificate
of refund of court fees, the revenue department staff not corporate
with the plaintiff and not refund the court fees to the plaintiff.
6. That as per direction of one of staff present on Help Desk of
Department of Revenue, the plaintiff also visited to the Revenue
Department situated in Ghaziabad, U.P as the jurisdiction where the
plaintiff resides but the plaintiff and his counsel not got any relief
from there also.
7. That the plaintiff seeks kind attention of this Hon’ble Court and prays
for direction of this court to the concerned Department of Revenue to
refund the court fees worth of Rs. 7,029/- (Rupees Seven Thousand
Twenty Nine Only) to the plaintiff in interest of justice.
8. That the present application is fixed bonafide and will cause
irreparable loss and grave injury to the plaintiff if the same is not
allowed by this Hon’ble Court.

PRAYER

In view of the aforesaid facts and circumstances, it is, therefore, most

respectfully prayed that this Hon’ble court may be pleased to:


a) Allow the present application and may direct to concerned

Department of Revenue to refund the court fees worth of Rs. 7,029/-

(Rupees Seven Thousand Twenty Nine Only) to the plaintiff in

interest of justice.

b) Pass such other or further orders as this Hon'ble Court may deem fit

in the facts and the circumstances of the case in favour of plaintiff.
