Concept of constitution

• The constitution refers to the basic principles of governance by


which the governance of the state is governed.

• Constitution refers to all the written and unwritten rules that


govern the governance of the country.

• On the basis of which the formation of the government, the


organization of the departments of the government,
determining the power and mutual relations and the relations of
the citizens of the state etc. are regulated.

• Aristotle –
“Constitution is the way in which, citizens who are the component
parts of the state, are arranged in relation to one another.”

• Woolsey –
“Constitution is the collection of principles according to which the
powers of the government, the rights of the governed and the
relation between the two are adjusted.”

• Jellineck –
“Constitution is a body of judicial rules which determine the supreme
organs of the states, prescribe their mode of creation, their mutual
relation, their sphere of action and finally the fundamental place of
each of them in relation to state.”
Concept of constitution…

• Finally we can say that All the rules and regulations that
determine how the government will be formed, what the power
of the government will be, how this power will be exercised,
how the power will be built between the various departments of
the government and what will be their mutual relationship, their
collective form is called the constitution.
Contents of the constitution
In an ideal constitution, the following point are essentially present -

01. Organization and form of the administration of state;

02. Functions of different organs of the government, their power and


mutual relations;

03. Mention of the fundamental rights of the citizens;

04. The relation of the government with the people; and

05. The procedure of the amendment of the constitution.


Qualities of a good constitution
• Clarity or definiteness;

• Brevity;

• Comprehensiveness;

• Flexibility;

• Declaration of rights;

• Independence of judiciary; and

• Directive principles of state policy.


Types of the constitution

• Written constitution;

• Unwritten constitution;

• Flexible constitution; and

• Rigid constitution.
