AI art and copyright infringement

The research question aims to address the problem arising from the unauthorized use of
copyrighted images by AI systems that scrape the internet.

Perspective 1: AI models should not be allowed to use artist’s copyrighted images in


their dataset.

Perspective 2: AI models should be allowed to use copyrighted images in their datasets.

Audience interest: I believe artists and the online technology community are interested in
this topic since it involves new advancements.

ARGUMENTS AND COUNTERARGUMENTS

1. Some argue that the use of copyrighted images by AI art models falls under the fair
use doctrine, as the final image does not contain copyrighted aspects of a single
artist’s work.
2. Creative freedom - placing restrictions could hinder AI’s ability to generate diverse
and unique artwork.

3. Emphasize the importance of protecting artists' copyrighted works and argue that AI
art models should obtain proper licenses or permissions to use copyrighted images,
just like any other artist.

4. Supporters of AI art models might argue that it is challenging for models to


distinguish between copyrighted and non-copyrighted images.

4. State the purpose of your research. Consider the following in your response:

1. My research question aims to address the problem of unauthorized use of copyrighted


images by AI art models by exploring the legal and ethical implications.

2. As AI art models are a new technology, the guidelines and laws are unclear so I will
focus on researching any legal precedents and current copyright laws as well as “fair
use” issues.

3. The scrutiny of legal precedents and court cases provides an avenue for understanding
the diverse viewpoints on both sides of the issue.
