TERMS OF REFERENCES

2.1 INTRODUCTION
The Terms of References (TOR) is for the preparation of an Environmental Impact
Assessment (EIA) study for “Manganese and Other Minerals Mining Operation on Lot 89798
Measuring an Area of 40.51ha (100.1 acres) at Mukim Penyor, Daerah Pekan, Pahang Darul
Makmur”. This TOR has been endorsed by Department of Environment Malaysia [Ref. No.:
JAS 600-2/8/5 (34)] dated 13 March 2020 which can be referred in Appendix V.

2.2 BACKGROUND OF THE PROJECT


Golden Prosperous Resources Sdn Bhd, a local experienced mining company has been
appointed by Sutera Manja Sdn Bhd, legal representative of Hanishah Ventures Sdn Bhd as
the operator for the project site. Thus, Golden Prosperous Resources Sdn Bhd is the project
proponent/project operator for this project operation. The project proponent has fully paid the
Mining Lease (ML) approval fee of RM 101,920.00 as per request by Pejabat Pengarah Tanah
dan Galian Negeri Pahang. State authority has striked out the project site designated as
‘Kawasan Warta Khas Tasik Chini’.

The principal purpose of the project operation is to supply manganese ore to meet the
increasing demands from downstream manufacturing industry in Malaysia and overseas.
Currently bulk of the mining produce is exported to China. The market price of manganese
ore increased as well due to its scarcity and demand locally and internationally.

The project site with a measured surface area of approximately 40.51 ha, sits across the
road where an existing mine being operated under ‘Pahang State Development
Corporation’ (PKNP). Both the projects are separated by Jalan Bandar Chini. The mining
capacity is anticipated to be averagely 35,000 metric ton / month. There will be monthly
stockpile maximum 105,000 metric ton on site depending on sales and demand. Most of the
impacts predicted will be in relation to water quality, dust dispersion, soil erosion and
sedimentation and health and safety. Impacts due to roads and transport may not be
significant as there is already established public access road. Project proponent shall take
responsibility to maintain the public access road.

The project proponent is Golden Prosperous Resources Sdn Bhd (1097672-U). It is an
experienced mining operator under the Golden Prosperous Group of Companies head
quartered in Kuantan, Pahang. The project proponent takes responsibility as a corporate
citizen by complying with stringent regulations at all times to minimize environmental
destruction and pollution caused by mining activities.

2.5 SCOPE OF PROJECT


2.5.1 Legal Requirement
Department of Environment
As the proposed project is a mining operation, it becomes a prescribed activity according to
the Environmental Quality (Prescribed Activities) (Environmental Impact Assessment) Order
2015, Second Schedule, item 8 (Mining) because it is sited next to Kawasan Warta Tasik
Chini. Thus, an EIA is necessary to fulfil the legal requirements. The EIA study will be
carried out in compliance with the above requirements and according to guidelines as
stipulated in the Guidelines for Mines and Quarry, published by the DOE Malaysia in October
2009.

Besides, EIA is needed to assess the potential impacts due to the proposed project operation
and their associated mitigation measures to ensure that sustainable development is achieved.
Best management practices (BMPs) will be proposed in the EIA to ensure the existing
environment is well taken care of and minimal impact is foreseen.

2.5.2 Project Work Components


The work components of the proposed project are overburden stripping, drilling, mine ore
extraction, crushing and screening, washing, hauling, stockpiling and marketing. Detailed
description of the project work components is elaborated in the ESI report.

i. Land use within 5km but more focus within 3km of sensitive environment recipients
ii. Zoning compatibility
iii. Dust dispersion within 5km radius
iv. Water quality, water usage for plant and ecology, water intake point
v. Public perception and socio-economy within 5km radius
vi. Noise exposure to workers & local settlement
vii. Occupational Health & Safety

2.5.3 Implementation Program


The tentative operation implementation schedule for the 2.2 years is attached in Appendix
VI.

2.6 ALTERNATIVES CONSIDERATION


2.6.1 Economy Option
Economy consideration is a key factor that drives the project towards its implementation.
Royalty from the project proponent is one the important revenue for State Government. In
addition, the proposed operation supplies important resources for industry development.

2.6.2 Project Site Location Option


It is a wise and strategic location as it is situated closed to an existing operation under
‘Pahang State Development Corporation (PKNP)’. Furthermore, the proposed mine site is
having sufficient buffer from the nearest settlement and at least 4km away from Tasik Chini.
According to ‘Rancangan Kawasan Khas Tasik Chini’, the proposed site lies off more than 4
km away from the ‘Tasik Chini Water Edge’ and it is designated as ‘Sustainable
Development Area’. Most of the project site has been exploited illegally. Thus, insignificant
impact on the current land use profile is foreseen. In addition, the project site area and its
surrounding are well proof of its manganese reserve that can be exploited. Manganese
reserve existence is very unique, no available at all the earth surface. Thus, the project site is
concluded as most suitable location for mining operation.

2.6.3 Technology Option


Manganese mining has evolved from primitive methods to a highly advanced,
technology-based process that allows us to achieve a substantial increase in manganese

production. Mining equipment that’s compact, cost-effective and durable over time has
made a positive impact on mining efficiency and production. One of the greatest of these
benefits is waste reduction and chemicals free.

Mining can be broadly divided into two categories that are open pit mining and
underground mining. Open pit mining (adopted by this project) is more advantageous
than underground mining in terms of ore recovery, operational flexibility, productivity,
safety, and cost.

There is some development in the manganese mining technology and the project
proponent shall not spare effort to implement onsite and DOE may ask for improvement
of technology within the financial capacity of the project proponent. Project proponent
will be willing to adopt updated technology in mining operation. This in turn will be
tuned more environmentally friendly approaches such as enclosed structure and dust
suppression system.

receptor is Kemajuan Tanah (Felda) Chini Dua. Impact on the receptors will be analyzed
through dust modelling software.

• Noise Quality
The spatial boundaries for the assessment area is for within Project Site and adjacent
boundary with the nearest residential receptors as critical groups. The nearest residential
receptor is Kampung Kemajuan Tanah (Felda) Chini Dua. Impact on the receptors will be
analyzed through noise modelling software.

• Soil Erosion & Sedimentation


Boundaries of soil erosion & sedimentation will cover within project site areas in accordance
with dedicated catchment area and receptor of downstream discharge of oil palm plantation
estate.

• Water Quality & Hydrology


The study boundary for water quality is upstream od stream discharge towards the oil palm
plantation, swamp water, upstream into the swamp water and tributary of tasik mentiga before
and after intercept of the unknown stream. 32 water parameters will be analyzed. Qual2k
model and TSS mix model will be adopted to analyze the impact.

• Flood Risk
Analysis of potential flood due to the project operation on the immediate downstream
receptor. The flood risk will be assessed through assessment matrix.

• Solid & Scheduled Wastes


Project proponent will take care the management of wastes within Project site during
construction and allocation of collection point. It should not impact any nearby receptors.

• Ecology (Flora & Fauna)


The boundaries of ecology are encompassing of within Project area and its surrounding. The
project site is long ago disturbed. The impact shall be analyzed.

• Transportation/Traffic
Traffic volume and network within Project site and radius of 5km from Project site should be
analyzed. The receptors are road users along 5km down the Jalan Bandar Chini. A traffic
estimation from the project site will be conducted and traffic data from Jabatan Kerja Raya
Malaysia will be compared and analyzed with the estimation.

• Socio-Economics
Boundaries of socioeconomic will covers the assessment of socioeconomic of current and
existing surrounding area of Project site within 5km radius vicinity. A survey will be
conducted to obtain the relevant information and opinion of public about the operation.

2.9 ASSESSMENT STANDARDS

• Water Quality Information


Five (5) water samplings station (W1, W2, W3, W4 & W5) have been identified as illustrated
in the ESI report. W1 is the upstream of unknown stream discharge into oil palm plantation
while W2 and W3 are the samples at upstream of swamp area and within swamp area. W4
and W5 are located at tributary of Tasik Mentiga. All the water quality will be compared to
Class II.

• Air Quality Information


The air quality was assessed in term of Particulates Matter 2.5µm (PM2.5), Particulates Matter
10 µm (PM10), Nitrogen Oxides (NO2), Sulphur Oxides (SO2) and Carbon Monoxide (CO)
level for the study area. Measurements will be carried out at three locations denoted as A1, A2
and A3. The results will be compared to the Ambient Air Quality Recommended Malaysia

Guidelines limit of 75 µg/m ,150 µg/m , 75 µg/m , 105 µg/m and 10 µg/m for PM2.5,
PM10, NO2, SO2 and CO respectively.

• Noise Quality Information


Under Guidelines for Environmental Noise Limits and Control issued by the Department of
Environment, 2019, the impact of noise level is depending on receiving land use. In case of this
Project, the monitoring works is concern on the impact to the nearest settlement areas. Based on
the guidelines, it shall fall under urban residential areas where the permissible limits are listed in
Table 2.1.

To confirm ambient noise level of area of interests, ad-hoc noise measurements were carried
out during day time and night time to determine the baseline level on those areas. The
monitoring was measured for 24 hours three (3) locations. Three locations for sampling points
are denoted as N1, N2 and N3.

• Types of Soil & Geology


The type of soil & geology will be accessed in accordance to major soil group by Department
of Agriculture and Geological setting by Department of Mineral & Geoscience.

• Solid & Hazardous Wastes


Scheduled waste on site will be assessed sa per DOE requirement EQ (Scheduled Wastes)
Regulation 2005 and Local Authorities requirement.

• Terrestrial Ecology
A site visit will be conducted to assess the flora and fauna at the expansion site. Besides,
literature review will be based on Wildlife and Forestry Department requirement.

• Transportation/Traffic
A traffic estimation will be conducted and it will be assessed in accordance to Jabatan Kerja
Raya Malaysia requirement.

• Socio-Economics
The socio-economic data will be assessed as per DOE’s requirement and data provided by
Department of Statistic. Social survey within 5km radius from the project site will be
conducted.

• Abandonment
The abandonment and rehabilitation plan will be conceptually prepared as per DOE’s
requirement.

2.11 CONSIDERATION OF CONCURRENT PROJECTS


Currently, there is one existing mining operation siting across the road under Pahang
State Development Corporation. The potential cumulative impact is traffic increment at
Jalan Bandar Chini. Thus, it is advisable that the mining operators can communicate
with each other to come out with a proactive solution.

2.12 DESCRIPTION OF MODELLING TOOLS, ASSESSMENT


METHODOLOGIES
2.12.1 Air Quality Model
US EPA Industrial Source Complex Short Term Version 3 (ISCST3) model is adopted to
assess the impact of air quality. In this assessment, the United States Environmental
Protection Agency (US EPA 1992), Screening Procedures for Estimating the Air Quality
Impact of Stationary Sources was employed. The ISCST3 model is based on a steady-state
Gaussian plume algorithm, and is applicable for estimating ambient impacts from a wide
variety of sources such as point, area, and volume sources out to a distance of about 50
kilometers. ISCST3 includes algorithms for addressing building downwash influences, dry
and wet deposition algorithms, and also incorporates the complex terrain screening algorithms
from the COMPLEX1 model (US EPA, 1995). The ISCST3 model utilizes hourly
meteorological data that have been preprocessed using the PCRAMMET program for
meteorological data, and the Meteorological Processor for Regulatory Models (MPRM) for
on-site data.

The ISCST3 model includes a wide range of options for modelling air quality impacts of
pollution sources, making them popular choices among the modelling community for a
variety of applications. Among the options available are the source option, receptor option,
meteorological option, dispersion option and output options.

2.12.2 Noise Assessment Equation


In this assessment, noise level at specific distances from a point source was calculated using
the following formula for distance attenuation

2.12.3 TSS Model


Qual2k will be employed to simulate the impact on the receiving river. Besides, a simplistic
TSS model will be simulated and calculated manually.
