TERMS OF REFERENCES
2.1 INTRODUCTION
The Terms of References (TOR) is for the preparation of an Environmental Impact
Assessment (EIA) study for “Manganese and Other Minerals Mining Operation on Lot 89798
Measuring an Area of 40.51ha (100.1 acres) at Mukim Penyor, Daerah Pekan, Pahang Darul
Makmur”. This TOR has been endorsed by Department of Environment Malaysia [Ref. No.:
JAS 600-2/8/5 (34)] dated 13 March 2020 which can be referred in Appendix V.
The principal purpose of the project operation is to supply manganese ore to meet the
increasing demands from downstream manufacturing industry in Malaysia and overseas.
Currently bulk of the mining produce is exported to China. The market price of manganese
ore increased as well due to its scarcity and demand locally and internationally.
The project site with a measured surface area of approximately 40.51 ha, sits across the
road where an existing mine being operated under ‘Pahang State Development
Corporation’ (PKNP). Both the projects are separated by Jalan Bandar Chini. The mining
capacity is anticipated to be averagely 35,000 metric ton / month. There will be monthly
stockpile maximum 105,000 metric ton on site depending on sales and demand. Most of the
impacts predicted will be in relation to water quality, dust dispersion, soil erosion and
sedimentation and health and safety. Impacts due to roads and transport may not be
significant as there is already established public access road. Project proponent shall take
responsibility to maintain the public access road.

The quarry consultant is KenEp Consultancy & Services Sdn Bhd. The company details as

The consultant engaged to prepare LDP2M2 is Yap Chin Hoi, a registered EIA consultant
under Capai Cerah Sdn Bhd. He has been involved in erosion and sedimentation design more
than 8 years. The correspondence address is given below:
Besides, EIA is needed to assess the potential impacts due to the proposed project operation
and their associated mitigation measures to ensure that sustainable development is achieved.
Best management practices (BMPs) will be proposed in the EIA to ensure the existing
environment is well taken care of and minimal impact is foreseen.

Mining can be broadly divided into two categories that are open pit mining and
underground mining. Open pit mining (adopted by this project) is more advantageous
than underground mining in terms of ore recovery, operational flexibility, productivity,
safety, and cost.
There is some development in the manganese mining technology and the project
proponent shall not spare effort to implement onsite and DOE may ask for improvement
of technology within the financial capacity of the project proponent. Project proponent
will be willing to adopt updated technology in mining operation. This in turn will be
tuned more environmentally friendly approaches such as enclosed structure and dust
suppression system.

• Noise Quality
The spatial boundaries for the assessment area is for within Project Site and adjacent
boundary with the nearest residential receptors as critical groups. The nearest residential
receptor is Kampung Kemajuan Tanah (Felda) Chini Dua. Impact on the receptors will be
analyzed through noise modelling software.
• Flood Risk
Analysis of potential flood due to the project operation on the immediate downstream
receptor. The flood risk will be assessed through assessment matrix.
• Transportation/Traffic
Traffic volume and network within Project site and radius of 5km from Project site should be
analyzed. The receptors are road users along 5km down the Jalan Bandar Chini. A traffic
estimation from the project site will be conducted and traffic data from Jabatan Kerja Raya
Malaysia will be compared and analyzed with the estimation.
• Socio-Economics
Boundaries of socioeconomic will covers the assessment of socioeconomic of current and
existing surrounding area of Project site within 5km radius vicinity. A survey will be
conducted to obtain the relevant information and opinion of public about the operation.

To confirm ambient noise level of area of interests, ad-hoc noise measurements were carried
out during day time and night time to determine the baseline level on those areas. The
monitoring was measured for 24 hours three (3) locations. Three locations for sampling points
are denoted as N1, N2 and N3.
• Terrestrial Ecology
A site visit will be conducted to assess the flora and fauna at the expansion site. Besides,
literature review will be based on Wildlife and Forestry Department requirement.
• Transportation/Traffic
A traffic estimation will be conducted and it will be assessed in accordance to Jabatan Kerja
Raya Malaysia requirement.
• Socio-Economics
The socio-economic data will be assessed as per DOE’s requirement and data provided by
Department of Statistic. Social survey within 5km radius from the project site will be
conducted.
• Abandonment
The abandonment and rehabilitation plan will be conceptually prepared as per DOE’s
requirement.
The ISCST3 model includes a wide range of options for modelling air quality impacts of
pollution sources, making them popular choices among the modelling community for a
variety of applications. Among the options available are the source option, receptor option,
meteorological option, dispersion option and output options.
