Request for redressal ofgrievances of poor farmers to save land,. Hon’ble Chairman Sahib, We, the following marginal
Farmers of village Daultabad, Sector-103, Gurugram-122006. Submits grievances as below-1. Smt., Gyanwanti window
of late Sh. Jagdish. Ii) S/Sh. Sita Ram, Rambir, Laxmi Narain and Krishan Kumar S/O late Sh. Abhey Ram iii) S/Sh
Surender Singh, Dayanand S/o Sh. Ratan. Background of the case: M/s. Mahira Buildtech Private Limited approached
the Applicants on 20.03.2018 and induced them to enter in to an Agreement to Sell the land measuring 44 Kanals 03
Marlas @ Rs.8.50 Crores/8.80 Crores per acre situated in revenue estate of village Tikampur and Daultabad,Tehsil
Kadipur, District Gurugram in which applicants have their share. As per Agreement payment was to be done in six
months failing which interest @ 18% will be paid. That on 22.03.2018 on asking of M/s. Mahira Buildtech Private
Limited, Applicants entered into (i) Joint Development Agreement(Vasika No.6404), dated 22.03.2018 and (ii) Joint
Development Agreement (Vasika No. 6466) dated 26.03.2018 with M/s. Mahira Buildtech Private Limited having its
registered office at 302-A, Global Foyer, Golf Course Road, Sector-43, Gurugram- 122009. GPA and SPA were also

given to obtain Licenses from DTCP HARERA. That after entering into Joint Development Agreement, M/s. Mahira
Buildtech Private Limited obtained License No.31 of 2019 dated 01.03.2019 from Town and Country Planning by
affixing forged and fabricated signatures of land owners on obligatory LC-IV and Form LC-IV-A and 15 of 2019 dated
01.04.2019 from HRERA, Gurugram. That Para-3 of Joint Development Agreements stipulates as below:"1.That out of
the approved build up area by the government measuring 76,230 (maximum permissible area for affordable housing)
sq/ft. per acre the share of parties would be as under : Share of the LAND OWNERS 60% Share of the DEVELOPER
40% That as per above terms and conditions of Joint Development Agreement dated 22/26.03.2018, the land
owners/Applicants were to receive 60% of the amount duly received by M/s. Mahira Buildtech Private Limited from
time to time. Entire expenditure to be borne by M/s. Mahira. Commissioner of Police, Gurugram: Reference:
Complaints as below: (All written proofs have been attached with complaints). 1. Complaint under Diary
No.13287/CP/2022 dated 30.08.2022. 2. Complaint under Diary No.14206/CP/2022 dated 15.09.2022. 3. Complaint
under Diary No.16993/CP/2022 dated 03.11.2022. 4. Complaint under Diary No.1946/CP/2023 dated 06.02.2023.5.
Complaint under Diary No.2926/CP/2023 dated 20.02.2023.6. Receipt dated 10.11.2022 (Proceedings dated 30.10.2022
of Panchayat-18).7. Grievance No.36318112022-65928 dt. 18.11.2022 from Home Minister, Haryana.8. Grievance
No.36308022023-7944 dt. 08.02.2023 from Home Minister, Haryana,Despite of repeated large number of complaints
and frantic visits, FIR has not beenlodged on following criminal act of ommissions and commissions of financial
embezellement,by M/s. Mahiramisappropriation/mismanagement and cheating and fraud committedBuildtech Private
Limited, Sector-103, Gurugram.Subject matter of complaints as below:1. M/s. Mahira Buildtech Pvt.Ltd has submitted
LC-IV (Agreement by Owner of land intending to set up a affordable group housing colony and Form LC-IV-A
(Bilateral agreement by owner of land intending to set up a affordable group housing colony) dated 01.03.2019 and
obtained License No.31 of 2019 dated 01.03.2019 whereas above named land owners have not affixed their signatures
on LC-IV and Form LC-IV-A and thus, the signatures on LC-IV and Form LC-IV-A are forged and fabricated.
Therefore, LC- IV (Agreement by Owner of land intending to set up a affordable group housing colony and Form LC-
IV-A(Bilateral agreement by owner of land intending to setup a affordable group housing colony) submitted by M/s.
Mahira Buildtech Pvt.Ltd and obtained License No.31 of 2019 dated 01.03.2019 are null and void ab-initio and may be
treated as "NIL.2. Press Release dated 18.03.2021 issued by the Commissioner of Income Tax, Department of Revenue,
Ministry of Finance, New Delhi has divulged as below:(i)The Group has claimed bogus expenses on account of building
material like cement, raiti, iron bar etc. of around Rs. 100 crores ii Bogus booking of flats in the name of
employees/relatives and unidentifiable persons. Flats have been sold to the actual buyers at a premium of Rs.6 lakhs to
10 lakhs each and cash in crores not accounted for in the books. Contd.Page-3 iii The Group is regularly claiming huge
bogus business promotion expenses and loundering the cash siphoned off as unaccounted investment in immovable
properties. (iv) The Group has incurred unaccounted expenditure for personal and office purposes in cash running into
crores including expenditure for taking various approvals for projects and lavish marriage expenses. 3. That M/s.
Mahira Buildtech Pvt.Ltd has collected/received Rs. 163.41 crores i.e. 87.5% payment from the flat allottees (774 flats)
but land owners whose land was taken in 2018 and who are poor marginal farmers have been paid very meagre amount.
Physical progress of the project is 20 % approx i.e. Rs.32.68 crores and not commensurate to the payments collected
from the Allottees. It is evident that M/s. Mahira Buildtech Pvt.Ltd are misusing Rs.104.13 crores for money-laundering
and have cheated land-owners as cost of land has been siphoned from the Escrow Account. M/s. Mahira Buildtech
Pvt.Ltd are also earning heavy amount like interest and diverted funds to other Associates. 4. The HARERA Act clearly
stipulates : "The Promoter shall deposit seventy percent of the amounts realized by the promoter in a separate Escrow
account to be maintained in a scheduled bank to cover the cost of construction and the land cost to be used only for that
purpose as per sub-clause (D) of clause (1) of sub-section (2) of Section-4". As per two Forensic Audit Reports M/s.
Mahira Buildtech Pvt.Ltd has siphoned almost all amount from the Escrow account of scheduled bank and thus
committed embazellment of public money and share of land owners who are very marginal farmers. As per provisions
of HARERA Act, the Chairman, HARERA-Gurugram is the custodian of the amount in Escrow Account and thus
Chairman/Officers/officials of HARERA Office have collusion with accused persons in this cheating and
embezellment. Rs.104.13 crores are involved in this matter. The preliminary forensic audit reports dated
22.07.2022/05.12.22 confirm the breach of Acts. 5. That in order to save repetition kind attention is invited to FIR
lodged by District Town Planner(Enf), Gurugram for submitting forged Bank Guarantees vide FIR No.0175 dated
18/05/2022. In this case cheating has been done with the land owners in view of Clause- 7 of Joint Development
Agreement as they have not incurred any amount and staked 40% share. 6. M/s., Mahira Buildtech Private Limited has
misled and misguided Hon'ble High Court of Delhi and got attached the land of owners/farmers "Commercial space
land measuring 26,708.05 sq.ft. super built-up area situated in the project named 'Mahira Homes-103' situated in Sector-
103 District Gurugram whereas M/s.Sai Aaina Farms Private Limited Contd.Page-4is separate Company/entity having
separate registration numbers and thus has no concern with the land of land owners/farmers. In this case cheating has
been done with land owners as their share has also been attached to pay the debt of other company. M/s. Mahira
Buildtech Pvt.Ltd are involving the land of Applicants in other matter which is cheating. 7. That M/s. Mahira Buildtech
Pvt.Ltd mortgaged property/unsold flats amounting to Rs.46,31,80,763/- as guarantee against the outstanding of
EDC/IDW to the DTP in respect of license no.31 of 2019 etc. for which M/s. Mahira Buildtech Pvt.Ltd has no authority
to do so and they mischievously utilizing and involving land of the land owners just in order to create complications and
unnecessary litigation and thus cheated the land owners. M/s. Mahira Buildtech Pvt.Ltd has not invested any amount
and staked 40% share. The 165 flats which have been mortgaged are in Air and not physical. Chairman,

not taken remedial action for the recovery and retrieval of withdrawal amount and nor lodged FIR of ommissions and
commissions of financial embezellement, misappropriation/mismanagement and cheating and fraud committed by M/s.
Mahira Buildtech Private Limited, Sector-103, Gurugram. For criminal act Subject matter of complaints as below: The
HARERA Act clearly stipulates : "The Promoter shall deposit seventy percent of the amounts realized by the promoter
in a separate Escrow account to be maintained in a scheduled bank to cover the cost of construction and the land cost to
be used only for that purpose as per sub-clause (D) of Contd.Page-5 clause (1) of sub-section (2) of Section-4". As per

below: 1. M/s. Mahira Buildtech Pvt.Ltd has submitted LC-IV (Agreement by Owner of land intending to set up a
affordable group housing colony and Form LC-IV-A(Bilateral agreement by owner of land intending to set up a
affordable group housing colony) dated 01.03.2019 and obtained License No.31 of 2019 dated 01.03.2019. The land
owners have not affixed their signatures on LC-IV and Form LC-IV-A and thus, the LC-IV signatures on LC-IV and
Form LC-IV-A are forged and fabricated. Therefore, (Agreement by Owner of land intending to set up a affordable
group housing colony and Form LC-IV-A(Bilateral agreement by owner of land intending to set up a affordable group
housing colony) submitted by M/s. Mahira Buildtech Pvt.Ltd and obtained License No.31 of 2019 dated 01.03.2019 are
null and void ab-initio and may be treated as "NIL. Therefore, it is not binding on Land Owners/Kisans. 2. That Land
Owners/Kisans are free from all encumbrances in respect of LC-IV (Agreement by Owner of land intending to set up a
affordable group housing colony and Form LC-IV- A(Bilateral agreement by owner of land intending to set up a
affordable group housing colony) submitted by M/s. Mahira Buildtech Pvt.Ltd and obtained License No.31 of 2019
Contd.Page-6 dated 01.03.2019. M/s. Mahira Buildtech Pvt. Ltd has collected/received Rs. 163.41 crores l.e. 87.5%
payment from the flat allottees (774 flats) but land owners whose land was taken in 2018 and who are poor marginal
farmers have been paid very meager amount. M/s. Mahira has attemted to grab the land of Farmers without payment. 3.
Physical progress of the project is 20% approx i.e. Rs.32.68 crores and not commensurate to the payments collected

Guarantees vide FIR No. 175 dated 18/05/2022. In this case cheating has been done with the land owners in view of
Clause-7 of Joint Development Agreement as they have not incurred any amount and staked 40% share. 7. M/s.. Mahira
Buildtech Private Limited has misled and misguided Hon'ble High Court of Delhi and got attached the land of
owners/farmers "Commercial space land measuring 26,708.05 sq.ft. super built-up area situated in the project named
'Mahira Homes-103' situated in Sector-103 District Gurugram whereas M/s.Sai Aaina Farms Private Limited is separate

Kadipur is not cancelling GPA and SPA despite submitting plethora document and proofs on the subject matter.
