GOODS CARRIAGE PERMIT CONDITIONS (T.N.M.V.RULES, 1974)

1) It shall be a condition of every permit to use a goods carriage that the vehicle shall not be
used for the conveyance of any class of description of goods in contravention of any law or
any rules, by law or under may where under prohibition or regulating the import, export or
transport of such goods or for the conveyance of mica in
respect of which royalty have not been paid.
2) It shall be a condition of every permit to use a goods carriage that the vehicle shall be stopped
at a check post or chowky post whenever any clerks, traffic squads, Chowkidar or attendar
employed in such post calls upon the driver of vehicle to the vehicle and to keep it at rest for such
time as may be necessary to do enable him to make a reasonable examination of the contents of
the vehicle.
3) It shall be a condition of every permit of a goods carriage that unless otherwise permitted
in writing by the competant authority prescribed in the Rules, the vehicle shall not be loaded in
a manner likely to cause danger to any person or in such a manner that the load or any part
thereof or anything extends.

i) Laterally beyond the side of the body or beyond a vertical place in prolongation of
the side of the body;
ii) To the front beyond the foremost part of the vehicle;
iii)To the near beyond the nearmost part of the vehicle, excluding the luggage
carrier and;
iv) Height by a distance which exceeds 380 Cms. from the surface upon which
the vehicle rests.
4) It shall be a condition of the permit of every goods carriage that it shall always carry two
black and white painted cones with height of one metre and those base with a diametre of 60
Cms. with red reflector having goods reflectivity at the top to be readily available for being
placed on the road front and at the rear exterior in the off side of goods carriage whenever
such a vehicle has to be stationed on highways in case of any mechanical failure, break-downs
on accident on the roads where such standing before necessary as a measure of safety warning
to other road users. The two painted cones shall be placed on the ground whenever the vehicle is
at rest on the road under the above circumstances and shall be taken back when the vehicle
resumes its.
5) It shall be a conditon of the permit of every goods carriage trasporting any dangerous or
hazarduous goods that the goods shall be packed and transported in accordance with the rule
129 to 137 of the Central Motor Vehicles Rules, 1989.

GENERAL CONDITIONS ATTTACHED TO ALL PERMITS


Sec.84 of Motor Vehicles Act, 1988

6) The follownig shall be the conditions of every permit:


a) That the vehicle to which the permit relates carry valid cetificates of fitness issued
under Section 56 and is at all times so maintained as to comply with the requirements of this Act
and the rules made thereunder.
b) That the vehicle to which the permit relates is not driven at a speed exceeding the
speed permitted under this Act.

c) That any prohibition or restriction imposed and any fares or freight fixed by notification
made under Section 67 are observed in connection with the vehicle to which the permit relates.
d) That the vehicle to which permit relates is not driven in contravention of the
provisions of Section 5 of Sec. 113.

e) That the provision of this Act limiting the hours of work of drivers are observed in
connection with any vehicle or vehicles to which the permit relates, and

f) that the provisions of Chapter X, XI and XIII so far as they adopt to the holder of the
permit are observed.

g) that the name and address of the operator shall be painted or otherwise firmly affixed
to every vehicle to which the permit relates on the exterior of the body of the vehicle
on both sides the rate of in a colour or colours vividily contrasting to the colour of
the vehicle centered as high as practicable below the window line in bold letters
( T.N.M.V.Rules, 112)

7) It shall be a condition of every permit that the vehicle or vehicles specified in it shall
not be used on any public road after the period of prescribed in Rule 7 of the
Tamilnadu Motor Vehicles Taxation Rules, 1974 until such time the tax in respect of
such vehicle or vehicles has been paid in accordance with the provisions of the
Tamilnadu Motor Vehicles Taxation Act, 1974 (Tamilnadu Act 13 of 1974) and the
rules and notification issued thereunder;

8) It shall be a condition of every permit that the vehicle or vehicles specified in it shall
have a current valid certificate of fitness.

9) It shall be a condition of every permit to use a transport vehicle that there shall not be
prevent in the vehicle even when it is stationary and class or description of goods,
the conveyance of which contravenes any law or any rule by law order made
thereunder prohibition or regulating the import, export or transport of such goods or
mica for which royalty has not been paid.

10) It shall be a condition of every permit of a transport vehicle other than a motor car
that the dates of expiry of the permit and the certificate of fitness shall be exhibited
exteriorly on the left side of the body of the cabin in the case of goods carriage and
exteriorly on the left side of the body above the position of the rear left wheel and as
near the rear entrance as possible in the case of stage carriges in the manner
prescribed for verification of the vehicle in rule 93.

11) It shall be a condition of every permit of a transport vehicle that the vehcle shall
carry a first aid box containing the following articles.
i) a copy of the first aid leaf-let (ii) twenty four sterilized finger dressings (iii)
twelve sterilized hand or foot dressings; (iv) Twelve sterilized large body dressings;
(v) One extra large, two large and three small sterilized burn dressings; (vi) two
fifteen grams packets of sterilized cotton wool; (vii) a bottle of 2 percent tincture of
iodine; viii) A bottle of salvolatile; (ix) An empty bottle fitted with cork and hamel
hair brush for eye drop and (x) Fifty milli litres medicine glass;

12) It shall be a condition of the permit of every transport vehicle that the vehicle will be
so maintained as to available the service for which the permit was granted for the
entire period of currency of the permit and that the permit is liable to be suspended
after due notice to the permit holder of the vehicle if the vehicle has not been used
for the purpose for which the permit was granted for a continuous period of more
than ten days during the periods for which the permit authorise to use the vehicle on
the road unless the holder of the permit had obtained in writing the prior permission
of the Transport Authority to suspend the service of the vehcle for a specific period
exeeding fifteen days.

Provided that no holder of a permit shall ordinarily be granted permissin to suspend


the service of the vehicle for a continuous period exceeding twenty days at a time.

Provided that further the period may be extended by such further period or periods, as
the transport Authority thinks fit.

Provided also that the holder of a permit shall pay the fee prescribed in the table
under rule 279.

13) It shall be condition of every permit of a transport vehicle that the vehicle shall be
allowed or caused to be driven only by a duly qualified persons holding a valid
driving licence.

14) It shall be a condition of every permit of a transport vehicle, that the vehicle shall not
be allowed or caused to be allowed to carry any stolen property with the knowledge
that the same was stolen.

15) It shall be a condition of the permit that where temporay permit under Seciton 87 of
Special under Sub Section 98 of Section 88 is issued to a vehicle covered by the
permit of any of the conditions of the temporary permit or as the case may be the
special permit shall be deemed to be the breach of the conditions of the permit itself
and the said permit shall be liable for suspension or cancellation.

16) It shall be a condition of a permit of every transport vehicle that it shall always carry
four wooden chokes capable of preventing the motion of the vehicle when kept
stationary or on public road. The wooden chokes shall be used when the vehicle is
kept stationary and shall be taken back when the vehicle resumes its journey.
