D.Answer the following questions in brief.
Qs 1. Explain the Judicial Powers of the President of India.
Answer : The Judicial Powers of President of India are as follows: —
a) She / he appoints the Chief Justice of the Supreme court as well as the High courts
including their judges .
b) She / he can reduce,change, postpone the punishment awarded by a court on the
appeal of Mercy filed by the convicted person.

Qs 3.Differentiate between the real and the nominal executive of India.


Answer : The difference between the Nominal and Real Executive of India can be understood in
the following ways :
a ) The nominal executive of India is the President.
b) She / he is elected indirectly for 5 years by all the elected MPs and MLAs.
c,)All the important decisions are implemented in the name of the President .
d)She/ he exercises all the powers on the advice of the Prime Minister and the Council of
Ministers.
Real Executive
a) The Real Executive of India is the Prime Minister and the Council of Ministers.
b) They all are elected directly by all the Adult citizens of India for 5 years.
c )All the powers vested in the President are exercised by the Prime minister and its
Council of Ministers.

Qs 4 How can the President of India be removed and on what grounds ?

Answer : The President of India can be removed before the completion of its normal terms of 5
years through the Impeachment Motion passed by the Parliament by ⅔ majority, if she / he
violates the Constitution of India.

Qs 5.Describe the powers and functions of the Vice President of India.

Answer : The powers and functions of the Vice - President of India are following :----

a) She/ he acts
as the Chairman of Rajya Sabha .
b) She / he doesn't participate in voting to pass a bill except in case of a tie.
c) She /he acts as the President only for 6 months if the post is vacant due to the death ,
resignation or impeachment.
d) She /he is the Chancellor of the Central universities .

E .Answer the following questions.

Qs 1.How are the Council of Ministers appointed? What are its functions ?
Answer : The Council of Ministers are appointed by the President of India . An elected MP may
be appointed as a Council of Minister . A non MP may be appointed as a Council of minister but
she /he has to contest and win the election to become an MP within 6 months.

The functions of the Council of Ministers are as follows :

a) Formation of internal and external policy of the country.


b) Takes decisions regarding national and international matters
c) It runs the administration of the Union Government through the various ministries.
d) It makes laws and approves the annual budget of the country
Qs 2 .List any five powers and functions of the Prime Minister of India.
Answer: The Primer Minister of India performs certain powers and functions like :
a) Forms Council of Ministers
b) Presides over the Cabinet meetings as well as the Council of Ministers .
c) Coordinates the various departments.
d) Acts as a link between the President and the Cabinet.
e) Advises the President to summon, prorogue and to dissolve the Lok Sabha.
Qs 4 Describe the legislative and the financial powers of the President of India.
Answer : The President performs the following legislative functions —
a) Addresses the first session of the Parliament.
b) Summons,prorogues and dissolves Lok sabha on the advice of the Prime Minister.
c) Every bill becomes a law with her/his approval.
d) Money bill is presented in the Lok sabha with her / his prior approval .
e) Nominates 12 members in the Rajya Sabha.

Financial powers of the President are :


a) Appoints the members of the Finance commission.
b) Sanctions fund to government from the Contingency Fund .
c) Annual budget of the government and the Money bill as well presented with her / his
prior approval.
Qs4. Explain the three situations under which the President of India can proclaim emergency.
Answer : The President can impose Emergency Rule or President rule either in the whole
country or in a particular state in the following three situations :
a) National Emergency is imposed in the whole country in case of war , external aggression
or civil war .
b) Financial Emergency is imposed if there is a financial instability in the country.
c) Breakdown of Constitutional Machinery : If any of the state within the country is not
working as per constitution , President Rule is imposed there under Article 356.
