All: Almighty God, we stand in Your Holy Presence as our Supreme Judge. We humbly beseech
You to bless and inspire us so that what we think, say and do will be in accordance with Your will.
Enlighten our minds, strengthen our spirit and fill our hearts with fraternal love, wisdom and
understanding, so that we can become effective channels of truth, justice and peace. In our
proceedings today, guide us in the path of righteousness for the fulfillment of Your greater glory.

Rosales: For hearing, Criminal Case No. 1234-00, People of the Philippines v. Jovem Faller, for
violation of Section 5 of R.A. 9165.
Prosecutor Cabilin: Your Honor, my name is Atty. Jerra Ermie Cabilin, and I am representing the
People of the Philippines in this case.
Counsel Rollan: Your Honor, my name is Atty. Ameer Ryhane Rollan, and I am representing the
Accused in this case.
Interpreter: May I call on the witness stand, SPO2 GERALD KALAW. (Swear in the witness) Raise
your right hand. Do you swear to tell the truth the whole truth and nothing but the truth?
SPO2 Kalaw: I do. (witness goes to the stand and sits down)
Interpreter: Please state your name, age and other personal circumstances.
SPO2 Kalaw: My name is Gerald Kalaw. I live in Piapi, Dumaguete City, Negros Oriental. I finished
Bachelor in Criminology. I am presently working as a police officer stationed in Dumaguete City,
Negros Oriental.
Prosecutor Cabilin: Your Honor, we are offering the testimony of this witness to prove the
genuineness and due execution of the seizure receipt; to identify the accused in this case and
likewise to identify some documents to this case and to testify on such other matters as may be
relevant, Your Honor. With the permission of the Honorable Court, may we proceed your Honor?
Judge: Yes, you may proceed.
Prosecutor Cabilin: Mister witness, as mentioned in your Judicial Affidavit, you are one of the
arresting officers who arrested the accused in the person of Jovem Faller., is that correct?
SPO2 Kalaw: Yes, Ma’am.
Prosecutor Cabilin: Do you personally know the accused, Mr. Jovem Faller.?
SPO2 Kalaw: Yes, Ma’am.
Prosecutor CABILIN: Can you tell us why you personally know Mr. Faller?
SPO2 Kalaw: I am the one who personally arrested him during the buy-bust operation, Ma’am.
Prosecutor Cabilin: Is he here right now in this courtroom?
SPO2 Kalaw: Yes, Ma’am.
Prosecutor Cabilin: Can you point him?
SPO2 Kalaw: Yes, Ma’am, there he is right there. (pointing to Jovem)
Prosecutor Cabilin: How did you know that Mr. Faller was involved in the selling of illegal drugs
locally known as “shabu”?
SPO2 Kalaw: Days prior to the operation, a concerned citizen personally appeared before our office
and reported to our Team Leader (PCPT Marquez) regarding the involvement of the subject in illegal
drug activity.
Prosecutor Cabilin: What did you do upon receiving the said information?
SPO2 Kalaw: Our team leader directed one of our Intel Operatives to conduct a validation in order to
confirm the veracity of the information.
Prosecutor Cabilin: What was the result of the validation made by your Intel Operative?
SPO2 Kalaw: It was confirmed that the subject was indeed engaged in selling illegal drugs, further,
we got the subject’s identity and his way of selling illegal drugs.
Prosecutor Cabilin: When did you conducted the buy-bust operation?
SPO2 Kalaw: On July 20, 2020 at around 6:00pm, Ma’am.
Prosecutor Cabilin: Where did you conducted the buy-bust operation?
SPO2 Kalaw: In the residence of Mr. Faller, Ma’am in Barangay Lo-oc, Dumaguete City.
Prosecutor Cabilin: During the buy-bust operation, did you personally see that Mr. Faller was indeed
selling dangerous drugs?
SPO2 Kalaw: Yes, Ma’am.
Prosecutor Cabilin: What dangerous drugs were you able to see during the buy-bust operation?
SPO2 Kalaw: It was a shabu, Ma’am.
Prosecutor Cabilin: How many items were confiscated during the buy-bust operation?
SPO2 Kalaw: We found two transparent heat-sealed sachets containing white crystalline granules,
Ma’am.
Prosecutor Cabilin: Do you have with you the chemistry report from the said operation proving that
you found two transparent heated sachets containing white crystalline substance?
SPO2 Kalaw: Yes, Ma’am, I got a copy from the Negros Oriental Crime Lab of the Chemistry Report
No. A-551-20, Ma’am.
Prosecutor Cabilin: Can you show us the chemistry report?
SPO2 Kalaw: Here it is, Ma’am.
Prosecutor Cabilin: Your Honor, may we request to mark the Chemistry Report No. A-551-20 as
exhibit H?
Judge: Yes, mark it.

Prosecutor Cabilin: After arresting Mr. Faller, did you make an inventory of the seized illegal drugs?
SPO2 Kalaw: Yes, Ma’am.
Prosecutor Cabilin: Did you prepare a seizure receipt?
SPO2 Kalaw: Yes, Ma’am. I am the one who made the seizure receipt.
Prosecutor Cabilin: I have in me the copy of the seizure receipt marked as exhibit G. Can you
confirm if the signature in the lower right is your signature? (Shows to her the seizure receipt)
SPO2 Kalaw: (looks at the seizure receipt) yes, that is my signature, Ma’am.
Prosecutor Cabilin: Your Honor, may we request to mark as exhibit G-1 the signature of SPO2
Kalaw in this seizure receipt to confirm and affirm the genuineness and due execution of the seizure
order?
Judge: Yes, mark it.

correct?
SPO2 Kalaw: Yes, Sir.
Counsel Rollan: Is the inventory done at the place of the arrest?
SPO2 Kalaw: Yes, Ma’am.
Counsel Rollan: Is it made in the presence of the barangay chairman, the DOJ representative and
the media?
SPO2 Kalaw: Yes, Sir.
Counsel Rollan: Did the witnesses sign the inventory report?
SPO2 Kalaw: Yes, Sir.
Counsel Rollan: Did you remember taking photograph of the seized illegal drugs after the arrest?
SPO2 Kalaw: Yes, Sir.

Prosecutor Cabilin: Yes, Your Honor. Our second witness is Cristy Joy Maningo, the forensic
chemist in the Negros Oriental Crime Laboratory, Your Honor.
Rosales: May I call on the witness stand, Cristy Joy Maningo (Swear in the witness) Raise your right

Maningo: My name is Cristy Joy Maningo. I live in Dumaguete City, Negros Oriental. I finished
Bachelor of Science in Chemistry. I am currently working as a forensic chemist in Negros Oriental
Provincial Crime Laboratory.
Honorable Ubalde: I do. (witness goes to the stand and sits down)
Rosales: Please state your name, age and other personal circumstances.
Honorable Ubalde: My name is Edward Ubalde. I live in Barangay Lo-oc, Dumaguete City, Negros
Oriental. I am currently the Barangay Captain of Barangay Lo-oc, Dumaguete City.
Counsel Rollan: Your Honor We are offering the testimony of this witness to prove whether or not
the witness was indeed able to witness the arrest and the making of the inventory of the seized illegal
drugs and to testify on such other matters as may be relevant, Your Honor. With the permission of the
Honorable Court, may we proceed your Honor?
Judge: Yes, you may proceed.
Counsel Rollan: Honorable Ubalde, where were you on July 20, 2020 at around 6:00 pm?
Honorable Ubalde: I am staying in my house, Sir.
Counsel Rollan: Did you know of any buy-bust operation to be conducted by the police in your
barangay?
Honorable Ubalde: Yes, Sir.
Counsel Rollan: How did you know that there will be a buy-bust operation during that day?
Honorable Ubalde: Because I was informed by SPO2 Kalaw and I even attended the pre-operation
meeting together with the buy-bust team, the DOJ representative and a media representative.
Counsel Rollan: Did you personally see how Mr. Faller was arrested by the police officers?
Honorable Ubalde: No, Sir.
Counsel Rollan: Why were you not able to see the arrest of Mr. Faller?
Honorable Ubalde: Because I was late and when I went to the Police Station, SPO2 Kalaw just
handed over to me the Inventory Report and asked me to sign it.
Counsel Rollan: So, you mean, you signed the Inventory Report without witnessing the whole
operation?
Honorable Ubalde: Yes, Sir.
Counsel Rollan: For the record, Honorable Edward Ubalde signed the Inventory Report without
witnessing the whole operation. That would be all for this witness, Your Honor.
Judge: Prosecutor, do you wish to cross-examine the witness?
Prosecutor Cabilin: No, Your Honor.
Judge: Counsel, do you have any other witness?
Counsel Rollan: Your Honor, may we request that the examination of our second witness, Mr. Faller,
the accused be presented in the next scheduled hearing?
Judge: Alright, we call the testimonies of the witnesses. In today’s hearing, the prosecution
presented their witness SPO2 Kalaw and Forensic Chemist, Cristy Joy Maningo while the counsel for
the accused presented Honorable Edward Ubalde, the Barangay Captain of Barangay Lo-oc
Dumaguete City. In the next scheduled hearing dated November 21, 2020, the counsel will present
