Defendant’s Motion to Lessen the Severity of Criminal Liability from Parricide due to
Mitigating Circumstances
Defendant, Christine Vole, by and through her counsel, Mr. Wilfred Robarts, respectfully
requests this Honorable Court to quash her charges from Parricide. In pursuant to Circumstances
which mitigate criminal liability as found in paragraph 6 Article 13 of the Revised Penal Code.
In support thereof avers as follows:
1. The Plaintiff compelled the defendant to testify wrongfully in the trial court
by stating made-up facts in favour of the former.
2. The Plaintiff willfully, maliciously, and treacherously killed Ms. Mary Jane
French on October 14, 1957.
3. The Plaintiff has the motive of acquiring £80,000 pounds from the victim by
modifying the latter’s last will.
4. The Plaintiff has an existing illicit relationship with another woman that has
caused psychological violence to the Defendant prompting her to strike a blow to
the former’s abdomen with the use of a sharp knife that inflicted the fatal wound,
that without timely medical assistance resulted in the Victim’s fatality. The
Defendant’s acts falls under the circumstances which mitigates criminal liability
in pursuant to paragraph 6 Article 13 of the Revised Penal Code.
1. For the Court to consider the mitigating circumstances surrounding the accused, Christine
Vole’s actions, particularly her lack of intent to commit murder and her emotional
distress or duress at the time of the incident;
2. That the Court conduct a thorough evaluation of the credibility and relevance of the
prosecution’s witness testimony, particularly considering any inconsistencies or biases
that may affect its reliability;
3. That the Court considers the possible defenses available to the accused, Christine Vole,
leading to a verdict that reflects a fair assessment of her actions under the circumstances.
4. That the Court DISMISSED the charges against her due to lack of sufficient evidence.
