INDEMNITY BOND

BY THE PRESENT INDEMNITY BOND executed by us on this 4th day of August


2007 at Bangalore.

We 1) SRI.V.BHADRACHARI, S/o Late Veerappa, aged about 83 years,


2)SMT.ANNAPURNA, wife of Sri.V.Bhadrachari, aged about 72 years, both are
residing at No.226, 6th Cross, G.K.W.Extension, Vijayanagar, Bangalore-560 040,
3)SRI.K.RAJESH, son of Sri.Umashankar, aged about 32 years, 4)SMT.SHEELA.B.S.
wife of Sri.K.Rajesh, Aged about 28 years, both are residing at No.17, Venkateswara
Nilaya, 1st Main Road, Nehru Street, Udayanagar, K.R.Puram, Bangalore-560016,
hereinafter called obligors.

In favour of IDBI HOME FINANCE LTD., No.412, 1st Floor, Jindal Centre,
100ft, Road, IV Block, Koramangala, Bangalore-560 034, herein after called the oblige,
which expression shall mean and include its successors and legal representatives etc.,

Whereas, the Railway men’s House Building Co-operative Society Limited,


representated by its President, Sri.Shaik Rahiman and Secretary Sri.K.Chandrashekar
executed Deed of Allotment in favour of Sri.N.Girish Registered as Document
No.7003/2004-05, Book-I, Stored in C.D.No.184, dated 20.5.2004, in the office of the
Sub-Registrar, Bangalore North Taluk, in respect of Site bearing No.404, And in turn
Sri.N.Girish, executed Sale Deed in favour of Obligors 1 and 2 registered as Document
No.BLN-1-39589/2004-05, Book-I, Stored in C.D.No. BLND 94, dated 10.12.2004, in
the office of the Sub-Registrar, Bangalore North Taluk.

Whereas, Obligors 1 and 2 had given complaint to the Sub-Inspector. Vijayanagar


Police Station on 12.01.2007 for having lost the original Deed of Allotment dated
20.5.2004 and Possession Certificate dated 04.07.2004 pertaining to the property in
subject and Paper Publication was published in the daily English and Kannada
Newspaper ‘The times of India’ dated 20.05.2007, and 23.05.2007 respectively for
having lost the original documents pertaining to the property in subject. In spite of
diligent search they have not been found.

Whereas Obligors 1 and 2 have entered into Sale Agreement in favour of Obligors
3 and 4 on 8.5.2007.

Whereas we the Obligors do hereby agree to indemnify and keep indemnified the
oblige against all loss, charges, costs, and expenses, they may incur or suffer on account
of the title deeds relating to the said property being not handed over to the oblige or on
account of any claim being made against the said property or the oblige, On the basis of
the said title deeds or any of them being deposited as security or otherwise howsoever.

by the Railwaymen’s House Building Co-operative Society Ltd., In Sy.No.66/1, to 8, 69,
71, 81/1, 2, 4, 5, 87/4, to 20, 88/1 to 14, 88/16 to 21 situated at Mallathahalli Village,
Yeshwanthapura Hobli, Bangalore North Taluk, measuring East to West 40 feet and
North to South 30feet, totally measuring about 1200 Sq.ft. and bounded on:

North by :: Site No.405,
South by :: Site No. 403
