56th National Film Awards 2008 Regulations

SHORT TITLE AND COMMENCEMENT: 1. These regulations may be called the National Film Awards Regulations, and shall come into force with immediate effect.

AIMS: 2. The Awards aim at encouraging the production of films of aesthetic and technical excellence and social relevance contributing to the understanding and appreciation of cultures of different regions of the country in cinematic form, thereby also promoting integration and unity of the nation. DEFINITIONS: 3. In these regulations, unless the context otherwise requires, (a) Board means the Central Board of Film Certification; (b) Directorate means the Directorate of Film Festivals under the Ministry of Information & Broadcasting; (c) Awards mean National Film Awards; (d) Producer includes an individual producer, a production company, a Government Department or a Government recognized Institute and (e) Right Holder means the owner of the negative who is authorized to order prints of cinematographic films on the lab for a particular film. ORGANISERS 4. The Awards will be organized by the Directorate, or such other organization as may be notified from time to time, on behalf of the Government of India.

SECTIONS 5. The Awards will have the following sections:(i) Feature Films; and (ii) Non-Feature Films

AWARDS FOR FEATURE FILMS 6. The Awards that will be given in the Feature Films Section are given in Schedule I to these Regulations. 7. If the same film qualifies for more than one award from among the categories referred to at (i) to (x), (xxx) & (xxxi) of Schedule I, the producer and/or the director of the film will receive only the higher award, determined on the basis of the cash component. However, this will not debar the producer and/or the director from winning one of these awards for other films. AWARDS FOR NON-FEATURE FILM SECTION 8. The awards which will be given in the Non-Feature Films Section are given in Schedule II of these Regulations. DADA SAHEB PHALKE AWARD 9. In addition to the awards mentioned in Schedule I & II, the Government of India, at its discretion, will give an award called the Dada Saheb Phalke Award to a film personality for his/her outstanding contribution to the growth and development of Indian Cinema. The Award shall consist of a Swarna Kamal, a cash Prize of Rs.10, 00,000/- and a shawl. ELIGIBILITY 10 (a) Only those persons whose names are on the credit titles of the film and are normally residing and working in India shall be eligible for the Awards. The film should have been produced in India. In the case of co-productions involving a foreign entity, the following conditions should be fulfilled: (i) At least one of the co-producers must be an Indian entity. (ii) The Indian entity should be registered in India or a citizen of India (iii) The title of the film should be registered as an Indian film title. (iv) The Director should be an Indian national and the cast and technicians should be, predominantly Indian nationals. However, non-feature films directed by the foreign students of Film Institutes situated in India, will be eligible, if their entries are sent through their respective Institutes. (v) The negative should be available with the right holder in India to strike prints. (vi)The applicant should have the right for sanctioning participation of the film in festivals in India and abroad as an Indian entry as well as special expositions of Indian cinema organized by the DFF. (b) The film should have been certified by the Central Board of Film Certification between 1st January 2008 and 31st December 2008. (c) The Director of the film should be an Indian national.

(d) Films made in any Indian language, shot on 16 mm, 35 mm or in a wider gauge or digital format but released on a film format and certified by the Central Board of Film Certification as a feature film or featurette are eligible for feature film section. In the case of award for Best Childrens Film only such films shall be eligible as have been certified by the Central Board of Film Certification as Childrens films. The phrase any Indian language would mean all official languages of the State/Union Territories of the Indian Union, all other Indian languages included in Schedule VIII of the Constitution of India and such other languages and dialects that may be permitted by the Government of India from time to time. (e) Films made in any Indian language, shot on 16mm, 35mm or in a wider gauge or digital format and released on either film format or Betacam-SP (Broadcast quality format) and certified by the Central Board of Film Certification as a Documentary/Newsreel/Non-Fiction are eligible for non-feature film section. The phrase any Indian language would mean all official languages of the State/Union Territories of the Indian Union, all other Indian languages included in Schedule VIII of the Constitution of India and such other languages and dialects that may be permitted by the Government of India from time to time. f) The question whether a film is a feature film or non-feature film shall be decided by the Feature Film Jury and its decision shall be final. (g) Entries should preferably have sub-titles in English language. (h) All entries should be in the version certified by the Central Board of Film Certification, {as per Clause (d) AND Clause (e) above},

11. The following shall not be eligible for entry in the competition: (a) Dubbed/revised/copied/remade version of a film. (b) Performance of an artiste where his/her dialogues are dubbed by some other artist, for awards at Sl.(xi - (xv) of Schedule I. 11.1 Violation of provisions of the Copyright Act, if proved, will result in a bar on the entry of the film and/or result in cancellation of selection of the film for any award

12. Members of staff of the Organizers would not be eligible for the awards in any category. LAST DATE FOR RECEIPT OF ENTRY 13. Last date for receipt of the application along with the print, in the Directorate of Film Festivals, shall be 15th December, 2009.

PROCEDURE FOR ENTRY OF FILM 14. (a) A film shall be entered only by its producer. (b) A film can be entered for one or more awards in a section.

15. The producer should submit his/her entry in the Entry Form as in Schedule III, in duplicate. The form must be completed in all respects and should be accompanied by all the material mentioned in Regulation No.16, failing which the entry is liable to be rejected by the Directorate. Note A. The producer/production company shall ensure that the names indicated in the entry form tally with the credit titles appearing in the film. A certificate to this effect shall be furnished by the producer. Note B. While furnishing information in column 13 of the entry form, the Producer/Production Company should ensure that complete postal address, telephone number, mobile phone number, fax number, if any, is furnished. 16(1) Along with the Entry Form the following shall also be furnished by the Producer:(a) An undertaking in Schedule IV. (b) An undertaking in Schedule V. (c) A non-refundable entry fee of Rs.2, 500/- for feature film and Rs.750/- for non-feature film through a crossed Demand Draft in favour of Pay & Accounts Officer (MS), Ministry of Information and Broadcasting payable at the State Bank of India, New Delhi. (d) Two certified copies of certificate issued by the Central Board of Film Certification. (2) In the case of a feature film the following shall also be furnished along with the entry form:(a) Two copies of the synopsis in English or Hindi not exceeding 250 words. Synopsis in English or Hindi should also be e-mailed on [email protected]. (b) Two copies of English/Hindi translation of dialogue/commentary of films produced in a nonscheduled language or dialect. (c) Short biographical sketches of producer, director, screenplay writer, leading and supporting artists, cameraman, audiographer, editor, art director, costume designer, choreographer, special effects creator, lyricist, music director and playback singer ALONG WITH two photographs of each one of them AND four stills of the film (hard copies as well as by e-mail). Provided that if a film is being entered for specific award(s), biographical sketches and photographs should relate to the person who are to be considered for the award(s) for which entry has been made. (d) One copy of lyrics in original language along with one copy of English or Hindi translation and CD of songs of the films, if the producer desires his film to be considered for the Best Lyric award.

(3) In case of non-feature film, the following shall be furnished along with the entry form:(a) Two copies of the synopsis in English or Hindi not exceeding 200 words. Synopsis in English or Hindi should also be e-mailed on [email protected].

(b) Short biographical sketches of producer, director, cameraman, audiographer, editor, narrator, music director and animator (in case of animation films) ALONG WITH two photographs of each one of them AND four stills of the film (hard copies as well as by e-mail). (4) Print of the film. (5) An affidavit shall be furnished by the applicant on a stamp paper duly verified, declaring that the information furnished in the entry form and other related forms is true to the best of knowledge of the applicant; and in the case of films certified by the Central Board of Film Certification the print of the film being submitted as required under clause (4) above represents the original first CBFC certified version and that the applicant has not made any change whatsoever therein after original certification by the Central Board of Film Certification. (6) In the case of Non-Feature Films, the affidavit may also include in addition to the above: a) A declaration of originality for the music score. b) A declaration that the entire footage shot is original and due permissions have been obtained wherever stock footage has been used. c) A List of stock shots used with durations of each shot d) Certified copies of permissions obtained to use the stock footage. 17. Only the Film Federation of India (FFI) shall have the right to nominate films for the Award for best popular film providing wholesome entertainment (Sl. (iii) of Schedule I). The FFI shall nominate up to a maximum of 10 films for this award. For this purpose, the Film Federation of India shall obtain application in the prescribed form from the Producers concerned and forward those to the Directorate along with the print of the film and the material/information referred to in Regulation 16, before December 15, 2009. 18. The cost for sending the print/cassettes and other material, if any to the Directorate is to be borne by the entrant. All material should be sent by courier under intimation to NFA Cell. The dispatch details of the print such as the title of the film, number of reels/tapes/CDs, Courier Receipt number etc. should be communicated to the Directorate by fax or E-mail . The Directorate reserves the right to reject any entry if the print is not received by the prescribed date. The cost of the return freight will be borne by the Directorate. PROCEDURE FOR SELECTION 19. (a) The Awards shall be decided by two juries, one for feature films and other for nonfeature films, duly constituted by the Directorate with the approval of the Government of India. (b) The Jury for Feature films shall comprise a Chairperson and not more than 16 members distinguished in the field of cinema, other allied arts and humanities. (c) The Jury for Non Feature Films shall comprise a Chairman and not more than 6 members distinguished in the field of cinema, other allied arts and humanities. 20. (a) The juries will determine their own work procedure. (b) The Chairperson of the Feature Film Jury may constitute a maximum of four panels from amongst the members of the Jury.

(c) The Chairperson of the Non Feature Film Jury may constitute a maximum of two panels from amongst the members of the Jury. (d) Each panel will recommend not more than 33% of the films viewed by it for combined viewing by the full jury. (e) The jury shall have the right to recall not more than such percentage of total number of entries received as has been decided by the jury before the screening of films for the panels starts.

21.

The Chairpersons of the Juries may seek advice of experts in specialized areas, whenever necessary.

22 (a) Any person directly or indirectly associated with any of the entries for competition in feature or non-feature sections, shall not be eligible to serve on the jury. (b) Any person who is related either by blood or marriage to any of those whose work is to be adjudged shall not also be eligible to serve on the jury. (c) A person appointed as Chairperson or member of the Jury shall make a declaration in writing in the form given in Schedule VI to these regulations. 23. The quorum for the final deliberations of the jury, both for feature and non-feature films, shall be 75% of the members of the concerned jury and the Chairman. 24. The juries shall select the award winners and give their reports to the Directorate. 25. a) The juries shall have the discretion to recommend that an award in any particular category may not be given if they are of the opinion that the entries in that category are not of the required standard. b) THE DECISION OF THE JURIES SHALL BE FINAL AND NO APPEAL OR CORRESPONDENCE REGARDING THEIR DECISION SHALL BE ENTERTAINED. 26. The Director of the Directorate and/or his/her nominee may be present at the time of the deliberations of the juries only in order to provide information/clarifications, if any, required by the juries and not to participate in the deliberations.

GENERAL 27. The decision of the Government of India in respect of matters covered by these Regulations and of the Interpretation of these Regulations shall be final. 28. A person submitting an entry for the award shall be deemed to have accepted these Regulations.

29. 30. ARBITRATION Should any dispute or difference arise between the Producer and the Directorate, the same shall be referred to the Secretary, Ministry of Information and Broadcasting, Government of India, whose decision in the matter shall be final and binding on both the parties.

In the Feature Film Section, the following awards will be given: (i) Best Feature Film (a) Swarna Kamal and a cash prize of Rs.2,50,000/- to the Producer, and (b) Swarna Kamal and a cash prize of Rs.2,50,000/- to the Director. (ii) Indira Gandhi Award for best first film of a Director (a) Swarna Kamal and a cash prize of Rs.1,25,000/- to the Producer, and (b) Swarna Kamal and a cash prize of Rs.1,25,000/- to the Director. (iii) Award for best popular film providing wholesome entertainment (a) Swarna Kamal and a cash prize of Rs.2,00,000/- to the Producer, and (b) Swarna Kamal and a cash prize of Rs.2,00,000/- to the Director. (iv) Nargis Dutt Award for Best Feature Film on National Integration (a) Rajat Kamal and a cash prize of Rs.1,50,000/- to the Producer, and (b) Rajat Kamal and a cash prize of Rs.1,50,000/- to the Director. (v) Best Film on Family Values (a) Rajat Kamal and a cash prize of Rs.1,50, 000/- to the Producer, and (b) Rajat Kamal and a cash prize of Rs.1,50, 000/- to the Director. (vi) Best Social Film on social issues such as prohibition, women and child welfare, anti-dowry, drug abuse, welfare of the handicapped, etc. (a) Rajat Kamal and a cash prize of Rs.1,50,000/- to the Producer, and (b) Rajat Kamal and a cash prize of Rs.1,50,000/- to the Director. NATIONAL AWARD FOR THE BEST WRITING ON CINEMA REGULATIONS Short title and commencement: 1. These regulations may be called the National Award for the Best Writing on Cinema regulations and will come to force with immediate effect. Aims: 2. The awards aim at encouraging study and appreciation of cinema as an art form and dissemination of information and critical appreciation of this art-form through publication of books, articles, reviews etc. Definitions: 3. In these regulations, unless the context otherwise requires, Directorate means the Directorate of Film Festivals. Organizers: 4. The Award will be organized by the Directorate of Film Festivals (hereinafter referred to as the Directorate) or such other organizations as may be notified from time to time, on behalf of the Government of India. Awards: 5. The following awards will be given: Best Book on Cinema: ( a ) Swarna Kamal and a cash prize of Rs.. 75,000/- to the author / authors of the book in case of Joint authors, the cash prize will be equally divided among the recipients. ( b ) Swarna Kamal and a cash prize of Rs.. 75,000/- to the Publisher of the book. Best Film Critic: ( c ) Swarna Kamal and a cash prize of Rs. 75,000/-. Eligibility: 6. (1) Any book on Cinema published in India in any language between 1st January 2008 and 31st December 2008 (both days inclusive). (2) Translation, Abridgements and edited or annotated works are not eligible. (3) Anthologies of articles written by the same author, but published in a book form within the eligibility period are also eligible. (4) Entry of a book and/ or article written by any member of staff of the Organizers will not be permissible.

The award for Best Film Critic will be given to the best critic of the year for critical studies, reviews or articles on cinema published in Indian newspapers, magazines, and journals between 1st January 2008 and 31st December 2008 in any language.

Last date of receipt of entries: 8. The last date of receipt of entries for both the awards is the December 15, 2009.

Procedure for Entry: 9. Entry can be submitted in the case of Award for Best Book on Cinema, by its author or Publisher and in the case of Award for the Best Film Critic by the Critic himself or by the Publisher / editor of the Newspaper / Magazine / Journal provided that the award will be given only to the author / critic. 10. The author of the book should be an Indian citizen. 11. One of the publishers/companies should also be an Indian entity 12. The film critic must be a citizen of India. 13. Entries should be submitted to the Directorate in the entry form. 14. Books / articles can be recommended for consideration by the Directorate by the film societies affiliated to the Federation of Film societies of India, by the Film Federation of India, Sahitya Kala Academies or any recognized literary cultural organization with full address of the publisher / author. The Directorate may then contact such authors to enter their books/articles for consideration for the awards. If the publisher / author do not enter their works for the awards, these will not be considered by the Jury. 15. (1) In the case of entries for the Award for Best Book on Cinema, the following shall be furnished along with the entry form. (a) 5 copies of the book entered for the awards, along with the entry form; (b) 5 copies of brief summary of the book in English / Hindi; (c) Short biographical sketch of the author(s);and the publisher(s) English/ Hindi; (d) 2 recent photographs of the author/s); and (e) 2 sets of publicity material (if any). (2) The Directorate will reimburse the cost of the book, against submission of bills, if the entries are accepted. 16. In the case of entries for the award for the Best Film Critic, the following shall be furnished along with the entry form: (a) Clipping of the works, which should not be less than 5 and not more than 10 in number along with the names of newspapers etc. in which these were published and the dates/places of publications. Entry form must be accompanied by 5 copies of each clipping.

(b) Short biographical sketch of the critic in English/Hindi; and (c) 2 recent photographs of the critic. 9. A non-refundable entry fee of Rs.750/- per entrant (irrespective of the number of books or articles submitted) in the form of a cross Demand Draft in favour of Pay & Accounts Officer (MS), Ministry of I & B payable at the State Bank of India, New Delhi. Procedure for Selection: 18. (1) The awards will be decided by a jury for Best writing on Cinema to be constituted by the Government of India. (2) The Jury will consist of three members, including the Chairperson, distinguished in the field of literature, journalism and cinema. 19. The Chairperson of the Jury may seek assistance of person conversant with the language in which entries have been accepted. 20. (a) Any person directly or indirectly associated with any of the entries for competition shall not be eligible to serve on the jury. (b) Any person who is related either by blood or marriage to any of those whose work is to be adjudged shall not also be eligible to serve on the jury. (c) A person appointed as Chairperson or member of the Jury shall make a declaration in writing in the form given in Schedule I to these regulations.

21. The Jury will determine its own work procedure. 22. The Jury shall select the award winners and give its report to the Government of India. 23. The Jury will have the discretion to recommend that no award shall be given, if the book/articles/ reviews entered do not come up to the required standard. 24. The Government of India, after taking into account the number of books/articles entered in a particular language, may at its discretion, constitute small regional panels for that particular language to recommend books/articles, which can then be adjudged by the Jury for Best writing on cinema.

General: 25. The freight / postal charges for the entries will be borne by the entrants. 26. The decision of the Government of India in respect of matters not covered by these regulations shall be final. 27. A person submitting an entry for the award shall be deemed to have accepted these regulations. 28.
