MEMORANDUM OF AGREEMENT

KNOWN ALL MEN BY THESE PRESENTS:

This contract made and entered into this 30th day of October, 2024, by and between:

The J.H. CERILLES STATE COLLEGE, a public higher education institution under
the Republic of the Philippines with four-fold functions: instruction, production, research and
extension, represented by its College President, DR. EDGARDO H. ROSALES, with postal
address at JHCSC Dumingag Campus, hereinafter referred to as the State College;

-and-

The LOCAL GOVERNMENT UNIT OF DUMINGAG, ZAMBOANGA DEL SUR,


herein represented by its Municipal Mayor, HON. GERRY T. PAGLINAWAN;

WITNESSETH that:

WHEREAS, J.H. Cerilles State College envisions to become the leader institution in
the development of competent and skilled professionals that promote quality life of the people of
Zamboanga del Sur and in the region by undertaking partner linkages;

WHEREAS, Local Government of Dumingag is cognizant of the significant role of


upholding their duties in education, skills development, training and livelihood in their respective
municipal jurisdiction;

WHEREAS, J.H. Cerilles State College, through the School of Criminal Justice
Education (SOCJE) programs, thru Dr. Mark E. Patalinghug, Dean and Paulino R.
Tagaylo, PhD CJ the Driving Subject Instructor, with the goal of coordinating and giving
technical skills realize such mandates, enters into this collaboration with the Municipal Office
through this program called the SOCJE-TESDA SKILLS (SOCJE-TESDA) to make the target
beneficiaries TESDA Skilled;

WHEREAS, the general objective of this program is to create partnership with the Local
Government Unit. Hence, JHCSC-SOCJE under the Traffic Management Subject will educate
students with the traffic laws, rules and regulations. Consequently, the Municipal TESDA Office
will provide assistance on hands-on training and assessment schedule and processing. In
particular, the program will cater the young able-bodied students in Dumingag, Zamboanga del
Sur. These objectives will be carried out by conducting face-to-face meetings as to both parties’
availability.

WHEREAS, J.H. Cerilles State College considers this program as a humble initiative in
developing the technical skills anchored on the JHCSC Academic system wide program.

NOW THEREFORE, for and in consideration of the following premises, the parties
hereby jointly declared and agreed on the following, to wit:

RESPONSIBILITIES OF THE PARTIES

The following are the duties and responsibilities of the J.H. Cerilles State College:

1.1 Establish linkage with the concerned authorities to make the necessary arrangements
regarding the conduct of the different activities inclusive of the program;

1.2 Design and Spare Head of giving orientations by holding completion of requirements
via face-to-face sessions;

1.3 Conduct monitoring and evaluation on the progress and impact of the project;

1.4 Distribute certificates of completion and participation to all participants or


beneficiaries at the end of the project;

1.5 Provide transportation for project implementation, monitoring, and evaluation;

1.6 Assist the beneficiaries in the implementation of the project;

1.7 Ensure that the project implementation on the ground complies with the concerned
government agencies requirements; and

1.8 Provide efficient services necessary for the establishment and maintenance of the
project.

Section 2: The DTTS Dumingag, Zamboanga del Sur shall be responsible for the following:

2.1 Enhance the driving knowledge and skills of JHCSC students in preparation for their
assessment;

2.2 Provide pre-assessment assistance to JHCSC students in the form of supplemental


lectures and/or tips;

2.3 Provide a military jeep for use of the students during the pre-assessment practice
sessions, provided that the fuel to be used during the practice sessions shall be
defrayed by the student/s;

2.4 Provide the venue and facilitate the conduct of the assessment by TESDA Assessors
for JHCSC BS Criminology students for certification in Driving NC II;

2.5 Provide assessment services for JHCSC BS Criminology students at a cost of TWO
THOUSAND PESOS (₱2,000.00) per student, the same to be applied as follows:

1,034.00 Assessment Fee


966.00 Venue and Facilities fee

2.6 Provide the vehicle as well as fuel to be used during the assessment proper. Expenses
for the same shall be included in the above-indicated assessment fee to be paid by
each student;

Section 3. Miscellaneous Provisions

3.1 Both parties shall work collaboratively with the TESDA in the implementation of the
SKILLED program;

3.2 Ownership of any patentable or registrable material/model or research outputs shall


be governed by the Intellectual Property Code of the Philippines;

3.3 Any data produced in this engagement shall be treated in accordance with the R.A.
10173 (Data Privacy Act).

DURATION AND TERMINATION

It is understood that:

1. This MOA shall not be assigned to other parties in whole or in part, by either party,
without the prior written consent of the other party.

2. This agreement shall take effect upon signing by both parties and their witnesses, and
enforcement for the period of one (1) year thereafter.

3. This agreement represents the complete understanding of the parties and is intended to
supersede all previous agreements, written or verbal. This shall not be altered, amended
or modified except through a written agreement signed by both parties.
4. The terms and conditions of this Agreement and the performances thereafter shall be
construed and interpreted in accordance with applicable laws of the Republic of the
Philippines.
