The legislation present in India for Persons with Disabilities (PWD) includes various acts and laws that

aim to protect their rights, ensure equal opportunities, and promote inclusion. Some of the key
legislations are:

1. The Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation)
Act, 1995: This act provides a comprehensive framework for protecting the rights and securing
equal opportunities for persons with disabilities. It covers various areas such as education,
employment, social security, accessibility, and non-discrimination. The act also establishes the
National Disability Rights Commission to oversee the implementation of its provisions.

2. The Rights of Persons with Disabilities Act, 2016: This legislation repealed and replaced the 1995
act, expanding and strengthening the rights and entitlements of persons with disabilities. It
recognizes 21 categories of disabilities and mandates inclusion and accessibility across all areas
of life. The act covers aspects such as education, employment, healthcare, public transportation,
reservation in government jobs, and reasonable accommodation.

3. The Mental Healthcare Act, 2017: This act provides for the promotion and protection of mental
health rights and the provision of mental healthcare services. It aims to ensure that persons with
mental illnesses are treated with dignity, respect, and are not discriminated against. The act also
establishes mental health review boards in every state for the protection of rights of persons
with mental illness.

4. The Rehabilitation Council of India Act, 1992: This act regulates the training and standards for
professionals working in the field of rehabilitation and special education. It establishes the
Rehabilitation Council of India (RCI) to frame guidelines, coordinate programs, and maintain a
registry of qualified professionals. The RCI ensures the quality of rehabilitation services provided
to persons with disabilities.

5. The Accessible India Campaign (Sugamya Bharat Abhiyan): This initiative was launched by the
Government of India in 2015 to make public spaces and transportation disabled friendly. The
campaign aims to create accessible infrastructure, transportation systems, and websites to
enable easy and barrier-free access for persons with disabilities.

6. The National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation, and
Multiple Disabilities Act, 1999: This act provides a legal framework for the welfare of persons
with certain disabilities, their guardians, and service providers. It establishes the National Trust
to oversee the management of funds, schemes, and programs for persons with disabilities, and
their overall well-being.
