जबिक, Sahara Credit Cooperative Society Limited. म उ खाता सं या/रसीद सं या के जमाकता ी/ ीमती/
सु ी Rajiv Ranjan Tiwari का उ सिम त से रीफंड क मांग के लए, इस योजन हेतु िवक सत पोटल के मा यम से उ आवेदन ा
हुआ है।

जबिक, माननीय उ तम यायालय ने िपनाक पाणी मोहंती बनाम् सहका रता मं ालय के मा यम से भारत संघ ( रट या चका ( स)
सं. 2022 का 191 म ह त ेप ाथना सं. 2023 का 56308) मामले म अ य बात के साथ-साथ िन न ल खत िनदश िदया है:

"(i)Out of the total amount of Rs. 24,979.67 Crores lying in the "Sahara-SEBI Refund
Account", Rs. 5000 crores be transferred from "Sahara-SEBI Refund Account" to the Central
Registrar of Cooperative Societies who, in turn, shall disburse the same against the legitimate
dues of the depositors of the Sahara Group of Cooperative Societies, which shall be paid to the
genuine depositors in the most transparent manner and on proper identification and on
submitting proof of their deposits and proof of their claims and to be deposited in their respective
bank accounts directly.

(ii)The disbursement shall be supervised and monitored by Justice R. Subhash Reddy,

Former Judge of this Court with the able assistance of Shri Gaurav Agarwal, learned Advocate,
who is appointed as Amicus Curiae to assist Justice R. Subhash Reddy as well as the Central
Registrar of Cooperative Societies in disbursing the amount to the genuine depositors of the
Sahara Group of Cooperative Societies. The manner and modalities for making the payment is to
be worked out by the Central Registrar of Cooperative Societies in consultation with Justice R.
Subhash Reddy, Former Judge of this Court and Shri Gaurav Agarwal, learned Advocate."

जबिक, माननीय उ तम यायालय के उपयु व णत िनदेश के अनुपालन म सहारा समूह क सिम तय , अथात् (1) सहारा े डट
कोआपरेिटव सोसाइटी ल. (2) सहारायन यूिनवसल म टीपपज सोसाइटी ल. (3) हमारा इं डया े डट कोऑपरेिटव सोसाइटी ल. और (4)
टास मलटीपपज कोऑपरेिटव सोसाइटी ल (अब इसके बाद सामूिहक प से सहारा समूह क सहकारी सिम तयां' के प म संद भत) के
ामा णक जमाकताओं को धनरा श के संिवतरण के योजन के लए एक ऑनलाइन पोटल िवक सत िकया गया है।

जबिक, सहारा समूह क सहकारी सिम तय के ामा णक जमाकताओं को धनरा श क सुचा और पारदश संिवतरण के पयवे ण
के लए सहारा समूह क येक सहकारी सिम तय के लए िवशेष काया धका रय (OSDs) क िनयुि क गई है। रीफंड क यह संपूण ि या
भारत के माननीय उ तम यायालय ारा िनयु ः माननीय यायाधीश (सेवािनवृ ) आर. सुभाष रे ी के पयवे ण व िनगरानी म ी गौरव
अ वाल, यायिम क सहायता से एवं उनके ारा अनुमोिदत मानक संचालन ि या (एसओपी) के अनुसार क जा रही है।
 अतः, जमाकता ारा तुत दावे क िव भ तर पर जांच क गई और उसमे िन न ल खत किमयां पाई गय ।

Deficiency Intimation

Sub: Refund of legitimate dues to the genuine depositors of Sahara Group of Cooperative
Societies in compliance of Supreme Court's Order dated 29.03.2023 in IA No.56308 of
2023 in WP (C) No. 191 of 2022- reg.

WHEREAS, an application was received from Shri/ Smt. Rajiv Ranjan Tiwari, depositor of
Sahara Credit Cooperative Society Limited. for seeking refund from the above Society for above
mentioned Membership /Account /Receipt number through the portal developed for the purpose.

WHEREAS, Hon'ble Supreme Court vide Order dated 29.03.2023, in the matter of Pinak
Pani Mohanty Versus Union of India through Ministry of Cooperation (IA No.56308 of 2023 in WP
(C) No. 191 of 2022) has inter alia directed the following:

"(i)Out of the total amount of Rs. 24,979.67 Crores lying in the "Sahara-SEBI Refund
Account", Rs. 5000 crores be transferred from "Sahara-SEBI Refund Account" to the Central
Registrar of Cooperative Societies who, in turn, shall disburse the same against the legitimate dues
of the depositors of the Sahara Group of Cooperative Societies, which shall be paid to the genuine

WHEREAS, in compliance to the aforementioned directions of the Hon'ble Supreme Court,

a Portal has been launched for the purpose of disbursement of amount to the genuine depositors of
Sahara Group of Cooperative Societies i.e. (1) Sahara Credit Cooperative Society Ltd; (2) Saharayn
Universal Multipurpose Society Ltd; (3) Humara India Credit Cooperative Society Ltd and (4) Stars
Multipurpose Cooperative Society Ltd. (hereinafter collectively referred to as "Sahara Group of
Cooperative Societies").
 THEREFORE, to oversee the smooth and transparent disbursement of amount to genuine
depositors of Sahara Group of Cooperative Societies, Officers on Special Duty (OSDs) have been
appointed for each one of the Sahara Group of Cooperative Societies. The entire process of refund is
being carried out under the supervision and monitoring of Hon'ble Justice (Retd.) R. Subhash Reddy,
with the assistance of Shri Gaurav Agrawal, Amicus Curiae as appointed by Hon'ble Supreme Court
of India.

WHEREAS, the claim filed by the depositor has been examined at various levels and
following deficiencies have been noticed:

The depositor is advised to rectify above deficiencies as found in his/her claim form and re-
apply through the portal along with requisite documents after rectification of deficiencies noted
above and if necessary get in touch with the Sahara Group of Cooperative Societies to rectify the
above deficiencies.
