Ompoc, “kokong for violation of Sec. 5 and 11 of RA 9165. Committed as follows: That on or about 2200H

of October 5, 2024 at the abandoned building , Purok 2, Barangay Jampason, Initao Province of Misamis

Oriental, Philippines and within the Jurisdiction of this Honorable Court, the said accused not being

authorized by law, did then and there, willfully, unlawfully and feloniously sell and found to have sold to

P02 Clyde Ian Lee C Bahian three (3) sachets weighing zero point one two three four (0.1234) grams of

methamphetamine Hydrochloride commonly known as shabu a dangerous drug.

about 7pm at abondoned building, Purok 2, Barangay Jampason, Initao Misamis Oriental, the said accused,

did then and there, willfully, unlawfully and feloniously sell and found to have sold to P02 Clyde Ian Lee C

Bahian three (3) sachets weighing zero point one two three four (0.1234) grams of methamphetamine

Hydrochloride commonly known as shabu a dangerous drug.

Roa, the team leader who oversaw the operation leading to the accused's arrest, PCpl. Clyde Ian Bahian, the

undercover officer who allegedly purchased the illegal substance from the accused and apprehended the

accused, Forensic Chemist confirming the methamphemine is real Mr. Ruel Defamante, the Barangay

Captain of Barangay Jampason, Mr. Allan Cabresos, a media representative.

and Mr. Art Jesun Sabaldana, the cousin of the accused.

PUBLIC PROSECUTOR: Your honor, we present the following documentary evidence, object evidence

and mark as prosecution’s exhibits:


EXHIBIT :

As Exhibit “A” Mark Money - This is the mark money that use in the test buy in the buy-bust

operation.

As Exhibit “B” Affidavit of the Team Leader - is a sworn statement from the arresting officer

detailing the execution of the planned in buy bust operation.

As Exhibit “C” Affidavit of Pusher Buyer or Arresting Officer - is a sworn statement from the

undercover officer who bought the drugs, outlining the buy-bust operation and detailing the events and

reasons for the arrest.

As Exhibit “D” - Contains three(3) sachets of methamphetamine

Exhibit D (1) weighing 0.65grams,

Exhibit D (2) 0.60grams, and

Exhibit D (3) 0.66grams respectively. These sachet were found in a small plastic bags, which was

located in the defendant`s possession. The total weight of the methamphetamine in Exhibit D is 1.91grams.

As Exhibit “E” - is a physical chemistry report of forensic chemist confirming the substance is

methamphetamine and detailing its purity.

As Exhibit “F” - is an inventory list of all items seized during the operation, including the drugs

and other possessions found with the suspect.

11 of RA. 9165

JUDGE: Appearances!

PUBLIC PROSECUTOR: Your honor, my name is Atty. Ronnel Ratunil, and I am representing the

People of the Philippines in this case.

DEFENSE COUNSEL: Your honor, my name is Atty. Kimberly Jane Hokoman, and I am representing the

accused in this case.

JUDGE: Is the prosecution ready?

PUBLIC PROSECUTOR: (stand up) Ready for the People of the Philippines, Your Honor.

DEFENSE COUNSEL: (stand up) Ready for the defense, Your Honor.

JUDGE: Does the prosecution wish to call any witnesses?

PUBLIC PROSECUTOR: Yes, Your Honor. For the prosecution, we are ready to present our first witness,

PMSg Juvany Roa. The team leader of the buy bust operation, Your Honor.

INTERPRETER: May I call the witness stand, PMSg. Juvany Roa. (at this time, the witness will

stand/Swear the witness), Raise your right hand. Do you swear to tell the whole truth and nothing but the

truth?

TEAM LEADER: I DO. (witness go to stand and sit down)

INTERPRETER: Please state your name, age and other personal circumtances for the record.

TEAM LEADER: My name is Juvany Roa, 35 years old, living at Poblacion, Initao and I am presently

working as Police Officer at Initao Municipal Police Station.

INTERPRETER: The Witness is ready.

PUBLIC PROSECUTOR: Your honor, we are offering the testimony of this witness to prove the

genuineness and due execution of the buy-bust operation; to identify the accused in this case and to testify

on such other matters as may relevant, You Honor. With the permission of the Honorable Court, may we

proceed you honor?

JUDGE: Yes, you may proceed.


(at this point, the public prosecutor will ask some questions to the team leader).

PUBLIC PROSECUTOR: Sir witness, can you please describe the planning and execution of the buy-bust

operation?

TEAM LEADER: Yes, your honor. I briefed my team on the operation that evening. We received

information about a drug transaction taking place in the abandoned building. PO2 BAHIAN was assigned as

the undercover officer, and he confirmed the details with the confidential informant. We coordinated with

the media and Barangay officials for their support and presence during the operation. My team was

positioned strategically in the area to apprehend the suspect after the transaction.

PUBLIC PROSECUTOR: Team Leader ROA, can you please confirm that the Three (3) sachet of

methamphetamine was found in the possession of accused was properly marked and properly collected and

documented?

TEAM LEADER: Yes, your honor. PO2 BAHIAN marked the Three (3) sachet of methamphetamine with

his initials, and all evidence was collected and documented according to standard procedures. We

photographed the evidence and the suspect at the scene, and PO2 BAHIAN prepared the receipt/ inventory

for property seized, which was signed by the Barangay captain and media representatives.

PUBLIC PROSECUTOR: I have nothing further, Your Honor.

JUDGE: Cross? Atty. Hokoman

DEFENSE COUNSEL: Yes your honor “Your honor, request permission to proceed”

JUDGE: “Proceed”

CROSS EXAMINATION

(at this part, it’s time for the defense counsel to ask question to the witness)

DEFENSE COUNSEL: Good afternoon Mr. Witness.

TEAM LEADER: Good afternoon, Attorney.

DEFENSE COUNSEL: Sir witness, can you describe the specific details of the information you received

about the drug transaction? Was it a reliable source?


TEAM LEADER: The information was received from a confidential informant who claimed to have

witnessed the accused selling drugs at the abandoned building. We were unable to independently verify the

informant's identity or the specifics of the transaction before deploying the team.

DEFENSE COUNSEL: Did this informant have any prior dealings with the police? Was their information

accurate in the past?

TEAM LEADER: The informant has provided information to the police in the past, and it has proven to be

reliable. However, due to the confidential nature of the informant's identity, I cannot disclose further details.

DEFENSE COUNSEL: Can you describe the chain of custody for the three sachets of methamphetamine?

Who handled them and when? Was there any opportunity for tampering or contamination?

TEAM LEADER: The three sachets were immediately marked by PO2 Bahian with his initials and placed

in a sealed evidence bag. The bag was then placed in a larger container, which was locked and transported to

the police station. The chain of custody is documented in the inventory list, which was signed by all officers

involved.

DEFENSE COUNSEL: Did you have any prior knowledge or prejudice against the accused? Were you

motivated to ensure his arrest?

TEAM LEADER: I had no prior knowledge of the accused and no personal motivation to ensure his arrest.

My primary concern was to uphold the law and protect the community from illegal drug activity.

DEFENSE COUNSEL: That would be all, your honor.

(This time the first witness is done)

JUDGE: Who is your next witness?

PUBLIC PROSECUTOR: Our second witness, Your Honor, is the Arresting Officer PCpl. Clyde Ian Lee

Bahian.

INTERPRETER: May I call the witness stand, PCpl. Clyde Ian Lee Bahian (at this time, the witness will

stand/Swear the witness), Raise your right hand. Do you swear to tell the whole truth and nothing but the

truth?

ARRESTING OFFICER: I DO. (witness go to stand and sit down).

INTERPRETER: Please state your name, age and other personal circumstances.
ARRESTING OFFICER: My name is Cyde Ian Lee Bahian, 32 years old, and I've been a police officer

for 6 years. I'm currently assigned at Initao Municipal Police Station.

INTERPRETER: The Witness is ready.

PUBLIC PROSECUTOR: "Your Honor, we would like to offer the testimony of Mr. Bahian to prove that

the defendant was properly arrested and that the evidence obtained during the arrest was legally admissible.

You Honor. With the permission of the Honorable Court, may we proceed you honor?”

JUDGE: Yes, you may proceed.

(at this point, the public prosecutor will ask some questions to the team leader).

PUBLIC PROSECUTOR: Mr. Bahian, we where you on October 05, 2024?

ARRESTING OFFICER: I was in my office in Initao MPS with my team to briefed on the operation that

evening together with our Team Leader PCpl Roa. We received information about a drug transaction taking

place in the abandoned building. I was assigned as the undercover officer and apprehending officer, and i

confirmed the details with the confidential informant and we prepared for the buy bust operation.

PUBLIC PROSECUTOR: What happened next?

ARRESTING OFFICER: I went to the said location in abandoned building and my team was positioned

strategically in the area to apprehend the suspect after the transaction.

PUBLIC PROSECUTOR: So you went their in abandoned building, what happened? did you see

anything?

ARRESTING OFFICER:Yes i saw the accused that hes talking to someone.

PUBLIC PROSECUTOR: What happened next when you saw the accused?

ARRESTING OFFICER: I follow our planned in buy-bust operation to approach the accused that i will

buy or do the test buy, using the Php. 500 peso bill.

PUBLIC PROSECUTOR: Your honor this is the Php. 500 peso bill with markings, Is this the Php. 500

peso bill that your talking about?

ARRESTING OFFICER: Yes Atty.

PUBLIC PROSECUTOR: Whose markings is this?

ARRESTING OFFICER: Mine Atty.


PUBLIC PROSECUTOR: We offered this mark money your honor for purpose of proving that this is the

same mark money use for the test buy. Mark as exhibit A.

PUBLIC PROSECUTOR: Mr. Bahian, What happened after the test buy?

ARRESTING OFFICER: I handled the money and then as plan I will remove my cap once the test buy

has complete.

PUBLIC PROSECUTOR: So what happened next?

ARRESTING OFFICER:After that we arrested the accused it proves that the test buy was completed and

we apprehended the accused.

PUBLIC PROSECUTOR: What happened next?

ARRESTING OFFICER: After, we conducted inventory we found three (3) sachet of shabu, and we put

markings.

PUBLIC PROSECUTOR: Okay, is this the shabu that you found in the accused?

ARRESTING OFFICER: Yes atty.

PUBLIC PROSECUTOR: Whose marking is this?

ARRESTING OFFICER: Mine Atty.

PUBLIC PROSECUTOR: We offered this three (3) sachet of shabu your honor for purpose of proving that

this is the shabu that found on the accused. Mark as exhibit D.

PUBLIC PROSECUTOR: Who is with you during inventory?

ARRESTING OFFICER: The Barangay Captain was there and Media representative was there in the

person of Mr. Ruel Defamente and Mr. Allan Cabresos.

PUBLIC PROSECUTOR: What happened after the inventory?

ARRESTING OFFICER: After conducted the inventory, i handed to Investigating Officer for the proper

inventory for turn over to the forensic chemist.

PUBLIC PROSECUTOR: Thank you, Officer Bahian. That's all I have for you. I have nothing further,

Your Honor.

DEFENSE COUNSEL: "Thank you, Officer Bahian, for your testimony. You mentioned that you were part

of a team positioned to apprehend the suspect after a buy-bust operation. Can you tell the court what your

specific role was in this operation?"

ARRESTING OFFICER: "I was assigned to be the arresting and undercover officer, Atty. My role was to

approach the defendant, identify myself, and place him under arrest."

DEFENSE COUNSEL: Do you said that the confidential informant informed you that the accused sells

illegal drugs?

ARRESTING OFFICER: Yes Atty.

DEFENSE COUNSEL: Do you believe the information from confidential informant?

ARRESTING OFFICER: Yes Atty.

DEFENSE COUNSEL: You're saying that, your investigation was based the information given to you by

the confidential informant?

DEFENSE COUNSEL: By just receiving the information that the accused is selling you already conducted

the operation because of that?

DEFENSE COUNSEL: You said that your operation started at 10pm in the evening, So are you saying that

the Barangay Captain and Media representatives was there at 10pm in the evening at Jampason, Initao??!!

ARRESTING OFFICER: Yes Atty.

DEFENSE COUNSEL: You’re saying that during the inventory, the Elective Officials is present?

ARRESTING OFFICER: Yes Atty.

DEFENSE COUNSEL: Can you describe the search conducted on the accused? Was it conducted lawfully

and with the proper procedures? Did the accused consent to the search?
ARRESTING OFFICER: The search was conducted with the accused's consent, and he was informed of

his rights. The search was limited to the immediate area where the accused was apprehended and focused on

recovering the drugs.

PUBLIC PROSECUTOR: Our third witness, Your Honor, is a Forensic Chemist, Mr. Juvany Roa

INTERPRETER: May I call the witness stand, Mr. Juvany Roa (at this time, the witness will stand/Swear

the witness), Raise your right hand. Do you swear to tell the whole truth and nothing but the truth?

FORENSIC CHEMIST: I DO. (witness go to stand and sit down).

INTERPRETER: Please state your name, age and other personal circumstances.

FORENSIC CHEMIST: My name is Juvany Roa, I am 35 years old. I live in Initao, Misamis Oriental, and

I have been working in a crime laboratory for almost 7 years.

INTERPRETER: The Witness is ready.

PUBLIC PROSECUTOR: Your Honor, we would like to offer the testimony of Mr. Roa to prove that the

methamphetamine he examined is real, it was tested using scientific methods, and those tests confirm it's the

real thing. You Honor. With the permission of the Honorable Court, may we proceed your honor?

JUDGE: Yes, you may proceed.

(at this point, the public prosecutor will ask some questions to the forensic chemist).

PUBLIC PROSECUTOR: Mr. Roa, can you please tell the court about your qualifications and experience

as a forensic chemist?

FORENSIC CHEMIST: Your Honor, I have a Bachelor of Science degree in Chemistry and I have been

working as a forensic chemist for PNP Crime Laboratory the past 7 years. I am proficient in conducting

chemical analyses of various substances, including controlled drugs.


PUBLIC PROSECUTOR: Mr. Roa, you received the three sachets of suspected methamphetamine from

the arresting officer, PCpl. Bahian, right?

FORENSIC CHEMIST: Yes Atty.

PUBLIC PROSECUTOR: Can you please describe the process you followed to analyze the substance?

FORENSIC CHEMIST: I conducted a series of tests, including a presumptive test and a confirmatory test

using GC-MS, FTIR. The presumptive test indicated the presence of methamphetamine, and the

confirmatory test confirmed the presence and purity of methamphetamine.

PUBLIC PROSECUTOR: Did your analysis confirm that the substance in the three sachets was indeed

methamphetamine?

FORENSIC CHEMIST: Yes, Your Honor. My analysis confirmed that the substance in the three sachets

was methamphetamine.

PUBLIC PROSECUTOR: Can you please describe the weight and purity of the methamphetamine you

analyzed?

FORENSIC CHEMIST: The total weight of the methamphetamine in the three sachets was 1.91grams.

The purity of the methamphetamine was higher-grade methamphetamine.

PUBLIC PROSECUTOR: Mr. Roa, can you please explain the significance of your findings?

FORENSIC CHEMIST: My findings confirm that the substance submitted for analysis was indeed

methamphetamine, a dangerous drug prohibited under Republic Act 9165.

PUBLIC PROSECUTOR: Thank you, Mr. Roa. I have no further questions.

BARANGAY CAPTAIN: My name is Ruel Defamente, 50 years old and I have been the Barangay Captain

of Jampason for the past three years.

INTERPRETER: The witness is ready.

PUBLIC PROSECUTOR: Your Honor, we are offering the testimony of Mr. Defamante to corroborate the

account of the arresting officer, PCpl. Bahian, regarding the presence of barangay officials during the buy-

bust operation and the subsequent inventory. With the permission of the Honorable Court, may we proceed,

Your Honor?

JUDGE: Yes, you may proceed.

PUBLIC PROSECUTOR: Sir witness, can you please describe the planning and execution of the buy-bust

operation?

BARANGAY CAPTAIN: Yes, your honor. I received a call from the police about a planned buy-bust

operation in our barangay. They informed me about the operation and asked for my presence as a witness. I

went to the abandoned building where the operation was taking place, and I witnessed the arrest of the

accused, Mark Angelo Ompoc.

PUBLIC PROSECUTOR: Sir witness, can you please confirm that you were present during the inventory

of the seized items?

BARANGAY CAPTAIN: Yes, your honor. I was present when the police conducted the inventory of the

seized items, including the three sachets of methamphetamine. I signed the inventory list as a witness.

PUBLIC PROSECUTOR: I have nothing further, Your Honor.

DEFENSE COUNSEL: Good afternoon Mr. Witness.

BARANGAY CAPTAIN: Good afternoon, Attorney.

DEFENSE COUNSEL: Sir witness, you mentioned that you were present at the abandoned building during

the buy-bust operation. Can you tell the court what time you arrived at the scene?

BARANGAY CAPTAIN: I arrived at the abandoned building at around 10:30 pm, Attorney.

DEFENSE COUNSEL: Can you describe the lighting conditions at the abandoned building at that time?

Was it well-lit or dark?

BARANGAY CAPTAIN: The area was poorly lit, Attorney. There were no streetlights in the area, and the

only light source was the flashlight used by the police officers.

DEFENSE COUNSEL: Sir witness, you mentioned that you witnessed the arrest of the accused. Can you

describe what you saw?

BARANGAY CAPTAIN: I observed the police officers approaching the accused and placing him under

arrest. I also saw the police officers recovering three sachets of suspected methamphetamine from the

accused.

DEFENSE COUNSEL: Sir witness, you mentioned that you signed the inventory list. Can you tell the

court if you had the opportunity to examine the seized items before signing the list?

BARANGAY CAPTAIN: I did not have the opportunity to closely examine the seized items before signing

the list, Attorney. I was there as a witness to the inventory process, but I did not personally inspect the items.

DEFENSE COUNSEL: Sir witness, can you tell the court if you were familiar with the accused before the

buy-bust operation?

BARANGAY CAPTAIN: I was not acquainted with the accused before the buy-bust operation, Attorney.

representative during the buy-bust operation?

informed me about the planned buy-bust and asked for my presence to ensure transparency.

accused, Mark Angelo Ompoc?

MEDIA REPRESENTATIVE: I arrived at the abandoned building shortly before the arrest. I observed the

police officers conducting the buy-bust operation, including the exchange of money and the subsequent

arrest of the accused.

PUBLIC PROSECUTOR: Were you present during the inventory of the seized items?

MEDIA REPRESENTATIVE: Yes, Your Honor. I was present when the police conducted the inventory

of the items seized from the accused, including the three sachets of suspected methamphetamine.

PUBLIC PROSECUTOR: Can you please describe the inventory process? What steps were taken to

ensure the integrity of the evidence?

MEDIA REPRESENTATIVE: The police officers carefully documented each item, including the three

sachets. They marked each sachet with their initials and placed them in sealed evidence bags. The entire

process was conducted in a transparent manner, and I was given the opportunity to observe and record the

details.

during the inventory process?

MEDIA REPRESENTATIVE: No, Your Honor. I did not witness any irregularities or deviations from

MEDIA REPRESENTATIVE: Good afternoon, Attorney.

DEFENSE COUNSEL: You mentioned that you were invited by the police to witness the buy-bust

operation. Can you tell the court how you were contacted and what information you were given about the

operation before arriving at the scene?

MEDIA REPRESENTATIVE: I received a call from a police officer who informed me about the

operation and requested my presence as a witness. They provided me with a brief overview of the operation,

including the location and the target.

DEFENSE COUNSEL: Can you confirm that you were not present during the actual buy-bust transaction

itself?

MEDIA REPRESENTATIVE: That is correct, Attorney. I arrived at the scene shortly before the arrest.

DEFENSE COUNSEL: You mentioned that you observed the inventory process. Can you describe the

lighting conditions at the scene where the inventory was conducted? Was it well-lit or dark?

MEDIA REPRESENTATIVE: The area was poorly lit, Attorney. There were no streetlights, and the only

light source was the flashlight used by the police officers.

DEFENSE COUNSEL: Did you have the opportunity to examine the seized items yourself before they

were placed in the evidence bags?

MEDIA REPRESENTATIVE: I did not have the opportunity to personally examine the items before they
were placed in the evidence bags, Attorney. I was observing the process, but I did not physically handle the

items.

As Exhibit “A” Mark Money - to prove the actual money used in the test buy and that it was the same

money recovered from the accused after the transaction.

As Exhibit “B” - Contains three(3) sachets of methamphetamine- to prove that the substance seized from

the accused was indeed methamphetamine and that it was found in his possession.

As Exhibit “C” Affidavit of Pusher Buyer or Arresting Officer - to prove the details of the buy-bust

operation, the events leading to the arrest, and the reasons for apprehending the accused.

As Exhibit “D” Affidavit of the Team Leader - to prove the planning and execution of the buy-bust

operation, the team's actions, and the information received that led to the operation.

As Exhibit “E” - is a physical chemistry report to prove that the substance analyzed was indeed

methamphetamine, confirming its identity and purity.

As Exhibit “F” - is an inventory list of all items seized during to prove that the inventory process was

conducted properly, with the presence of witnesses, and that the seized items were documented and

accounted for.

And also your honor, we are offering the testimony of PMsg. Roa, PCpl. Bahian, Forensic Chemist,

Barangay Captain, and Media Representatives to prove the genuineness and due execution of the buy-bust

operation, the chain of custody of the evidence, the identification of the accused, and the legitimacy and

transparency of the procedures followed, ultimately establishing a strong case for the guilt of the accused.

ACCUSED: My name is Mark Angelo Ompoc, 45 years old, living at Jampason, Initao and my job is a

construction worker and I have 2 kids.

accusations against the defendant are unfounded and based on misunderstandings, Your Honor. With the

ACCUSED: He invited me to celebrate their town fiesta in Lugait.

DEFENSE COUNSEL: Can you tell the court what you did during the fiesta celebration?

ACCUSED: Yes, we had dinner, watched some performances, and played some games. It was a lot of fun.

DEFENSE COUNSEL: Did you leave your cousin's house that night?

ACCUSED: Yes, I left around midnight and went back to my house in Initao.

DEFENSE COUNSEL: Do you have any proof that you were at your cousin's house that night?

ACCUSED: Yes, I have a picture of me with my cousin and some other relatives at the fiesta. I can show it

SABALDANA: My name is Art Jesun Sabaldana, 38 years old and I currently live in Lugait Misamis

Oriental.

DEFENSE COUNSEL: Your Honor, we are offering the testimony of Mr. Sabaldana to corroborate the

defendant's account. We believe his testimony will support the defendant. With the permission of the
