ABOUT THE COLLEGE

Smt. Velagapudi Durgamba Siddhartha Law College, Vijayawada is a


renowned and leading centre of Legal Education and Research in the
State of Andhra Pradesh. Established in 1987 by the Siddhartha
Academy of General and Technical Education in Vijayawada as well
as affiliated to Krishna University, A.P and recognized by the Bar
Council of India , the institution offers U.G, P.G and Ph.D programmes
in the discipline of law. The college maintains a holistic education
approach and strives to groom approximately 1050 students every
year as professionally competent and socially relevant legal
professionals with the help of its state-of-the-art infrastructure,

Our campus, spanning 10,674 square meters along National Highway
No: 9 in Kanuru, in a sprawling premises in the city of Vijayawada,
which is proximate to the capital of State of Andhra Pradesh and is
well connected by road, rail and air transport facilities and therefore
easily accessible for the competetiors to reach even from distant
places.
ABOUT THE LEGAL FEST
With the background of 2 national legal festivals organized successfully on previous
occasions, the college is now hosting 3rd National Legal Festival-2024, to be held from
20/12/2024, covering Moot Court Competiton and Legal Quiz. The Moot Court competition, a
highlight of this fest, provides a platform for law students to hone their advocacy skills and
engage in simulated court proceedings. Participants will present their arguments on a novel
and complex legal problem before a panel of esteemed judges, displaying their legal
acumen, and harnessing research abilities & oratory skills. This event is designed to foster
critical thinking and practical legal knowledge, offering students an invaluable opportunity to
apply theoretical concepts in a courtroom setting.
MOOT COURT PROPOSITION

ZENITH TECH – a renowned multinational company with business operations


across the world, including the Republic of Indica, has developed a
fascinating and advanced Generative Artificial Intelligence. This AI is
endowed with an in-built mechanism to conceive, visualize, design, plan, and
execute tasks independently. The company proudly proclaimed that its
Generative Artificial Intelligence has the innate capacity to think, conceive,
and visualize almost like human beings and might even surpass human
intelligence in the near future. It further claimed that a major chunk of
prevailing jobs will soon become redundant, leading to gargantuan levels of
unemployment, while simultaneously creating numerous new jobs requiring
skills aligning with generative artificial intelligence. Human intelligence and
creativity are expected to be surpassed by artificial intelligence, leading to an
easier, healthier, happier, and higher quality of life.
However, “TECH WITH HUMAN FACE” – an NGO initiated by renowned
altruistic scientists in the Republic of Indica – has presented a counter-
argument alleging that such technology, if left unregulated, would have
catastrophic consequences. It poses a grave danger to human existence,
disrupts national security, undermines individual privacy, and disturbs public
order. This, in turn, could even threaten the unity and integrity of the nation.
There is also a risk of these disruptive technologies falling into the hands of
criminals, anti-social elements, and terrorists, potentially wreaking havoc with
the lives and well-being of people. Therefore, effective and robust regulatory
frameworks are necessary to mitigate these adverse effects. The NGO has
made a series of representations to the Government of the Republic of Indica,
seeking regulation of generative artificial intelligence and allied technologies.
In response, the Republic of Indica contended that emerging technologies
like Generative Artificial Intelligence and Quantum Computing are still at the
nascent stage. Therefore, bureaucratic control would be sufficient at this
stage, and further such technologies have cross-border ramifications. Thus,
domestic regulation might be inadequate and ineffective. Regulating these
technologies too early and that too at the nascent stage might stifle their
natural development. The Republic of India, therefore, suggests that a
Global Regulatory Framework, developed through consensus among comity
of nations at an appropriate time, could be more effective.
Consequently, Tech with Human Face has filed a Public Interest Litigation
(PIL) with the Supreme Court, seeking a directive for policymakers to
formulate and enforce a robust regulatory mechanism for generative
artificial intelligence, or alternatively, for the Court to frame interim
guidelines until the legislature intervenes. The Supreme Court dismissed the
petition, arguing it was not a public interest issue and beyond its jurisdiction
as it falls within the legislative domain, which is not within the Court's law-
making powers. Aggrieved by this decision, Tech with Human Face has
appealed to the Moot Court, contending inter-alia: that the PIL is
maintainable due to the paramount importance of the issue, legislative
inertia, and the potential catastrophic consequences for existing and future
generations. The appeal, therefore, argues for judicial intervention and
suggests that judges do have law-making power in cases of first instance to
advance public causes, citing historical examples.
NOTE: The laws prevailing in Republic of Indica are in Pari Materia with that
of Republic of India.
Participants are at liberty to frame issues by their ingenuity
MOOT COURT RULES
1.Memorial Submission Guidelines
A. FONT AND FORMATTING REQUIREMENTS:
· The body of the Memorial must be typed in Times New Roman, size 12, with 1.5
line spacing.
· The font size for footnotes, if any, must be no less than size 10.
· Each page must have a margin of at least one inch on all sides.
· The Memorial should not exceed 25 typed pages (excluding the Cover Page).

B. STRUCTURE OF THE MEMORIAL:


· The Memorial shall consist of the following parts:
i. Cover Page
ii. Table of Contents
iii. List of Abbreviations
iv. Index of Authorities
v. Statement of Jurisdiction
vi. Statement of Facts
vii. Issues Formulated
viii. Summary of Arguments
ix. Arguments Advanced along with the supportive Precedents. (not exceeding 15
pages)
x. Prayer
· The text must follow the Blue Book mode of citation (20th Edition).

C. SUBMISSION DETAILS:
· Each team must submit 02 copies of the Memorials for both Petitioner and
Respondent on or before 14/12/2024. The postal address is provided at the end of
the brochure. Along with that, the participants are instructed to submit 4 Copies of
the memorials for both sides at the time of desk registration.
· The name of the institution or the names of student participants must not appear
anywhere in the Memorial. The Team Code allotted must be typed at the top right
corner of the cover page.
· The Cover Page for the Appellant/Petitioner should be in blue color, and for the
Respondent in red color. Use chart paper or bond paper for the cover page.
· Email soft copies of the Memorials in MS Word (.doc) and PDF formats to
[email protected] by 14/12/2024 (23:59 hours IST) with the subject:
“Memorial for S.V.D. Siddhartha Legal Fest [Team Code]”.

D. Copyright and Other Details:


· The organizing college holds exclusive copyrights over the memorials
submitted by participating teams.

2. RULES GOVERNING THE COMPETITION

1. The Competition is open to students currently enrolled in LL.B. Degree


Courses (3 year/5 year) from BCI recognized universities and Law Colleges.

2.The team shall consist of 3 members ( 2 Mooters and 1 Researcher)

3. The competition shall be conducted in four rounds comprising Preliminary,


Quarterfinal, Semifinal, and Final rounds.

4. In the Preliminary rounds, each team shall argue for both sides. Eight
teams that achieve the highest marks in the Preliminary rounds shall become
eligible to enter into the Quarterfinals. Quarterfinal, Semifinal, and Final
rounds shall be held on a Knock-Out basis.
5. In the Preliminary rounds, each team shall get 30 minutes (including
rebbutals). The two Mooters can adjust the time between them, but no
Mooter shall argue for more than 20 minutes.

6. In the Quarterfinal and Semifinal rounds, each team shall get 30 minutes
for arguments and 2 minutes for rebuttals.

6. In the Final round, each team shall get 40 minutes and 5 minutes for
rebuttals.
7. Memorials are evaluated separately. Memorials for each side shall carry
100 marks. Each Memorial is valued for 100 marks.
8. Basis of Evaluation of Marks for Memorials.

Inferences and Conclusions: 40

9. Oral arguments shall generally confine to the Memorials.

10. Oral arguments for each side (i.e., for Petitioner and Respondent) shall
carry 50 marks. Each Mooter’s argument shall be valued for 25 marks.
11. Basis of Evaluation of Marks for Oral Arguments:
· Addressing the Court, Gait and Gesture, Tone and Tenor, Voice Modulation,
and Court Etiquette: 5
· Formulation of Issues, Linking Facts with Applicable Law and Binding
Precedents, Drawing of Inferences and Conclusions, Depth of Knowledge,

· Novelty, Clarity, Cogency, Brevity, Ingenuity of Arguments: 5

· Answering to the Queries of the Court: 5
QUIZ RULES

1. The Competition is open to students currently enrolled in LL.B.


Degree Courses (3 year/5 year) from BCI recognized Universities and
Law Colleges

2. Teams and Participants:


· Each team must consist of exactly two participants.
· Teams should select a team name before the quiz begins.

3. Quiz master:
The Quiz master will preside over the quiz, ask questions, manage
the quiz flow,and resolve any disputes.
· The Quiz master decisions are final on all matters, including
questions, answers, and disputes.

4. Question Format:
· Questions will cover a range of legal topics, including:
· General legal principles and concepts
· Specific Acts and statutes
· Notable case laws and Landmark Audio-video visuals
· Current affairs and recent developments in law
· The quiz will be conducted in both clockwise and anti-clockwise
direction in each round

5. Answering Questions:
· Answers must be given verbally by one of the team members.
· If a team answers incorrectly, then the same question will be put to
the next team as per the order of seating allocated.
6. Scoring:
· Correct answers will earn points as determined by the Quiz master.
· Incorrect answers carries a negative mark of one.
· The Quiz master will announce scores after each round or at the
end of the quiz.

7. Timing:
· Each round and question will be timed as specified by the
quizmaster.

8. Disputes and Challenges:


· Disputes or challenges regarding questions or answers must be
raised immediately after the relevant question or round.
· The Quiz master will review and resolve disputes, and his/her
decision is final and binding.

9. Behaviour:
· Teams are expected to conduct themselves with respect and
courtesy throughout the quiz competition.
· Cheating, such as using unauthorized materials or any electronic
device, will result in disqualification.
· Disruptive behavior may lead to penalties or disqualification at the
discretion of the quizmaster.
10. Breaks:
· Scheduled breaks will be announced by the quizmaster at his/her absolute
discretion. Teams may use these breaks for refreshments and discussion.

11. Winning:
· The team with the highest score at the end of the quiz will be
declared the winner.
· In the event of a tie, a tiebreaker round will be conducted as
decided by the quizmaster.
PRIZES
1. The Winning Team shall be awarded a Trophy, a Cash
Prize of Rs. 30,000, and a Certificate of Appreciation of
Merit.
2. The Runner-Up Team shall be awarded a Trophy, a Cash
Prize of Rs. 20,000, and a Certificate of Appreciation of
Merit.
3. The Best Memorial shall be awarded a Trophy, a Cash
Prize of Rs. 10,000, and a Certificate of Appreciation of
Merit.
4. The Best Mooter shall be awarded a Trophy, a Cash
Prize of Rs. 10,000, and a Certificate of Appreciation of
Merit. The Best Speaker shall be evaluated based on
performance in the preliminary rounds.
5. The Winner of the Research Test shall be awarded a
Trophy, a Cash Prize of Rs. 10,000, and a Certificate of
Appreciation of Merit.
6. All the members of the teams that become eligible for
Quarterfinals and Semifinals shall be awarded a Certificate
of Appreciation of Merit. All members of the other
participating teams shall be awarded a Certificate of
Participation.
7. The Winners of the Quiz shall be awarded a Trophy, a
Cash Prize of Rs. 15,000, and a Certificate of
Appreciation of Merit, while the Runners-up shall be
awarded a Trophy, a Cash Prize of Rs. 10,000 and a
Certificate of Appreciation.
STEPS TO BE FOLLOWED FOR REGISTRATION

1. The registration fee of Rs. 2000 (For Moot Court, Quiz, or Both) can be paid

2. Teams from each participating institution are required to fill in the registration

3. After filling out the Registration (Google form), participants should proceed
with the second step of registration: to fill the Authority Letter, Registration
Form & Payment Details, and send the scanned copy (soft copy) of the same
along with the screenshot of payment made or the photocopy of the receipt
(clearly depicting the transaction reference number) to our email:

4. The hard copies or physical copies of the Authority Letter, Registration Form &
Payment Details shall be sent along with the memorials by post on or before
14/12/2024. The participants are instructed to provide a copy of them during
the desk registration aswell.
5. After successfully completing your registration process, participants are
requested to fill out the Travel and Accommodation Form (if accommodation is
