RENT AGREEMENT

This Rent Agreement is made at Delhi on the 29.08.2024 between MRS.


ANITA GUPTA W/O SH. N.K. GUPTA R/O D-11/119-120, SECTOR-7,
ROHINI, DELHI-110085, (Hereinafter called the FIRST PARTY/OWNER)
AND
MR. ARUN KUMAR S/O SH. RAKESH KUMAR SONI R/O 83/14, LIC KE,
PEECHE, SIKANDRAPURA, RATH, HAMIRPUR, UTTAR PRADESH -
210431, (UID - 2037 7405 9814, DOB - 22/05/2002) (Hereinafter called
the SECOND PARTY/ TENANT).
The Expression of both the parties wherever they occurs in the body of
this agreement shall include their respective heirs, legal representatives,
administrators and executors, successors and assigns.
NOW WHEREAS the First Party/Owner is the exclusive owner and in
Possession of Property PROPERTY NO.D-11/416, 1ST FLOOR, Without
Roof Rights, SECTOR-7, ROHINI, DELHI-110085, (Hereinafter Called the
FLOOR/ PROPERTY / PREMISES).
NOW WHEREAS the first party at the request of the tenant agreed to let out
the above said property to the second party / tenant on monthly rent basis
on the following terms and conditions:-
NOW THIS RENT AGREEMENT WITNESSESTH AS UNDER:-
1. That the tenanted period of the said premises shall be effective from
01.09.2024 and shall be continued for a period of 11 months. There
shall be a lock-in period of 6 months from the date of commencement.
In case the tenant vacates the property before the lock-in period the
security will be forfeited.
2. That the rate of rent of the said property is fixed at Rs.8500/-(Rupees
Eight Thousand Five Hundred Only) The tenant is fully satisfied that
the rent is just fair and reasonable as prevailing in the areas. The tenant
has paid one month’s rent by cheques/ cash to the first party/landlord.
3. That the tenant shall pay monthly rent of the said rented property to the
first party on before 01ST Day of every English calendar month in
advance through NEFT/RTGS (CHEQUE/ CASH ).
4. That the tenant is not permitted for sub-letting the premises or any kind
of Residential/Commercial Activities and to make any type of additions
or alterations in the premises and shall use the premises for Residential
/Commercial purpose only.
5. That the second party shall Deposit total sum of Rs.15000/-(Rupees
Fifteen Thousand Only) as refundable security out of which he/she has
paid Rs.7500/-(Rupees Seven Thousand Five Hundred Only) on dated
01.09.2024 and shall further pay a sum of Rs.7500/-(Rupees Seven
Thousand Five Hundred Only) on dated 01.10.2024 along with rent to the
owner as refundable security of the said rented premises. The rent amount will
not be adjusted from the security deposit amount in any case and in any
manner. The amount is refundable without interest at the time of vacating the
said premises on the expiry of the tenancy period after the adjustments unpaid
rent, unpaid bill of electricity water etc. for the period of tenancy and also on
account of damages to the property/ fixtures if any.
6. That if the Second party does not vacate the premises even after the expiry of
the rent agreement then he will have to pay Rs.1000 per day as penalty in
addition to the monthly rent.
7. That if both the parties agree to renew the agreement, the monthly rent will be
increased by 10% OR as per the market rent prevailing in the area whichever is
higher.
8. That the said premises have been checked by the second party / tenant who is
fully satisfied. The tenant shall be responsible for restoration of any broken/
missing/ fittings/ fixtures and day to day repairs such as fuse, leakages of
water taps etc.
9. That in the default of payment of rent / charge for even one month: the first
party/ owner shall have right to evict the tenant from the said premises.
10.That the tenant /second party is not permitted to mortgage, sublet, assign or
part with the possession of said premises to anybody under any
circumstances..
11.That the electricity and water bills of the said rented property shall be paid by
the second party to the concerned department/owner as per meter reading from
time to time, during the tenancy period and the receipts of the same shall be
deposited with the first party, and the second party is liable and responsible for
electrical misuse and any other unfair practice for using the electricity during
the tenancy period. The first party will not be responsible for the same in any
manner.
12.That the owner or his authorized persons shall be entitled to inspect the
premises at all reasonable hours and the tenant shall not raise any objection
the same.
13.That the second party shall not contravene any of the bye-laws and provisions
of the DDA/MCD/DJB/ELECTRICITY authority.
14.That the tenant will not do any illegal work in the above premises in any
circumstances, and shall not keep any objectionable item in the said tenanted
premises.
15.That the tenant shall handover the peaceful physical vacant possession of said
premises as well as all fittings and fixtures in running condition to the owner
after the expiry of the tenancy period without any hitch and hesitation.
16.That the tenant/second party undertakes not to use this agreement to borrow
any sum of money from any bank/financial institution/ party etc.
17.That the legal hires, executers, administrators and nominees of both the parties
will also remain bound by all terms and conditions.
18.That the first party has delivered physical possession of the said rented
property to the second party(S) on spot in good condition.

19.That if either of the party wants to vacate the said premises before the expiry of
the tenancy period then they will serve one Month’s advance notice to each
other(s) and/or pay one month’s rent in lieu thereof.
20.That the minor defects shall be repaired by tenant/second party like leakage of
taps, fuses of electricity at his/her own cost. Proper sanitation and cleanliness
of the above said premises will be looked after by tenant or second party.
21.That the courts at Delhi, New Delhi shall have jurisdiction in case of any
dispute between the above parties regarding said property or any terms
mentioned above.
22.That the tenant admits that the terms and conditions in the agreement are fair
and reasonable and he/she agrees voluntarily and willfully without any
pressure and in their full senses to all these conditions and is residing in
premises at his own sweet will.
23.That the first party will not be responsible for any theft or loss, damages or
deterioration of any property of the second party or any other persons laying in
said premises Or anybody injury or harm to any person in the premises from
any cause whatsoever during the tenancy period.
IN WITNESS WHEREOFF the parties hereto have signed this agreement on the date
First above written in the presence of witnesses at Delhi or New Delhi.
