This case has been set for hearing on August 19, 2024 at 1:30 in the afternoon after the July 29, 2024 was cancelled; 2. Unfortunately, however, on that same date, the undersigned counsel would still be in Cebu as he will be appearing at RTC 76, Naga City, Cebu in Civil Case No. NCV-ODT-2022-26 entitled “MERCY E. GRAUEL, et al., vs. Sarah Ybafiez”, for Injunction, etc., scheduled on the following day, August 20, 2024, thus, he will be physically unable to attend to this case; 3. That another predicament this counsel is being confronted with is the fact that on August 24, 2024 to September 10, 2024, he and his wife have an scheduled travel to Missouri, USA. August 24, 2024 is their date of departure and September 10, 2024 would be their date of arrival back to the Philippines; 4. In view of this predicament of counsel, with the kind indulgence of the Honorable Court and the opposing counsel, this counsel humbly moves that this case be reset to September 23, 2024at 1:30 in the afternoon. 5. Printout of the online receipt of the postponement fee is herewith attached as Annex “1”; WHEREFORE, in the interest of justice, it is most respectfully prayed of this Honorable Court to cancel the setting on August 19, 2024 and move the same to September 23, 2024 at 1:30 in the afternoon.
