COMMON ORAL ORDER

1. During the hearing of this group of

petitions, question arose with regard to number

of vacancies / posts to be reserved for

appointment by way of promotion and consequently,

issue with regard to number of vacancies which

are advertised also arose inasmuch as the

petitioners expressed apprehension that number of

vacancies which are advertised preferably

includes the vacancies which should be reserved

for appointment by way of promotion, learned

advocate for the respondents was asked to seek

necessary clarification on this count. Mr.

Supehia, learned advocate for the respondents

submitted that the vacancies include all existing

vacancies including the vacancies which,

according to the judgment by Division Bench and

in view of the recommendation by the report by

Justice Shetty Pay Commission, have to be

reserved for appointment by promotion. In this

view of the matter, it appears appropriate that

the said fact may be placed on record by way of

affidavit, more particularly because some of the

petitions, particularly the petitions filed by

employees in Metropolitan Court, seek relief with

regard to all districts in the State.

2. In view of the clarification by learned

advocate for the respondents, Mr. Pujara and Mr.

Raval, learned advocates for the petitioners

submitted that since the process of finalisation

of selection list is in progress, appropriate

interim order to safeguard the interest of the

employees may be passed.

3. Appropriate order can be passed after

considering the details which may be brought on

record by affidavit of the respondents.

4. Therefore, time to file appropriate reply is

granted. S.O. to 13.3.2015.

5. In the meanwhile, the respondents may file

reply and serve copy to learned advocates for the

petitioners.

6. Thereafter appropriate order with regard to

petitioners’ request for interim relief will be

passed.
