RULE 1030 - TRAINING AND ACCREDITATION OF OSH PERSONNEL

• A full-time safety officer must be duly accredited by the DOLE.


• The employment of full-time safety officer may not be required if the employer
enters into a written contract with a qualified consultant or consulting organization
whose duties and responsibilities shall be the duties a safety practitioner as stated
in this Rule.
• The employment of a consultant, however will not excuse the employer from the
required training of his supervisors or technical personnel

RULE 1050 - NOTIFICATION & KEEPING RECORDS OF ACCIDENTS

1053.01: Notification - All work accidents or occupational illnesses, resulting in


disabling conditions or dangerous occurrences shall be reported by the employer
to the Regional Labor Office

**(If a major work accident results in death or permanent total disability, employer
shall initially notify the Regional Labor Office within 24 hours.)

1054: Keeping of Records - The employer shall maintain and keep an accident or
illness record which shall be open at all times for inspection by authorized
personnel.

• 1. Every employer shall establish in his place of employment occupational health
services in accordance with the regulation & guidelines provided for under this
rule.

measures relating to occupational health services.

1963: EMERGENCY HEALTH SERVICES
• An employer may not establish an emergency hospital or dental clinic in his
workplace as required in these regulations where there is a hospital or dental
clinic which is located not more than five (5) kilometers away from the workplace,
if situated in any urban area, or which can be reached in twenty-five (25) minutes
of travel, if situated in rural area, and the employer has facilities readily available
for transporting workers to the hospital or dental clinic in case of emergency

The employer shall exert efforts to maintain and control the working environment in
comfortable and healthy conditions for the purpose of promoting and maintaining the

The sampling and analysis carried out in respect of the atmospheric working
environment for the purpose of determining actual conditions therein.

RULE 1080 - PERSONAL PROTECTIVE EQUIPMENT AND DEVICES


1081.04 - No person shall be subjected or exposed to a hazardous environmental
condition without protection.

jurisdiction as the competent authority in the
specific industry or economic activity.
WORKERS’ RIGHT TO PERSONAL PROTECTIVE EQUIPMENT (PPE)

Every employer shall provide their workers, free of


charge, protective equipment for their eyes, face, hands
and feet, and lifeline, safety belt or harness, gas or dust
respirators or masks, and protective shields whenever
necessary by reason of the hazardous work process or
environment, chemical, radiological, mechanical and
other irritants or hazards capable of causing injury or
impairment in the function of any part of the body
through absorption, inhalation or physical contact.

Section 1: Definition of terms
25 terms as used in the guidelines were defined in order to clarify their meaning
and to distinguish them from similar terms as defined in other issuances

Section 2: Jurisdiction
The Secretary of the Department of Labor and Employment, by virtue of Article
162 of the Labor Code of the Philippines, has the authority to issue appropriate
laws related to the administration and enforcement of occupational safety and
health in the Philippines

Section 3: Delegation of Authority


DOLE has the power to delegate some enforcement powers to other government
agencies and to private organizations provided that they have adequate
personnel, training and facilities (These cover Technical Safety Inspections)
Section 4: Coverage
The guidelines shall apply to all construction activities, including demolition,
whether owned by the private or the government sector

Section 5. Construction Safety and Health Program


Before the start of the actual construction, The construction project manager
shall prepare and submit to DOLE a comprehensive construction safety and
health program (for approval of the Bureau of Working Conditions) which shall
include, but not limited to:
• Composition of the construction safety and health committee
• Specific H&S policies within the construction site
• Penalties for violation
• Training of workers
• Waste disposal
• Other requirements of D.O. No. 13, series of 1998
Section 6: Personal Protective Equipment (RULE 1080)
Every Employer shall, at his own expense, furnish his workers with protective
equipment for eyes, face, hands and feet.
• All employees must be provided - free of charge

Section 7: Safety Personnel (RULE 1030)


To ensure that a Construction Safety and Health Program is duly followed and
enforced at the construction project site, each construction project site is
required to have the minimum required Safety Personnel.
• Must be Accredited by DOLE

Section 8: Emergency Occupational Health Personnel and Facilities


The construction project owner or his duly authorized representative shall
provide competent emergency health personnel within the worksite duly
complemented by adequate medical supplies, equipment and facilities, based on
the total number of workers
Section 9: Construction Safety Signages
Mandatory provision of safety and warning signs are reiterated not only for the
protection of workers, but also the public in general. Signs should conform with
the standard requirements of the OSHS.

Section 10: Safety on Construction Heavy Equipment


-All HE (Heavy Equipment) Operators must be tested and certified by TESDA (NC II).
-All Heavy equipment (minimum operating rate & horsepower rating of 1,000 kg &
10 HP, respectively) must be tested and certified by DOLE or its recognized
organizations.(Heavy Equipment Testing Certificate).

Section 11: Construction Safety and Health Committee


All construction sites must have a general Construction Safety and Health
Committee composed of safety and health representatives from each sub-
contractor. The construction project manager shall head the committee.
Section 12: Safety and Health Information
A detailed safety and health information system is included in the guidelines. These
include orientation, instructions, and training for workers; means of conveying
safety related information to all workers and specialized instructions and trainings
for specialty workers and operators

Section 13: Construction Safety and Health Training


The basic construction safety and health training shall be forty (40)-hour training
course as prescribed by the BWC

Section 14: Construction Safety and Health Reports


All general constructors shall be required to submit a monthly construction safety
and health report to the BWC or to the DOLE Regional Office concerned.
Section 15: Construction Workers Skills and Certificates
All construction workers in critical occupations shall undergo mandatory skills
testing for certification by TESDA

Section 16: Workers’ Welfare Facilities


The employer shall provide the welfare facilities in order to ensure humane
working conditions

Section 17: Cost of Construction Safety and Health Program


The total cost of implementing a Construction Safety and Health Program shall be a
mandatory integral part of the project's construction cost as a separate pay item,
duly quantified and reflected in the Project's Tender Documents and likewise
reflected in the Project's Construction Contract Documents.
Section 18: Miscellaneous
All provisions of other existing occupational safety and health guidelines not
inconsistent with the above Guidelines shall form part of this Department Order.

Section 19: Violations and Penalties


the DOLE Regional Director shall issue a stoppage order, in conformance with the
guidelines specified under Rule 1012.02 of the OSHS and other pertinent issuances
for stoppage of operation or for other appropriate action to abate the danger.

Section 20: Effectivity


This issuance shall serve as policy and procedural guidelines for this Department
and its agencies in the administration and enforcement of applicable labor and
social legislations and their implementing regulations.
