Important Instructions / guidelines to the quotationers to attach the following

Documents:

1) EMD paid in the form of Demand Draft from the Nationalized / Scheduled Bank or
Railway cash office.
2) Any authorized ID proof for age issued by any state or central governme
government ( i.e.,
PAN card/ ADHAR card/ Driving license,/Election card /passport etc.,)

The Senior Divisional Commercial Manager, South Central Railway,

Vijayawada Division on behalf of the President, Union of India, invites sealed
Quotations from the Indian Nationals (above the age of 18 years) / firms for award
of parking stand mentioned below for a period of 90 (Ninety) days on temporary
basis or finalization of regular tender whichever is earlier.
The details of area of the stand, Earnest Money Deposit, Estimated
Reserve Price of quotation value for 90 days are as under:

Note: In addition to the offered price, the successful quotationer should also pay
the GST @ 18%, Cess charges (Rs.1,395 for three months) and TCS @2.33% of
the contract value.

The quotation form must be accompanied with the above said EMD amount,
otherwise quotation will not be considered. The applicants are required to submit their
credentials, experience certificate (if any), Age proof certificate, Partnership deed if
any, in case of firm/company etc., The conditions stipulated in the Terms and
Conditions supplied along with the quotation are binding on the part of quotationer.
The Applicant should affix his/her passport size photograph on the quotation form in
the space provided for this purpose.

The sealed quotation should be dropped in the quotation box placed at the
Office of the Senior Divisional Commercial Manager, South Central Railway,
Vijayawada Division, Vijayawada before 15:00 Hrs of 30-09-2022. The quotation
box will be sealed in the presence of representative of finance at 15.00 Hrs of
30-09-2022. After 15:00 hrs of 30-09-2022, no quotation will be entertained.
The sealed quotation box will be opened at 15:30 hrs on 3 0-09-2022, in
the Sr. Divisional Commercial Manager’s Office in the presence of the Commercial
and Finance department officials.

If the date of opening happens to be a holiday the Quotations will be
opened on the next working day. Notwithstanding the above, the railway
administration has the right to reject any or all quotations without assigning any
reasons. The decision thereof shall be final.

1) In response to your Quotation Notice No.04/2022-23 (parking stands), dt:23-09-

2022, I/We Sri./ M/s. ______ ______read the various terms
& conditions attached to the quotation/application. I/We agreed to abide by the said
terms & conditions and intend to participate in parking stand at _____________
Railway station and offer an amount of Rs. ___________ (Rupees
only) for a period of 90 (Ninety) days.
I/ We also agree to keep this quotation open for a period of 30 days from the date
of opening the quotation and in default there of liable for forfeit of my/ our EMD.

(Note:1: Tender should submit Quotation document separately for each location
Note:2 The bid amount should be written LEGIBLY in ink in figures and in words;
where there is a discrepancy between the words and figures, the amount written
in words shall be considered. Incomplete / insufficient information and without

Terms & Conditions for accepting Sealed Quotations for Parking stands on temporary
basis for a period of 90 (Ninety) days or finalization of regular tenders whichever is
earlier.

1. The Quotation Forms will be available in the office of Sr.Divisional Commercial

Manager, South Central Railway, Vijayawada. The quotation should be
submitted in a sealed cove super scribed “Quotation for ___________
parking stand at _______________ Railway Station”.
2. The offerer in his own interest may visit the site and should satisfy himself
before applying for the parking stand. Any dispute regarding Area/Boundaries
or any other deficiencies will not be entertained after allotment of contract.

3 The applicant should submit separate application for each location. The sealed
quotation should be submitted in superscribed as “Quotation for __________
parking stand at _____________ Railway station” .
3. The successful applicant has to pay the entire bid amount as license fee for
90 days period, in advance before taking up parking contract. The
payment should be paid in the form of Demand Draft from any nationalized /
Scheduled bank to be drawn in favour of Senior Divisional Finance Manager,
S.C. Railway, Vijayawada.
4. All intending applicants should note that just offering highest bid amount does
not accrue any right to claim the license. Divisional Railway Manager
(commercial), South Central Railway, Vijayawada reserves the right to reject
any or all quotations without assigning reasons, and does not bind himself to
accept the highest or any quotation.
5. The successful bidder should take up the parking stand contract within the
stipulated time prescribed in letter of acceptance i.e., within three days period,
and any non-response/withdrawal from the license, will lead to legal action
proceedings under laws apart from forfeiting the EMD paid.

6. A) EMD amount: Earnest Money Deposit should be 10 % of the three months

contract value. No concession is allowed in respect of payment of Earnest
Money Deposit. Each application must be attached with an original money
receipt/DD in respect of the ________________ parking stand at
___________ Railway station, which shall have to be paid to the Divisional
Cashier (Pay) South Central Railway, Vijayawada or in the form of Demand
Drafts, Banker cheques / Pay orders to be drawn in favor of Sr. Divisional
Finance Manager, S.C. Railway, Vijayawada. Without payment of EMD
amount quotations will not be considered and disqualified.

B) license fee: The Successful quotationer shall pay 90 days period license
fee (as quoted towards bid amount in the quotation) and other charges as
advised by the administration, in advance before taking up the contract and
also execute Agreement with Railway administration before taking up the
contract. Partial payment of license fee shall not be allowed under any
circumstances.
7. If the licensee fails to take up the contract within the time stipulated by the
Administration, the contract shall stand cancelled and the amount paid by him
as earnest money deposit shall be forfeited. After depositing of quotations any
withdrawal of offers in any manner will not be considered.
8. The Licencee should complete full tenure of contract. No refund will be
granted if the licensee leaves the contract in between.
9. If the area is required by the Administration for any other purpose before
completion of the contract, the license fee for the balance period will be
refunded.
10. The bid amount should be legibly written in ink both in figures and in words.
When there is discrepancy between the words and figures, the amount written
in words shall be considered.
11. Quotations will be opened and scrutinized by the Railway Officials in presence
of such of those applicants who choose to attend.
12. The EMD amount of the unsuccessful quotationers will be returned after
finalization of offers.
13. The licensee is required to use only earmarked space for the stand. Any
violation in this regard not only attracts imposition of proportionate bid amount
as penal rent but also cancellation of license together with forfeiture of
Earnest money deposit.
14. The licensee or his agent must be present at the parking stand daily round the
clock or as specified from time to time by the Railways.
15. The licensee of the stand shall be a license holder and he shall be responsible
for compliance of the various labour laws and other statutory requirements.
No sublease shall be entertained.
16. Payment of Taxes: The successful quotationer is required to pay 2.33% of
Income tax on the contract value as per section 206 of Income Tax Act.1961,
GST @ 18% of the contract value, Cess charges of Rs.1395 for three months
and any other charges on demand by the administration, as well as and any
other taxes as levied by Government of India from time to time.
17. The GST @18% should be paid along with the license fees.
1) GST Registration number should be furnished.
2) GST Act and Rules are applicable from time to time.
3) No bills will be accepted without GST registration.

19. In the event of any question, dispute or difference arising under this conditions
of or in connection with this license (except as to any matters the execution of
which is specially provided for these conditions) the same shall be referred to
sole Arbitrator a Gazetted Railway Officer appointed to be Arbitrator, by the
Principle Chief Commercial Manager, South Central Railway. The Gazetted Railway
Officer appointed as Arbitrator, however will not be one of those who had opportunity
to deal with matters to which the license relates or who in the course of his duties as
Railway Servant has expressed views on all or any of the matters under dispute or
difference. The Award of the Arbitrator shall be final and binding on the parties to this
contract. No person other than a person appointed by the Chief Commercial
Manager, South Central Railway, shall act, as Arbitrator and if for any reason that is
not possible the matter is not be referred to Arbitrator at all. Subject to the provisions
of the aforesaid Arbitration & Conciliation Act 1996 and the rules there under & any
statutory modification thereof shall apply for arbitration proceedings under this clause.
