RULES AND REGULATIONS TO IMPLEMENT SECTION 33 (B) OF REPUBLIC ACT


NO. 10029, ENTITLED “PHILIPPINE PSYCHOLOGY ACT OF 2009”
ON THE ISSUANCE OF PERMIT TO OPERATE A PSYCHOLOGY OR
PSYCHOMETRICS OFFICE, CENTER, CLINIC, OR FACILITY

WHEREAS, Republic Act (R.A.) No. 10029 or the “Philippine Psychology Act of 2009”
mandates the Professional Regulatory Board of Psychology (Board) to supervise and
regulate the practice of Psychology in the Philippines. Section 2 of the said law provides
that the State recognizes the importance of psychologists in nation-building and
development, as such, it should nurture competent, upright and assiduous professionals
whose standards of practice and service shall be excellent and globally competent, for
the protection of the public through prevention of inexperienced or untrained and
unlicensed individuals from offering psychological services;

WHEREAS, Section 3(b), Article III of R.A. No. 10029 provides for the scope of the
professional practice of Psychology, to wit:
(1) psychological interventions: psychological counseling, psychotherapy,
psychosocial support, coaching, psychological debriefing, group processes
and all other psychological interventions that involve the application of
psychological principles to improve psychological functioning of individuals,
families, groups and organizations;
(2) psychological assessment: gathering and integration of psychology-
related data for the purpose of making a psychological evaluation,
accomplished through a variety of tools, including individual tests, projective
Si tests, clinical interview and other psychological assessment tools, for the
purpose of assessing diverse psychological functions including cognitive
abilities, aptitudes, personality characteristics, attitudes, values, interests,
emotions and motivations, among others, in support of psychological
counseling, psychotherapy and other psychological interventions; and
(3) psychological programs: development, planning, implementation,
monitoring and evaluation of psychological treatment for individuals and/or
groups

WHEREAS, Section 33(b), Article VIII of R.A. No. 10029 further provides that no
corporation, partnership, association or entity shall operate a psychology or
psychometrics office, center, clinic or otherwise engage in the practice or allow the
practice of Psychology or Psychometrics within its premises without securing a permit
therefor from the Board. Such permit shall be issued only after the Board is satisfied that
such establishment is competently staffed by a Psychologist and equipped with sufficient
and adequate psychology-related instruments and facilities]

WHEREAS, Section 35, Article VIII of R.A. No. 10029 likewise authorizes the Board to
initiate action to enjoin, restrain, and/or prosecute any individual, corporation, association,
partnership or entity engaging in the practice of psychology and psychometrics in violation
of the law.

NOW THEREFORE, by virtue of the powers vested unto it, the Board RESOLVES, as it
is hereby RESOLVED, to issue and promulgate the following “Rules and Regulations to
Implement Section 33(b) of R.A. No. 10029 on the Issuance of Permit to Operate a
Psychology or Psychometric Office, Center, Clinic, or Facility”:

RULE I
DEFINITION OF TERMS, SCOPE AND PURPOSE

Section 1. Definition of Terms - The following terms as used in this Resolution shall be
understood to mean as:

a. Permit to Operate refers to a formal authorization issued by the Board to a


corporation, partnership, association or entity to operate a Psychology or
Psychometrics office, center, clinic or facility as herein defined.
b. Psychologist refers to a natural person who is duly registered and holds a valid
Certificate of Registration (COR) and a valid Professional Identification Card (PIC)
as a Professional Psychologist issued by the Board and the Commission.
c. Psychometrician refers to a natural person who holds a valid COR and a valid
PIC as a Psychometrician issued by the Board and the Commission.
d. Psychology or Psychometrics Office, Center, Clinic or Facility refers to an
establishment where psychological services and activities described in Section
3(b), Article III of R.A. No. 10029 and Section 3(b), Rule III of its Implementing
Rules and Regulations (IRR) are carried out therein by licensed Psychologist/s
and/or Psychometrician/s.
e. Head of Psychological Services Unit refers to a registered Psychologist who
possesses all the qualifications prescribed in Section 3 (e.1), Rule II hereof and
who shall be responsible for supervising and overseeing all psychological services
offered or rendered by the psychology or psychometrics office, center, clinic, or
facility.
f. Board refers to the Professional Regulatory Board of Psychology.

Section 2. Scope and Applicability. This Rules and Regulations shall cover all
establishments and facilities operating as Psychology or Psychometric Office, Center,
Clinic, or Facility as herein defined. The following are deemed to be within the scope of
this Rules and Regulations and, for purposes hereof, shall be required to secure a Permit
to Operate from the Board:

a. Clinics and facilities that render psychological or psychometric services as


part of the practicum or outreach program of a school, university, church,
hospital/health institution and other similar entities; Provided, that such
clinics and facilities shall have also complied with the permitting and
licensing requirements of other government institutions and agencies such
as the Department of Plealth, Department of Social and Welfare and
Development, and Commission on Higher Education;
b. Human Resource Department/Division/Unit of government institutions or
agencies and private corporations or industrial firms providing/rendering
psychological services;
c. Other clinics and facilities that render psychological or psychometric
services such as, but not limited to, OFW clinics and treatment rehabilitation
centers;
d. Entities performing online psychotherapy and assessment; and
e. Other similar entities offering or rendering psychological or psychometric
services as defined in R.A. No. 10029.

RULE II
QUALIFICATIONS AND DOCUMENTARY REQUIREMENTS FOR THE
ISSUANCE OF PERMIT TO OPERATE PSYCHOLOGY OR PSYCHOMETRICS
OFFICE, CENTER, CLINIC, OR FACILITY

Section 3. Qualifications for the Issuance of Permit to Operate Psychology or


Psychometrics Office, Center, Clinic, or Facility- A Psychology or Psychometrics
office, clinic, center, or facility, as defined above, may be issued a Permit to Operate by
the Board; Provided, that they prove to the satisfaction of the Board that they meet the
following requirements:

a. Must have appropriate facilities, fixtures, furniture and sufficient area to


conduct the practice of Psychology or Psychometrics;
b. Must have an area for proper storage of psychometric
equipment/devices/materials for safety and confidentiality;
c. Must have adequate illumination and ventilation;
d. Must be provided with appropriate measures against hazards, such as
earthquakes, floods, fire and others;
e. Must have the necessary personnel complement:

e.l.The Head of the Psychological Services Unit (PSU) must be a


registered and licensed Psychologist who possesses a master’s
degree in Psychology, with at least seven (7) years of experience as
a Psychologist, three (3) years of which is in a supervisory capacity.
The PSU Head must be fully engaged as the center chief, director or
operations manager of the establishment or facility, either as its
business-owner, business partner, or full time management employee
hired specifically for the role or purpose. He/she is fully accountable
for the PSU’s full operations and resources, hence, is expected to be
present, at all times, when psychological services are rendered, unless
there is another psychologist available to supervise the services
rendered on a temporary basis, under his/her authority. This
arrangement notwithstanding, it is still the Psychologist who is the
designated head of the PSU who shall take full responsibility over the
operations of the center, clinic or facility. The engagement of the PSU
Head Psychologist on a full time basis shall be required even for clinics
and facilities which provide extension services, such as a school’s
community outreach program, university, church, hospital/health
institution or similar entities and his/her engagement and designation
as PSU head or director shall be limited to only one (1) Psychology or
Psychometrics Office, Center, Clinic or Facility; and
e.2.The number of Psychometricians employed must be commensurate
with the number of clients to be served per day, thus:

1) With an average of thirty (30) clients per day: at least one (1)
Psychometrician;
2) With more than thirty (30) up to sixty (60) clients per day: at
least two (2) Psychometricians;
3) With more than sixty (60) up to ninety (90) clients per day: at
least three (3) Psychometricians; and
4) With more than ninety (90) up to one-hundred twenty (120)
clients per day: at least four (4) Psychometricians.

Section 4. Documentary Requirements for the Issuance of Permit to Operate


Psychology or Psychometrics Office, Center, Clinic or Facility - The applicant shall
submit to the Regulation Division of the Regional Offices the following documents in
support of its application:

a. Duly accomplished Application Form ("Annex A");


b. Proof of corporate or juridical existence:

For government institutions or agencies - a copy of the charter/organic


law which created the government institution or agency concerned.

For private corporations, partnerships, organizations and other similar


entities - authenticated copy of the Certificate of Registration, Articles of
Incorporation/Partnership and By-Laws issued by the SEC (for
corporation or partnership), or Certificate of Registration issued by the DTI
(for sole proprietorship)

Covered clinics or facilities which are attached or part of a school/university, church,


hospital/health institution, government institution/agency, or corporate/ industrial
firm shall submit the SEC or DTI registration documents or charter, whichever is
applicable, of the entity to which they are attached or part of.
c. Profile of the Psychology or Psychometrics office, center, clinic or facility, with a
brief statement of the nature of psychological services it provides, existing staffing
complement, among others;
d. List of facilities, areas, furniture, assessment tools, including but not limited to test
materials, questionnaires, reference manuals, etc. and other ancillary equipment
necessary for the conduct of competent and professional services;
e. Pictures of the secured storage area or room where psychometric and
psychological materials and questionnaires as well as other confidential materials
are kept. The pictures submitted by the applicant shall be kept confidential and
shall not be available for public viewing or inspection unless upon order of
competent authorities or with express written consent of the applicant.
f. For online psychotherapy or assessment, an undertaking (which should also be
made available in the office), as to the PSD Head’s full accountability in ensuring
data security under the client’s confidentiality clause and Data Privacy Law. This
is also required for all other psychologists, service-providers under his/her
supervision. On this regard, it is up to the PSD Head or facility to formulate his/her
own data security of client confidentiality including, among others, client-waiver or
informed consent, as this may vary from one client to another depending upon the
need, having in mind, compliance with standard ethical practice and Data Privacy
Law.
g. For online assessment, copyright usage of online assessment tools and proof of
purchase.

Section 5. Prescribed Fee - The processing fee for application for Permit to Operate was
submitted, reviewed and approved by the Committee on Revision of Fees and is
prescribed in the application form hereto attached as Annex “A”.

RULE III
ISSUANCE OF PERMIT TO OPERATE PSYCHOLOGY OR
PSYCHOMETRICS OFFICE, CENTER, CLINIC, OR FACILITY

Section 6. Processing of Applications for the Issuance of Permit to Operate - The


following steps shall be observed in the processing of applications:

a. The Regulation Division of the nearest PRC Regional Office, shall initially evaluate
the application based on the documentary checklist and verify the validity of the
license of the head of the PSU/Psychologist. The Legal Section/Division shall
verify whether there is a pending case filed against the head of the PSU. Once
completed, the applicant shall then be instructed to proceed to the Cash Section
for the payment of the prescribed fee.
b. The applicant shall submit the duly accomplished Application Form, supporting
documents and official receipt of payment to the Regulation Division designated
window.
c. The Regional Division shall forward the application documents to the Accreditation
and Compliance Division (ACD) for validation and endorsement to the Board. The
Board, through its Focal Person, shall proceed to evaluate the application. The
processing and evaluation of the application by the Board Focal Person shall be
subject to the provisions of PRC Memorandum Order No. 04 (s. 2016)1.
d. The corresponding Permit to Operate shall be issued to those whose applications
have been approved. The Permit to Operate shall be signed by the Board
Chairperson and the Commission Chairperson.

ex' Section 7. Initial Issuance and Renewal of the Permit to Operate Psychology or
Psychometrics Office, Center, Clinic, or Facility-The Permit to Operate ("Annex B")
shall be valid for three (3) years, subject to renewal. Any change in the composition or
structure of the office, center, clinic, or facility (e.g. change in the designated PSU Head)
that take place within the validity of the Permit issued shall be reported to the Board within
seven (7) working days from the date the change was implemented. Applications for the
V renewal of the Certificate shall be filed at least three (3) months prior to the expiration of
the Permit originally issued, upon compliance with the requirements set forth in Rule II of
this Resolution.

The Permit to be issued by the Board shall be separate and distinct from the permits and
licenses issued by other government institutions and agencies (e.g. DOH, LGUs, etc.). It
is not to be construed, though, that herein Permit shall be the sole and exclusive authority
to operate Psychology or Psychometrics office, center, clinic or facility, as such permit is
without prejudice to the applicability of the permitting and licensing requirements of other
government institutions and agencies.

Section 8. Ratification of Approved Applications - All applications approved by the


Board Focal Person shall be subsequently ratified by the Board and the Commission
through a Resolution passed for that purpose.

Section 9. Disapproved Applications - All disapproved applications by the Board shall


be returned to the ACD for the preparation of the notice/letter of disapproval. The ACD

shall ensure that the concerned Regional Office will send the notice/letter to the applicant.
Any request for reconsideration shall be filed with the Board not later than three (3) days
from receipt of the Board's decision. The Board shall resolve the same not later than three
(3) days from receipt of the request. The decision of the Board is appealable to the
Commission within five (5) days from receipt of the same.

Section 10. Monitoring of Psychology or Psychometrics Office, Center, Clinic and


Other Related Establishments - The Board shall continue to monitor, through the
conduct of inspection/visitation, all Psychology or Psychometrics offices, centers, clinics
and facilities which have been issued Permits, and shall, for this purpose, conduct
periodic or unannounced inspections of such establishments and facilities at any time
during the validity of their Permits.

Rule IV
SUSPENSION OR REVOCATION/CANCELLATION AND REINSTATEMENT,
RE-ISSUANCE OF PERMIT TO OPERATE TO OPERATE PSYCHOLOGY OR
PSYCHOMETRICS OFFICE, CENTER, CLINIC OR, FACILITY

Section 11. Grounds for the Suspension or Revocation/Cancellation of Permit to

4 Operate Psychology or Psychometric Office, Center, Clinic, or Facility- The Board


may revoke or cancel the Permit to Operate, after due process, on any of the following
grounds:

a. Use of deceit or fraud in securing or obtaining the Permit;


b. Establishing another clinic or satellite centers without written authority from
the Board. Satellite Offices/Branches should seek a separate and
independent permit, apart from the original or main office;
c. Commission of illegal and/or unethical acts during the validity of the issued
Permit;
d. Non-compliance with the provisions of R.A. No. 10029, its IRR, or other
requirements or conditions imposed by the Board; or
e. Any other analogous grounds.

The decision cancelling or revoking the Permit to Operate which shall be in the form of a
Board Resolution shall become final and executory upon the completion of its publication
in any newspaper of general circulation.

Section 12. Reinstatement or Re-issuance of Permit to Operate - The reinstatement


or re-issuance of permit shall be governed by the following rules:

a. A Permit that has been suspended, revoked, or canceled on the ground of fraud
or deceit under Section 11 (a)(b)(c), Rule IV hereof shall not be reinstated under
any circumstance. Such may also constitute as ground for the institution by the
Board and/or the Commission of the appropriate administrative and/or criminal
actions against those who are responsible therefor;
b. A Permit that has been suspended, revoked or cancelled on the ground of non-
compliance with the provisions of R.A. No. 10029, its IRR and other requirements
and conditions imposed by the Board under Section 11(d), Rule IV hereof may be
reinstated upon compliance with the deficiencies and/or conditions; and
c. In case a Permit has been lost, damaged, or mutilated, the applicant may apply for
a duplicate copy of the same accompanied by a duly notarized affidavit detailing
the circumstances and the reason for the request for re-issuance of the Permit.

Rule V
SEPARABILITY CLAUSE AND FINAL PROVISIONS

Section 13. Retention of Permit to Operate Number. Corporations, partnerships,


associations or entities issued with a permit to operate a Psychology or Psychometrics
office, center, clinic or facility shall retain their Permit to Operate numbers for records and
monitoring purposes.

Section 14. Separability Clause. The provisions of this Resolution are separable, and
in the event that any of its provisions is declared invalid, illegal, or unenforceable, the
validity, legality, and enforceability of the remaining provisions shall not in any way be
affected or impaired thereby.

This Resolution shall take effect after fifteen (15) days following its publication in the
Official Gazette or in any major newspaper of general circulation.

Let a copy hereof be furnished the University of the Philippines Law Center and relevant
government institutions and agencies.
