    LAW353:PATENTS AND GEOGRAPHICAL INDICATIONS

    Course Outcomes: Through this course students should be able to

    CO1 :: apply the distinction between corporeal and incorporeal property to identify different types
    of intellectual property (IP) rights

    CO2 :: differentiate between provisional and complete patent specifications, explaining their roles
    in the application process.

    CO3 :: identify different modes of patent infringement and their legal implications.

    CO4 :: evaluate the effectiveness of civil remedies and injunctions in enforcing patent rights in
    India.

    CO5 :: evaluate the significance and implications of the Geographical Indications of Goods
    (Registration and Protection) Act, 1999
    CO6 :: analyze case studies like the Darjeeling tea case to understand the identification process
    for Geographical Indications (GIs).

    Evolution and growth : definition of patent, history of patent law in India, Indian Patent Act, 1970

    Unit II
    Registration of patent : grant of patent, national grant of patents, patent specification: provisional
    and complete, patent documentation and application process, publication
    Unit III
    Infringement of patent : modes of infringement, legal and equitable remedies for infringement

    Unit IV
    Remedies and enforcement : civil remedies, injunction, other equitable remedies

    Unit V
    The Geographical Indications of Goods (Registration and Protection) Act, 1999 : meaning,
    procedure for registration, effect of registration, term of protection
    Unit VI
    Identifying geographical indications : Darjeeling tea case, turmeric case study, kinwoo case
    study
