LAW108:LAW OF TORTS INCLUDING CONSUMER PROTECTION ACT AND MOTOR

Course Outcomes: Through this course students should be able to

CO1 :: interpret the term tort as a civil wrong and compare it with other civil wrongs

CO2 :: identify the general and specific defenses

CO3 :: evaluate the factors leading to tort of negligence and nuisance

CO4 :: categorize the principles of tortious liability

CO5 :: assess the provisions of Consumer Protection Act, 2019

CO6 :: examine the provisions of Motor Vehicle Act, 1988 and Amendment Act, 2022

Unit I
Torts meaning and introduction : meaning of torts, essentials, injuria sine damno, damnum sine
injuria, cyber torts
Unit II
General defences : volenti non fit injuria, other defences

Defamation : meaning, difference between libel and slander, essentials of defamation, defences

Unit III
Negligence : essentials of negligence, res ipsa loquitor, contributory and composite negligence

Nuisance : meaning and essentials of nuisance, difference between public and private nuisance,
defences in nuisance
Unit IV
Vicarious Liability : meaning and instances of vicarious liability, doctrine of common employment,
meaning of state's vicarious liability, instances of state's vicarious liability
Strict and absolute liability : meaning and instances of strict liability, meaning and instances of
absolute liability
Unit V
Consumer Protection Act : meaning, need for the amendment to Consumer Protection Act 1986,
changes incorporated in the Consumer Protection Act 2019, essential provisions of consumer
protection Act, 2019, consumer grievance redressal mechanism, consumer protection councils, central
consumer protection authority, consumer disputes redressal commission, product liability, offenses
and penalties, mediation
Unit VI
Motor Vehicle Act : no fault liability, fault liability, insurers liability, insurance of motor vehicles,
claims tribunal, essential provisions under Amendment Act 2022
