Permission To Protect Against Fish Aquarium in Gujarat Council of Science City, Ahmedabad

activity so that the nation constantly rises to higher levels of endeavour
and achievement.

his child or, as the case may be, ward between the age of six and fourteen

Facts being bonafide omission:
No doubt, Gujarat Science City is a science education and entertainment
centre located in Ahmedabad, opened in 2002 and expanded in 2021,
having in public domain, an aquarium, an aviary and a butterfly park; as
well as other facilities, related to commercial use biological resources.
Aquatic gallery: The aquatic gallery is spread over an area of 15,000 square
metres (160,000 sq ft). It has 68 tanks which hold brackish, marine and fresh
waters in variety of ecosystems marked as Indian, Asian, African and American
Zones. It has 11,690 animals from 188 species. The shark tunnel in the gallery is
28 metres (92 ft) long.
Exemption required:
1. Commercial utilisation of biological resources, from the Gujarat State
Biodiversity Board.
2. Performing animals, read with section 27(b) of PCA Act, 1960, from the
Gujarat State Animal Welfare Board.
3. On behalf of Brand Ambassador Viyana Berwal via her grandpa alarming
public:
Requested to grant permission to protest, in front of Gujarat Council of Science
City, with 101 volunteers, similar permission required from Gujarat Animal
Welfare Board - Gujarat Biodiversity Board - DSPCA - BMCs, for Introduction of
draft for the Prevention of Cruelty to Animals (Aquarium and Fish Tank Animals
Shop) Rules, 2024.
If they have not obtained exemptions, then FIR may be lodged against the
operators and promoters with animal owners, being criminal conspiracy as
organised crime, read with violation of the legal frame work as follows:
1. As per section 3 of the Prevention of Cruelty to Animals Act, 1960:
Duties of persons having charge of animals: It shall be the duty of every
person having the care or charge of any animal to take all reasonable
measures to ensure the well-being of such animal and to prevent the
infliction upon such animal of unnecessary pain or suffering.
2. Bharatiya Nyaya Sanhita, 2023: As per section 2(2): “animal” means any
living creature, other than a human being.
3. Prevention of Cruelty to Animals Act, 1960: As per section 2 (a): "animal"
means any living creature other than a human being.
4. Section 27 of the Prevention of Cruelty to Animals Act, 1960.
5. Performing Animals (Registration) Rules, 2001.
6. Prevention of Cruelty to Animals (Animal Husbandry Practices and
Procedures) Rules, 2023.
7. Prevention of Cruelty to Animals (Establishment and Regulation of Societies
for Prevention of Cruelty to Animals) Rules, 2001.
8. Section 2(d) of the Prevention and Control of Infectious and Contagious
Diseases in Animals Act, 2009: “Compulsory vaccination” means
vaccination of any animal against any scheduled disease in respect of which
vaccination is made mandatory under the provisions of this Act.
The "fish, molluse, crustacean and amphibian" shall be aquatic animals
within the definition of "animal" defined under clause (a) vide notification
No. S.O. 995(E), dated 1st April, 2014.
9. Prevention of Cruelty to Animals (Aquarium and Fish Tank Animals Shop)
Rules, 2017, read with G.S.R. 1474(E).—In exercise of the powers conferred
by section 38 of the Prevention of Cruelty to Animals Act, 1960 (59 of 1960),
except as respects things done or omitted to be done before such
withdrawal, the Central Government, hereby withdraws the notification
number G.S.R. 493(E), dated the 23rd May, 2017 of the Government of India
in the Ministry of Environment, Forest and Climate Change.

12. Orders passed in SLP (C) No. 11686 of 2007, clarified vide Supreme Court
order dated 18.5.2023 in WP (C) No. 23 of 2016, read with article 51A of Indian
Constitution, being fundamental duty of every Indian: FREEDOM: Chapter
7.1.2 of the guidelines of OIE, recognizes five internationally recognized
freedoms for animals, such as: Freedom from hunger, thirst and
malnutrition / Freedom from fear and distress / Freedom from physical and
thermal discomfort / Freedom from pain, injury and disease and Freedom to
express normal patterns of behaviour.
